Review: On February 2013, we had hired a contractor to repair water damages on (1) the ceiling in a TV room and (2) exterior wall in our house. The proposed total cost was $2850. Our insurance company has agreed to provide the full $2850 with the breakdown of $650 for (1) and $2200 for (2). Independent estimates from local vendors have also provided similar estimates as well. So, we signed the contract. The contractor had done the work on the ceiling in the TV room, but not on the exterior wall. The work done so far included installing approximately 12 square feet of sheetrock and painting that area, and the work was completed with 5-6 labor hours. The contractor has charged the total cost of $2150 ($1650 in addition to the $500 deposit we had already paid) for the work completed so far, which we believe is over-charge for the ceiling repair alone. We attached the contract and invoice from the contractor as well as the estimate from our insurance company as supporting documents.

Desired Settlement: We would like to settle on the appropriate value for the work done so far. Independent estimates (including the estimates from the insurance company and local repair companies) suggest that the cost of the ceiling repair performed by the contractor should be in the range of $500-$700. We would be like to settle on $700.

When repairing a home from water or fire damage we sometimes find conditions that vary from the insurance adjusters scope. If more work is required we seek a change order from the owner and we also negotiate with the insurance adjuster on behalf of the owner. Sometimes less work is required to complete the project at which point the owner in this case Mr [redacted] deserves a credit. After my empoyees complete a project my office bills it out. Our final step is to meet with the owner and inspect the finished project. Not only have I not completed this inspection step but Mr [redacted] refuses to return my phone calls. I will gladly write Mt [redacted] a credit for any work that was not completed but I need to inspect the work that was done to understand the amount of the credit. Mr [redacted] does not mention in his complaint that he failed to make his start payment of 1350.00 when we started the project. In fact he made no payments the entire time we worked at his house.I believe Mr [redacted] is due a large credit but he has put me in an unfair position by not making his paymenst and not returning any of my calls. If I do not hear from him I will ask his insuarnce agent to inspect the project so I may issue him a credit.

The Baybrook Remodelers Inc. did not accept our desired resolution nor offered an alternative offer yet. So, the

case remains open.

Regarding the inspection, the Baybrook's remodeling consultant, Mr. [redacted], came to our house to collect $1650.00

on March 14, 2013. We inspected the work done by Baybrook together, and we expressed that this is a over-charge for

the work done so far. After filing a complaint to the Revdex.com (Revdex.com) on March 24, we spoke with the president

and owner of Baybrook, Mr. [redacted], over the phone on March 31, April 10, and April 11. Mr. [redacted] and I have

agreed to meet and discuss the issue at our house on April 17. We intend to report outcomes of the discussions to the Revdex.com then.

Regarding the payment, it is not correct that we made no payment the entire time. We paid the deposit of $500 when we

signed the contract. Moreover, we did not receive the invoice for the start payment $1350.00. The contractor has started

the work (by sending workers to our house) before we made a start payment. The only invoice we received was $1650 at

the end of the work.

After a meeting with the owner of the Baybrook on April 17 2013, we have settled for $850 and paid this amount.

Review: Baybrook left me with an incomplete job and continue to harass me to pay the final fee. I have paid more than the contract stated should be paid upon completion, but held back some money because two things were not completed. My back door lock is not functioning properly and my gutter guard doesn't look right and is catching leaves.Desired Settlement: Fix the two issues and stop harassing me for final payment when the job is not complete. All other payments were made in a timely manner. The contract has been up since July and the work is still not complete to satisfaction.

Three months ago at the completion of the contract work I met with Mrs. [redacted] and explained that her front gutter was not installed properly. The gutter was installed in a manner that left a three inch gap between the end of the gutter and the house wall. Mrs [redacted] did not want to pay to have the gutter pulled off the house and re installed. As a courtesy I installed a diverter to close the gap in exchange for payment in full of 1000. After I performed this work Mrs. [redacted] refused to return our calls or letter. Mrs [redacted] finally allowed us back on her property this past Monday. Her request was for us to remove the diverter. When we arrived Mrs [redacted] said she would pay her 1000 balance only if we relocated her front gutter for free. Our crew removed her gutter, gutter guard and then reinstalled her gutter properly. This work was never included in our scope of work.

Baybrook completed the additional work for free and was able to collect the balance.
