The complainant signed up for a membership at our [redacted] facility on January 6, 2017. At that time, we were offering a promotion whereby all signup costs were included for $1. Additionally with this promotion, one free month was added to the start of all 12- and 18-month contracts. The complainant...

elected to sign up for a 12-month contract, putting the total term of the contract at 13 months with an expiration date of February 6, 2018. In summary, the terms were one month free followed by 12 months at $39.95 each. As the complainant stated, this was a signed contract. The complainant initially inquired about our $1 promotion through our Facebook page on January 4th, 2017 and followed up with a call to our office on January 6, 2017 when she spoke to General Manager [redacted], who advised her of pricing options as well as all membership benefits. When she visited the facility on January 6, 2017, she was offered a tour of the facility, which is standard procedure at the time of any potential sign-up, however, she declined the tour, making it clear she wanted to sign up as quickly as possible. By all accounts, she seemed excited to get started with her membership. After her initial sign up visit, our records indicate she visited the club only one more time, on January 21, 2017. At no time was there any indication that the complainant was uncomfortable with the staff or any members of the gym. At no time was there any indication that the complainant felt as if she was treated unfairly. At no time did the complainant reach out to our staff about any concerns.  Our records indicate the complainant called our facility on October 17, 2017 regarding billing and membership. Our records indicate that we waived all late fees and all service fees that had been applied to her account at that time. The complainant inquired about cancelling her membership and was told to stop by the office to fill out a cancellation form. She did not seem to be upset or irritated and did not bring up any of the issues which she stated in the Revdex.com complaint. This was the last contact the complainant had with any staff member. On December 26, 2017, the complainant’s account was turned over to a third-party collection agency. Between September 7, 2017 and December 15, 2017, either Anytime Fitness or our billing company (ABC Financial) tried to contact the complainant regarding her past due balance a total of 52 times in an attempt to avoid having the account referred to a collection agency. These attempts were made to the complainant’s email on file, address on file, and phone number on file. In summary:Total contract value:  $479.40Total payments:         $279.65Unpaid balance:         $199.75Total service fees:      $47.50Total late fees:             $97.50 As a courtesy to the complainant, we propose she pay half of the unpaid balance ($99.87). In return, we will forgive all remaining debt, waive all service fees, waive all late fees, and assure that no comments be reported to any credit bureau.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait for the business to perform this action and, if it does, will consider this complaint resolved. I will pay the $99 and change, and have the issue resolved so long as nothing is reported to the credit bureau
