Note that the Kickstarter Terms and Conditions are the contract between backers and BauBax, nothing elseKickstarter backers should know and/or acknowledge that while BauBax sincerely attempted to meet all of its goals and the goals of its
backers, it had license and appropriately did make changes in certain situations.
Furthermore, in regards to third party purchases getting "ahead of" Kickstarter backers, this simply should not be the case but has to do with inefficiencies in BauBax's process and use of a third party packersDespite BauBax sending the jackets for Kickstarter backers to its fulfillment center before it sent any third parties, these third parties are more established company's, hence they are simply able to move more quickly then we were
At this point, refunds are not possible, because all orders have been produced and shipping information has been sent to our fulfillment centers for processing
Finally, your order has already been processed and shippedYour tracking information will be available to view no later than tomorrow: FedEx - ***.

Complaint: ***I am rejecting this response because: After months of back and forth emails the most helpful response I recieved was an email detailing exchangesThis was only AFTER I had asked for a refund and no longer wished to deal with this terrible companyFor a startup that received over $9million on Kickstarter alone, there is no reason that refunds cannot be issued for legitimate reasons besides blatant disregard for the cuatomera who gave them the money to begin retailing their jackets before they had even finished distributing the original orderThis on top of customers who recevied jackets that did not fit as advertised (like myself = advertising), customers who were allowed to order Tall sizes (of which were never produced = customer fraud), and a company who DOES issue refunds but only to some customers who made enough of a fuss that Baubax just wants them to go awayThey have recieved complaints to the FTC, ICand the Attorney General of WAEven after they admitted they didnt make Tall sizes and had just sent out the lettered sizes, and issued refunds to those customers who realised the fraud, they still continued to sell Tall sizes on secondary retail sites like Indiegogo pre-order (whichnis NOT a donation) and Touch of Modern

This is rediculous and this business has no other accountability as they remove any negative comments from their facebook page
I have been asking for a refund both because the jacket didnt fit even AFTER the company told me explicity it would, it arrived in March instead of the promised November (advertising), they promised Tall sizes and were either not available to choose, or were chosen and never produced (consumer fraud), and many jackets do not fit as advertised with measurements ranging from too long in the arm, or too small across the breast compared to the provided charts upon orderingI only ordered a jacket under the promise that Tall sizes would be availableOnly after they took your money and messed around ignoring customers for months did they tell you that they never even produced themBaubax has refused my request for a refund even though other customers with similar issues has received one, and I have put in complaints also to the FTC, ICand Attorney General with hopes I can get my money backIm an Australian and I cannot afford to pay return shipping for a jacket that by all accounts may not even meet the sizing chart when it arrives, which at this rate will be after winter making the garment redundant for a year
I would like a refund and I have taken the matter to my Credit Card company to get the charge reversed since Baubax is so against helping the customers who gave them the moeny to be a 'startup' in the first place

We understand the frustration, however, we do have an exchange policy that states “If you follow the sizing chart carefully, then the jackets shall fit you just fineStill, if you wish to exchange your jackets for any reason, we’ll happily do that but you’ll have to pay for the two way shippingAs we are just starting up and offering our jackets at highly discounted prices on Kickstarter, we won’t be able to accept returnsPlease make sure the items are unworn and unwashedAlso, all items must be in the condition you received them with all hangtags still attached.”
In our email communications, we have asked all customer to verify their sizes based on the sizing chartThis is what we have tested and assured our customers (American sizes)Based on the information provided, we have done our best to provide as much information prior to making the selection of size in each of our customer ordersYes, it does take time to process returns as we are working feverishly to get all our customer orders outAnd for this we apologize for any inconvenience

With that being said, we have began shipping to both International and North America orders to our customersThis began on 2/16/with International and the week of 02/22/for North America ordersIn a recent update provided to our backers on 1/14/2016, we informed backers that orders would begin shipping at the end of 01/- and go through end of 02/We are currently on-schedule with this timelineAlong with our latest update provided to our backers on 03/01/regarding additional shipping statuses.

Unfortunately, we did not meet our initial deadline of the holidays, due to a few caveats; shipping delays per the Chinese holidays and customs hold-ups as we are a 1st time company importing into the U.S.Awhich has a more thorough inspection process.
As we have stated, yes, we are delayed in shipping orders for ***, however, we are beginning to ship internationally and will soon begin North America orders once all our Kickstarter backers shipments have been sent.
Furthermore, the delayed responses from our support team has been addressed as we have asked our backers with questions to be patient as we are backloggedMost recently we implemented an automated response that has asked our customer to be patient with our response.
Yes, we have started selling to third parties, and with our delays, there have been a few customers that have received their jackets prior to our Kickstarter and *** backersWe are working feverishly to fix this and get the backers their jackets as soon as possible.
In addition, we do ask customer to email our support team with questions, comments, and concernsAfter checking out logs, we have been in correspondence and dialogue and answering the questions you have asked us

