PRIOR to this conversation, I had been given a tracking number which never works + failed to show anything after weeks timeAnd the number given to me are not the same with the one listed on the reply

We are doing are best and have been giving updates as readily as we can with the information that we have and are in full compliance with the Kickstarter Terms and Conditions they agreed to

Unfortunately, we did not meet our initial deadline of the holidays, due to a few caveats; shipping delays per the Chinese holidays and customs hold-ups as we are a 1st time company importing into the U.S.Awhich has a more thorough inspection process.
With that being said, we have began shipping to our International customers (Non-North American orders)This began on 2/16/and we have seen pictures posted on social of our customers receiving themIn addition, we will begin North American order shipments on 2/26/In a recent update provided to our backers on 1/14/2016, we informed backers that orders would begin shipping at the end of 01/- and go through end of 02/We are slightly delayed from our adjusted schedule with this timeline
Yes, we have started selling to third parties, and with our delays, there have been a few customers that have received their jackets prior to our Kickstarter and Indiegogo backersWe are working feverishly to fix this and get the backers their jackets as soon as possible.
To date, this holds true as our Kickstarter customers are receiving our jackets (per our social media posts)

The company still has not addressed the issue of the sizes being way offI thought that I should order a small bomber jacket because that's fairly typical for my sizeI reassured myself with their sizing chart, and went with the XS, as a small would have been way too big based on their measurementsI have received my XS (conveniently after filing a complaint here), and it is way smaller than their size chart saidI would like to return the item for a full refund.

You state you have done everything you can to communicate with your backers, yet updates have been few and far between (reference your Indiegogo/Kickstarter/Facebook customer comments)
You agree that you have sold your product on 3rd party websites before filling orders from your backers and state that it was a mistake that needs to be fixed, as if you're not in control of your product
You continue to miss new shipping deadlines without any communication as to why or when I should actually expect to receive my order Should I wait indefinitely?
I emailed your support team on March through your Indiegogo support email address requesting a refund and did not receive a reply It is up to you to monitor your customer communication channels
You are not a charity I did not donate my money to you I funded you to deliver a product to me and you have not been able to deliver it within your repeated, self-imposed delivery times (though selling your pre-paid products on other websites has not been a problem) I want a refund of my money to end this fraudulent nightmare

On the Indiegogo campaign we never mentioned the Sweatshirt is 100% cottonOur materials were updated in August of which we notified our Kickstarter backersOur Indiegogo campaign started in September and per the attached screenshot, our supporters through Indiegogo were shared the fabric blends of of all our styles

Note that the Kickstarter Terms and Conditions are the contract between backers and BauBax, nothing elseKickstarter backers should know and/or acknowledge that while BauBax sincerely attempted to meet all of its goals and the goals of its backers, it had license and appropriately did make changes in certain situations.
In regards to the quality of the material and functionality, the material of a polyester/cotton blend is a stronger material that will hold each of the pockets contents with little to no sag.
Furthermore, in regards to third party purchases getting "ahead of" kickstarter backers, this simply should not be the case but has to do with inefficiencies in BauBax's process and use of a third party packerDespite BauBax sending the Jackets for Kickstarter backers to its fulfillment center before it sent any third partiesThese third partied being a more established company's, were simply able to move more quickly then we were
At this point, refunds are not possible, because all orders information produced and shipping information has been sent to our fulfillment centers for processing

Complaint: ***I am rejecting this response because: my complaint was not only based on the poor fit and nonstandard sizing of the jacket, but also on the advertising that lied to customers, the promised features that are not present, the poor quality of the jacket and stitching, the poorly-judged attempt at certain features (such as an eye mask that functionally blinds the wearer while the hood is up!) - I don't want another jacket of a different size that will still have every other problem I am complaining aboutThe size is the tip of the iceberg in this situation
The business are selling their product on other websites so I reject their claim that they cannot refund my jacket as they could easily resell it to another customer as they are still taking ordersThey raised over $million, they are hardly a penniless startup unable to refund a single jacketThe product is SIGNIFICANTLY DIFFERENT TO ADVERTISED which is why I believe the company's behaviour is FRAUDULENT.Sincerely,*** ***
