The customer is correctI had a written contract with mr.***But when he decided he didn't want us to finish the project, I then needed to be compensated for my time, materials, and dump feeTaking all my jobs profits from this year into account, My hourly rate averages out to $dollars an hourMr [redacted] insisted in an email that he sent to me, that we use the $an hour per guy listed on the second page of our contract to determine the wages owed to me for work that had been completedSo even using that figure, the total amount owed to me and my company far exceeds the $dollar deposit I received from mr.***I have emails from him to back up what I am stating is trueI also have emails from him trying to black mail me with bad responses on the internet if I don't do more work for him for freeI will gladly submit these emails to Revdex.com Anytime the Revdex.com needs these emailsI never said I installed any flooring in mr ***s bathroomHowever he claims there wasn't any wallboard installedI challenge mr[redacted] to provide pictures with proper dates showing that wall board wasn't installed in his bathroomAlso, there was a few garbage bags left in his garageThis is because we didn't get a chance to remove garbage bags due to the fact he decided to go with another contractor before we could remove themI also challenge Mr [redacted] to show documentation of a contract between himself and his new contractor his chose to do the workMaybe he contracted electrical, but the other 85% of job, I am certain he did the work himselfI believe this was his plan all alongHave bathenvy do the intense demolition and wall board and then he would fire us and do the majority of the work himselfHowever, this does show the evidence of how intense and time consuming the demolition of his bathroom took to completeMy trailer is feet long and almost wideWith sides that are feet in heightAt the most it usually only takes trailer load to remove demolition debris from a bathroomMr ***s took trailer loads and still had a few garbage bags In his garageBottom line is mr[redacted] decided to go this routeAgain, I have all documentation to back up my statements

I,myself and one of my employees did a full demolition of mr***s bathroomWood backing was installedWall board and under layment was installedDemolition debris was hauled to a dump site roughly an hour awayIt took two trips to dump site to unload the debris from mr.***s bathroomI was
there with my employee the first day for the entire dayBetween us the labor hours were hoursThe second day I was in and out because I was hauling debris to dumpI left my experienced employee on mr***s project so to keep it moving while I was hauling debris to dumpAfter the second day myself and my employee had hoursMr*** is correct that I was not there consistently throughout the dayThis is because I was hauling debris to dump siteOn the third day my employee hung wall board and installed under laymentI was shopping for material and bringing it to the job siteAlso my employee installed foam insulation on exterior wallOn the third day my employee had labor hours and I logged a generous hoursThis puts the total hours at labor hours and roughly ( including dump fees) $in material costs out of my pocketOn the fourth day I informed mr*** I would not be on his project due to truck issuesMy company completes roughly bathrooms a week, so I would have to look back at my notes as to why I couldn't be there on that fourth dayBut I am pretty sure it was mechanical issues that needed to be resolved immediately with my truck so I could continue with project and have it done in a timely fashionMr*** then sent me an email stated he was hiring another contractor to finish work in his bathroomMr*** is correct on the delay of the start date of his projectUnfortunatly because of the previous customer adding a bunch of additional work in his bathroom it delayed the start of mr***sI did however keep in contact with mr.*** and had much communication on where things were the schedule was at to start his projectIt wouldn't be fair to mr.*** or previous customer to start mr***s project without the previous one being finished firstWe do our best to stay on track and on schedule but many different situations can arise that unfortunatly cause delays of start dates of projectsWe always keep our customers informed on what's going onAnd company policy is to complete one bathroom before starting anotherSo on the second page of the contract between mr.*** and my company it states a $per hour per laborer to complete workSo using this figure and taking into account the labor hours on mr.***s project this equals a sum of $which includes materialsMr*** is asking for his $dollar deposit back from my companyI think it's fair to say that mr.*** owes my company $dollarsBut to showi value his time and for waiting that extra time to get started on his project I felt I would call everything a wash and waive the $he owes the companyQuite frankly after mr.*** decided to hire another contractor I was relieved not to get in any deeper with a customer of suchIn any other circumstance s customer understands delays in a business of such and are much more reasonableAgain we do our best to stay on track with scheduling

Mr. [redacted] insisted in an email that he sent to me, that we use the $47 an hour per guy listed on the second page of our contract to determine the wages owed to me for work that had been completed. So even using that figure, the total amount owed to me and my company far exceeds the $1600 dollar deposit I received from mr.[redacted]. I have emails from him to back up what I am stating is true. I also have emails from him trying to black mail me with bad responses on the internet if I don't do more work for him for free. However, this does show the evidence of how intense and time consuming the demolition of his bathroom took to complete. My trailer is 12 feet long and almost 5 wide. With sides that are 3 feet in height. At the most it usually only takes 1 trailer load to remove demolition debris from a bathroom. Mr [redacted]s took 2 trailer loads and still had a few garbage bags In his garage. Bottom line is mr.[redacted] decided to go this route. Again, I have all documentation to back up my statements.

I am rejecting this response because:Our contract with M. [redacted] with us was to remodel the bathroom. The contract included a start date on May 23 with completion by May 31.  This was not a time and material contract; it was a contract for the entire project. The contract was supplied by Mr. [redacted] and listed 28 action items to be completed. The list of action item items was compiled by Mr. [redacted] Mr. [redacted] worked one day on the project worked on June 1 and we paid the down payment of $1600. (the project was already 8 days later in starting)  His emails explaining the late start reiterated a promise of once he started,  he would be onsite and working every day until completion. After not showing up for 3 consecutive work days, we received an email from Mr. [redacted]. Stating “I can't make an honest commitment at this point, to being on your job every day till complete. I would be open to terminating the contract".   He never showed up at the job site after this email. He was on action item 2 at this point.We asked our down payment back. He refused to return the down payment.  We sent him an email stating that if the down payment was not returned  we would report him to the Revdex.com, and if needed, proceed to Small Claims Court. This is what Mr [redacted] refers to as blackmail.  I do not believe a report to the Revdex.com constitutes blackmail.My wife and I are senior citizens. Being senior citizens may make us look like easy targets, but we are well aware of services such as Revdex.com that help protect us as consumers.  We appreciate all the work an effort put forth by the Revdex.com in this situation but I believe we have taken this as far as it can go with the Revdex.com. We will  look to  “Small Claims court of Cook County” for resolution..