Complaint: ***I am rejecting this response because I had chosen the "correct" size of the Black Women's Bomber in Medium (technically I wear size which equates to a Small size based on Baubax's sizing chart Even on Ebags, they report sizing runs small Just to give you an idea I actually ordered a Baubax sweatshirt in Women's XL so that it would be a comfortable fit Even in the conversation with Baubax, when asking about exchanging for the "right" size, I asked if my husband wore a size medium, they recommend to roder the XL size which I did and I ended up exchanging my small bomber instead to give my husband a bomber who wears medium but ordered XL which fits - but requiring to order sizes up I think it's wrong to put blame on the customer when the merchandise has sizing inaccuracies I don't normally file Revdex.com complaint, but I don't see why I need to pay additional $22+ for shipping both ways when it's the company's fault for not producing the right sizes I am not asking for exchange now, I am asking for compensation for the shipping fees I had to incur for Baubax's error and their own agents indirectly admits to the fact that I need to order sizes up on the bombers Sincerely,*** *** ***

This is the same form message I have received from the business previously, and does not address my specific complaints, particularly with respect to their hood sizing I ordered the correct size for my measurements, but I did not receive a jacket that matches those measurements I am not at fault for the defective product I receive; the business should be responsible for either refunding the cost of the defective product or paying for the exchange shipping

[email protected], on a separate email chain, has told me for the past few days that they will refund me via Paypal, but it hasn't happened. All I want now is a refund. Continued vague promises about delivery at some undefined future date is not acceptable. Keeping my money for five months past the original date is unacceptable. I have spoken with *** customer support, and they have confirmed that Baubax is in violation of the *** Terms of Service.
Failure to immediately refund my $will result in my taking legal action in Small Claims Court in Massachusetts. I will be seeking Triple Damages. Baubax will receive a Certified Letter containing my legal Refund Demand on Friday. Sincerely,*** ***

And it is obvious that the moment I raised a complaint with Revdex.com, my product is at my door stepThis is not how a reputable business would behaveEven though I received the product, I would never do business with Baubax LLC, and I'd never recommend them to anyone

The company did NOT send what was ordered I and at least HUNDREDS of other BauBax jacket purchasers are experiencing the SAME problem: the jackets are TOO small, either 1-sizes too small despite following the measuring and size guidelines posted by BauBax company themselves They are insisting that they are made to their measurements, but we are insisting they are not Hundreds of us cannot be wrong They do not adhere to their own measurementsThey do not make a size larger than what I ordered which is already larger than what I should normally wear Their only solution is to order a man's jacket but mens clothing does not fit the same as women's clothing, so it will also be wrong This is not a case of me mis-ordering This is a case of the company having poor manufacturing without oversight as the jackets are smaller than they are supposed to be Continuing to respond that they have no responsibility is not a resolution of the matter when they do indeed have responsibilty to not commit fraud by selling products that don't fit I spent $on two jackets that do not fit and were not manufactured correctly Continuing to insist they fit your size guidelines does not make it true

The tracking number that is sent to customers is from the shipping company directlyOnce the tracking number is generated, it takes between 24-48hours to activate and that is why when you clicked on it there was an error

Complaint: ***I am rejecting this response because: It took extreme measures for me to get a response 1) a complaint to the Revdex.com and 2) a requested charge back from my credit cardThey were delayed in their responses to me via email.Sincerely,*** ***

I am still not satisfied from this response as a customer which has both paid and waited patiently for the product to arrive The status of the fabric changes made a larger impact than just a "pocket support," as that changed my value of the purchase As for working "feverishly" to push out product, there are other reasons I personally wish to receive a refund and no longer do business with Baubax.1) As stated the fabric changes aren't high on the list, as I was personally expecting something to change in either the design or materials used, but the concept that third party buyers are receiving their devices before Backers is rediculous The other rediculous concept is that those that have backed you up with more funds are the ones receiving their products last.2) Those in other countries which need to deal with a tax from customs also will be receiving their products later than anticipated Once customs receives the product, the customer will need to further pay the tax to receive the product (Which they have already paid prior to the shipment) Baubax has indicated they will not pay this tax themselves.3) There have been multiple time tables of when the product will arrive Starting from the expected Thanksgiving date, Baubax has stated a shipment in January, February, and March with no further details than "this is when you should expect your product." The better alternative is to know WHERE their product is and WHAT the company expects to ship to individual customers, rather than filling THIRD PARTY orders.4) Both through Social Media sites and other forums, Baubax, as a company, has not satisfied their customers feelings about their payment and product If there was any negative reaction to the company, Baubax's "customer support" skills were below par as comments were deleted and no comment was made This further angers the customer and wastes time for Baubax in deleting these comments.For these four reasons, I again request a refund from Baubax on what I have paid and no longer wish to do business or support Baubax.Thank you,
