line-height: 150%; font-family: Georgia;">I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

This is my response to your e-mail to me regarding [redacted] response to my complaint regarding the incomplete job his men did in replacing the shower in our bathroom:

All [redacted] did in his response was to send you a copy of his contract which I had already sent you.  He did not address the issue of mold reappearing in less than two years after the high priced job was done.  I am not a plumber or a contractor but with the mold that was present in the shower when his men began their job it would seem they would look to  try to find out why the mold was present.   They were not plumbers but after the tile and wall was torn out,  if they had been any kind of reputable business, they would have looked to see what the problem was and told me.  I would then have had a plumber come and fix it so they could then resume their job of replacing the shower.  I was not present watching them as they worked but they were not honest craftsmen or they would have at least checked this possibility.  You never sent anyone who was not connected with this company to check out our shower and if all you need to comply with your request to [redacted] is another copy of his contract with no further explanation, then I think I'm wasting my time with you.  You are supposed to be protecting me not the contractor for a very poor job.  They did not look into the reason for my problem.  The contact said "to remove any mildew and mold that may exist".  That mildew and mold did not occur because the shower was installed properly, there was a reason for it and they did not bother to look into the reason at all.  I paid a high price for a shoddy job and NO I am not satisfied with [redacted]'s response nor the fact that this seems to be acceptable to you people.  I am looking further into this  problem as I paid a lot of money for a poor job to a very arrogant man who runs this company.

It is obvious that you did not read my original response to complaint ID
[redacted] so I will try to simplify my final answer.
The  mold  and  mildew  growing  in [redacted]  shower  is  caused  by
excessive moisture in her crawl space under her shower.
[redacted] was informed at the time of the instaJiation of her new shower that she would only have a ninety day warrantee due to the moisture in the crawl space under her shower. [redacted] was also informed that unless she corrected the moisture problem in her crawl space there would be nothing to prevent new mold and mildew from growing in her walls.
If you would send out one of your members who is in the water proofing business they will verify the cause of the new mold and mildew.
In closing I have enclosed a copy of the Delaware Business license [redacted] bathroom was don under. Please note the name of the company  was Dejay Enterprises LLC DBA Don Clayton. Dejay Enterprises ceased doing business in 2013.
This will be my last response.
Truly yours

Review: I contracted [redacted] to remodel my master bathroom. We had lengthy discussions about the scope and quality of the work to be [redacted]e. When I first saw the completed bathroom, I reviewed with [redacted] and his assistant, Ashley, the following issues: 1) The new floor squeaked; 2) There were large gaps between some of the floor boards; 3) There was a large scratch on the floor made by the installation of the toilet; 4) The shoe molding wasn’t attached to the wall and the nails used to install it were sticking out; 5) The vanity, backsplash, mirror and vanity light weren’t aligned, despite my explicit instructions; 6) The shower tile doesn’t extend to the end of the wall, leaving an unsightly jagged edge; 7) The wrong toilet was installed; 8) The towel bar was loose; 9) Grout was left on the outside of the shower pan, on the tiles, dust and wall board pieces were left in the vanity, paint spatters were left on the shower door – the workers did not clean up after themselves; 10) The shower head was not centered in the shower (I didn’t ask this to be fixed, because of the amount of work it would take to remove all of the tile, move the plumbing, etc., but I did tell [redacted] as an FYI for the workers); 11) The shower door was scratched.

As a result, the workers returned on 12/2 and replaced the toilet and the shower door. They also attempted some of the other repairs to the floor, etc. After they left, the following issues were still apparent: 1) The floor boards were moved, but gaps remained and new, worse gaps were created; 2) The scratch on the floor is still visible; 3) A stain appeared on the ceiling—looks like the polishing varnish used to try to fix the floor scratch; 4) The new shoe molding still didn’t fit properly*; 5) The towel bar became loose again in less than a month and one side actually pulled out of the wall*; 6) The threshold still squeaks; 7) Grout in the shower fell out in chunks (it should have been caulked)*; 8) The backsplash wasn’t removed, but they damaged the new wall trying to pry it off.* A new time was supposed to be scheduled to repair #7 & 8 repair, but never was.

During the course of the ensuing year, where my calls/texts were ignored, the following mistakes with the work were discovered later: 1) The cover for the shower faucet wasn’t attached, so water leaked in behind it*; 2)The putty used around the sink drain had holes in it allowing leakage*; 3) The toilet paper holder came loose*; 5) That the new exhaust fan was vented only into the ceiling (not into duct work), which over time could cause mold.** It was never disclosed to me that it wouldn’t be vented properly if I moved the fan; 6) A piece of flooring was never installed next to the back of the vanity (I guess because it is difficult to see, there was no reason to complete the floor?!); 7) There was paint dripped on the cabinet door (and on the cabinet in the other bathroom, where the workers washed up). [They also dripped while cleaning up that damaged that floor and scratched my The shower pan by storing the tools in it, but I didn’t mention this at first because I thought it was dirt that could be cleaned.]

After reviewing the work that was [redacted]e on 12/2, I was told that the workers would have to return on a Saturday to remove the backsplash, fix the damaged wall and replace the backsplash. I never received a call to schedule that. On 1/13, I texted Ashley to ask that the work be scheduled. I also let her know that the grout had cracked in places and had actually fallen out such that water could leak in. I received no response. On 2/7, I texted again to ask if my text was received. The only response I got was 5 days later “who is this”. On 3/21, texted again to schedule the fixes. I received no response. On 4/23 I texted again and reiterated that I would have water damage if the work wasn’t remediated and asked if there was someone else I needed to contact. I once again received no response. At that point, I contacted someone else to fix some of the problems before more damage could occur (those repairs are indicated above with an asterisk). I also had to have the fan part of the fixture disconnected so that it wouldn’t create mold. When I move, I will have to hire another contractor to reinstall the fan properly on the wall so that there is an operational exhaust fan in the bathroom.Desired Settlement: I would like to be reimbursed $3,000 (about 1/3 of the total cost) for the inconvenience of, and the time and money spent on redoing the work that had to be remedied; for a new floor, since there is not enough of the existing floor to replace the scratched board and to fix the gaps; and because there was not one part of the job that was done satisfactorily, the sales price was not fair.

Review: Bathroom shower was replaced because of mold on the tile in the shower. Within approximately 16 months after completion of the job, mold was again on the tile.

I called [redacted] and told him we had a problem with the return of the mold. He asked me when the job was done and when I told him, he responded "we only guarantee our work for 90-days." I told him that mold doesn't show up within 90-days. I told him we paid $3950 for a job that included removing shower walls and mold that existed. He responded in a sarcastic way "we don't guarantee a job for life". I responded to him that "for what we paid it should have lasted longer than it did. " I called him a few weeks later to remind him of our problem and he said he would stop by and look at the shower, but he never didDesired Settlement: The only way to get rid of the mold is to remove it from behind the shower wall. The only solution is to do the job correctly this time. The mold presents a major health risk.
