I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Thank you for looking at this matter for us.  We are concerned about the inaccuracies in Battaglini’s reply. When they gave us the estimate, a pressure washing was included in the cost of this job.  Our driveway has never been covered in dirt, even after heavy rainfalls.  We have trees near the driveway, so from time to time there may be some small debris  - but never covered with dirt. The first attached picture [redacted]-1 shows part of the driveway (including a large flaked off area) and a general view of the property. We believe it also shows the care we take in maintaining our property. Nothing on our property is ever filthy. The facts are: We paid $1,170 for the job shown in the pictures. [redacted]-2, -3 and -4 are of the area seen in [redacted]-1 near the top of our driveway and clearly show very large areas where the sealcoat has lifted off. [redacted]-5 is an enlarged view of an area on the side of the driveway near the top. [redacted]-6 is an area near the sidewalk to house, and -7 and -8 are from the area in front of the garage. These pictures show that the areas of flaking are large and wide spread. The job was accepted by Battaglini and they conducted their own pressure washing. Battaglini’s sealcoat lasted less than 6 months. The prior work lasted 6 years. No area of our property, including the driveway is or ever has been filthy. We work very hard to maintain our property. See photo [redacted]-1. When they first inspected the flaking they stated that they could not explain why it happened and that they would reseal the driveway without charge. After several months there was still no effort to reseal our driveway in spite of the fact that numerous Battaglini advertising signs were observed in our area where they did other nearby jobs. How could a business like this be member of the Revdex.com when they do NOT stand by their product or workmanship? We contracted with them to do a job, and paid in full after its completion, believing they would stand by their work, which is clearly not the case. We’re not interested in them “fixing” the mess they made of our driveway – we want a return of our money. Further detailed explanation: Battaglini never asked us at the time of arranging for sealcoating if we had previously coated the driveway.  We had done so (after being meticulous with our pressure washer and a hard bristle broom in cleaning the surface) 6 years earlier – our job held up for 6 years. They told us their work would hold up for 3 years, and accepted our check for $1,170.00.  When they first came to prepare our driveway, they pressure washed most of the surface, but our well regulator shut off our water supply when they still had an area in front of the garage to do. Ken B stated that they would bring their own water to finish the pressure washing. When they returned they finished the pressure washing using our well water. We were present whenever the crews worked on our property, and they never trucked in water. After the pressure washing, the sealing was done three weeks later. We questioned whether the surface was still sufficiently clean after this time, and Ken B explained that it was not unusual and that the crew would sweep the surface and blow off any debris with high-pressure air before applying the sealcoat. This was in fact done. At no time did anyone from Battaglini Sealcoating mention anything about dirt or previous sealing material, i.e. they accepted the job with their pressure washing. When we called them 5 months later about large areas of the driveway flaking off, Battaglini inspected the driveway and told us they “owed us a reseal”, and stated that “they couldn’t explain why it lifted up like that.”  When they came again to pressure wash the driveway prior to doing the reseal– again with our well water – the story started to change.  Now we heard that our previous reseal effort was the reason for the failure.  This actually made no sense since THEY had pressure washed the driveway to their specifications. Ken told us they have covered old reseal jobs often – that the second reseal would more than likely adhere, but would accept no responsibility if it did not.  But they never showed up to do the job.  We didn’t harass anyone – we were customers just trying to make sure that this work would get done. A majority of messages we left at their business were unreturned. Thank you for any help you can provide.[redacted]

fact the cracks are filled with dirt. We still took on the job with the provision that they pay for a complete pressure washing of the driveway. This was done after three attempts because (as was later admitted by this persons wife) their well regulator needed replacement and they had not had it fixed for years. This wasted a great deal of our time since the well kept shutting down while we were attempting to wash it. Finally on the third try we trucked water out in a tank to complete the washing of this neglected driveway.As we could finally see the surface it was obvious the driveway had been sealed previously. Sections of loose sealer came off during the washing process. The homeowners had sealed the driveway prior to contracting with us. Their application was most certainly done over dirty asphalt, they probably had difficulty cleaning it properly. We utilize a high pressure commercial pressure washer. This forced us to seal over their faulty application of sealer. Even though we removed all loose sealer freeze and thaw cycles will cause poorly bonded sealer to release during the winter carrying our sealer with it. This will happen regardless of how many time it is resealed.My secretary, who is also my Mother was being harassed by this customer on repeated occasions and she did ultimately hang up on him. We have THOUSANDS of customers. 99.9% of which are wonderful people, but there is always that .01%. This person is incapable of admitting his responsibility in effectively negating the possibility of his driveway ever being effectively seal coated due to his poor work prior to us coming in. We do NOT offer a three year warranty. We tell our customers they should look to reseal ever third year as it is important to allow the sealer to begin to wear before a reapplication to prevent a build up of sealer.
