I do not believe this case should be closedone yetIf you are saying that I need to contact kickstarter and kickstarter says I need to contact you then I need to make sure that you actually refunded the to kickstarter if that is how it goes I have sent in a complaint to kickstarter too Cuz Capital one has done their part in giving me provisional credit for the time being as their investigating this dispute but you guys are not responding to the disputeWhere is your confirmation? Because I have emailed you and even told you when I shipped back your product and you still did not respond to my emails resulting in me having to go through Revdex.com to get you to respondSo tell me exactly what you guys did regarding this issue did you let kickstarter know that you've received your items back? Did you make sure that you sent back the 264? I want documentation to make sure this is resolved.

Complaint: ***I am rejecting this response because: this is a canned response that I and others have received beforeThis also does not address the fact that we were overcharged due to 'retail' price which was blatantly misleading and fraudulentAttached are screenshots from yet another customer suffering the sameNumerous complaints have been filed with the Revdex.com and Attorney General, along with multiple outlets online complaining about the lack of communication, quality, change in materials, broken promises, advertising, etc
Refunds are more than possible for a 2-person business that has taken in more than $million dollars in 'good faith' money.Sincerely,*** ***

BauBax, first let me thank you for the prompt response
Now, let's apply some basic UCC contract law in order to review the facts of the situation
(i) *** *** (Plaintiff) entered into a contract with BauBax LLC (Defendant) via the Kickstarter platform in July of in order to acquire three (3) units of their product, at specified quality (as per BauBax LLC marketing campaign circa July 2015) and on a specified time period (November 2015) Subsequently, Mr*** made a number of communications to BauBax LLC both in advance of and subsequent to the transaction in order to emphasize the importance of the November time period
(ii) BauBax LLC first (a) missed the specified delivery period, and next (b) made significant changes to the end product with regards to features / configuration, construction, and overall quality Both of these related actions are tantamount to a default of the original contract, and constitute separate counteroffers by BauBax LLC to *** *** and other backers, to be discussed in further detail below. For meantime, condition (a) resulted in Counteroffer #by BauBax LLC to Mr***
(iii) During early December of 2015, when the issues related to product quality and missing / adulterated features were not yet known, Mr*** accepted Counteroffer #by BauBax LLC, conditional on delivery of the products by the Christmas holiday (see e-mail communications) BauBax LLC subsequently defaulted on this Counteroffer, this in effect triggered Counteroffer #by BauBax LLC to Mr*** on 12/25/2015, which Mr*** did not specifically accept
(iv) It is now late March Mr*** has not yet received any product from BauBax LLC A small handful of backers are indeed receiving their products, which has brought the aforementioned (b) significant changes to the product to light, and triggered Counteroffer #by BauBax LLC to Mr***, which supercedes Counteroffer #
(v) Mr*** expressly rejects Counteroffer #by BauBax LLC BauBax LLC is now in default of the original agreement and owes damages for (a) return of purchase price of $and (b) time value of money of ~$
(vi) Mr*** would like to remind BauBax LLC that only the terms above will constitute an acceptable response to this complaint. Given that BauBax LLC is continuing to market and distribute their products to third parties as they have admitted with their March response, and allegedly stands by their quality and brand, Mr*** feels that the requested action should be more than manageable for BauBax. Mr*** is prepared to (a) take actions to dispute charges with American Express and (b) take the matter to small claims in the event that this effort to resolve the situation outside of court is not successful
We further noted that you have referenced social media multiple times in your March response to us However, the overwhelming consensus on said social media is that BauBax has been deleting nearly all unfavorable comments on all of its platforms where such an action is possible to do On the Indiegogo platform, instead of deleting unfavorable comments, BauBax has taken the insidious route of editing said comments in order to make them visible to the commenter only, and not anyone else (multiple examples that we will be happy to provide). This further clarifies my position that BauBax, LLC is not an ethical organization, and reinforces my resolve to refrain in supporting them in any manner

We are doing are best and have been giving updates as readily as we can with the information that we have and are in full compliance with the Kickstarter Terms and Conditions they agreed to

Kickstarter page directlyOnce this is official posted to the sign all backers who have supported our campaign receive a direct email (per their email on file with their Kickstarter account)
Unfortunately, we did not meet our initial deadline of the holidays, due to a few caveats; shipping delays per the Chinese holidays and customs hold-ups as we are a 1st time company importing into the U.S.Awhich has a more thorough inspection process.
With that being said, we have began shipping to our International customers (Non-North American orders)This began on 2/16/and we have seen pictures posted on social of our customers receiving themIn addition, we will begin North American order shipments on 2/26/In a recent update provided to our backers on 1/14/2016, we informed backers that orders would begin shipping at the end of 01/- and go through end of 02/We are slightly delayed from our adjusted schedule with this timeline
Yes, we have started selling to third parties, however, we have assured our customers that our Kickstarter backers and Indiegogo supporters would receive their orders before any 3rd party customer would(As addressed in our latest update on 02/19/2016)
To date, this holds true as our Kickstarter customers are receiving our jackets (per our social media posts)

Complaint: ***I am rejecting this response because: Contrary to Baubax's statement, I believe them not to be in full compliance with Kickstarter rules and regulationsThey are not communicating clearly or regularly with their backersThey began selling to third party backers before Kickstarter backers received their rewards, contrary to the agreement made to backersThere is reason to believe they uploaded a video which misrepresented the functionality of a portion of the travel jacket- specifically the "built in pillow" (not allowed by Kickstarter)They misrepresented the type/quality of fabric used in the sweatshirt style jacket and buried this information in a shipping information update and well after the end of the campaignThe size charts v actual product are significantly different for a large percentage of Kickstarter and retail outlet backers/customers, as evidenced by the comments section of the Baubax-Kickstarter comments page
I have backed KS campaignsFewer than of those rewards were shipped on time, but EVERY other business managed to stay in contact with backers and provide real information explaining delaysIt's Kickstarter- I don't expect my reward to get to me on timeWhat I do expect is transparency and accountabilityI like the point another backer made- Baubax selected their manufacturers who put together the productThey are not shy to take credit for the reports of good quality of the jackets when they post a favorable review for themselvesBaubax also selected their shippers, yet they don't own the delaysAll we get are canned responses about how the shipping problems aren't their faultTHAT is just poor formIn addition to my Revdex.com and WaState AG reports, I have contacted my credit card company to dispute the chargeNot because I haven't gotten the jackets I ordered, but because Baubax broke it's contract with backers in regards to quality of materials and functionality of the jackets; and by abandoning/or significant delay in shipping to Kickstarter backers in favor of filling retail orders before their original backers There are many other posts on the comment section of the Baubax-Kickstarter page that outline the multitude of ways the contract was broken Baubax does not get my support for their lack of integrity

However, the resolution proposed by the business is not adequate at all, and I would like to reopen my case (complaint #***)
More specifically, my complaint was that due to ongoing delays of a number of months, I STILL haven't received my goods, and it is now impractical for me to receive them as the intended recipients are all at different addressesFurther, I'm sick of dealing with the non-communication of the business and would just like a refund
