Batten Seamless Gutters

Repayment of service that he didn't fix in a timely manner.I hired Batten Seamless Gutters to install Gutters and Black drain pipe in the ground. I have contacted Mr. Batten many time to let him know the pipe was coming up out of the ground. He came by once to so call fix the problem but it started coming out of the ground again and I had contacted him to let him know that I really need him to take care of the problem due to I was having my yard landscaped and that if they had to re-bury the pipe they may charge me. I contacted him two week before the landscaping work was suppose to be done and he never came by to take care of the problem. When I got the bill from the work I have done they charged me $60.00 to re-bury the pipe and he had agreed to pay for it. He told me he was putting a check in the mail July 29 or the 30 but I have yet to receive anything. I have tried contacting and texting him about this matter but he is not responding to any of my phone calls or text.Desired SettlementAll I am asking is for him to pay the $60.00 for the re-bury of the pipe. I don't think it is right or me to have to pay twice for the same service.
