I am writing to respond a second time to the dispute of [redacted] as referenced in the case ID aboveI need to clarify some misunderstandings I believe exist in this caseThe credit union only reports payments to the credit bureaus which are more than days lateOnce those payments become late, they are reported at the beginning of the month, following the date the account went over days lateSo, when we look at reporting we need to keep three dates in mind:1.) The payment due date, which per his loan documents was the 2O of every month, beginning on August 20, 2016;2) The date the payment, would have been considered days late; which would have been the 21st of each: month of the month, following the date the payment was dueFor example, August's payment would have been days late on September 21, 2016.3) The month in which delinquency would have been reported to [redacted] , which would be the month following the date the payment went over the 30-day thresholdIn this example, it would be October to report a late payment forAugust.For MrMack, we reported twice he was 30-days late and once he was 60-days lateI am attaching an excel spreadsheet which considers the three dates listed above, as well as, the dates and amounts of the payments he madeFor easier reference, I've color coded the payments received with the monthly payment to which they were appliedIt’s also important to take into consideration our loan plans require a payment every days.I have again reviewed his dispute and still do not believe the credit union has made an error in reportings [redacted] * *** loan delinquency.Should you have additional questions, please contact me at [redacted] ***

I am writing in response to the above-mentioned case submitted by our member *** *** ** ***In his desired resolution, he requested we change our reporting to the credit bureaus for the months of February and March However, we are required by regulation to accurately report all
payment history for our membersFor those months, he was late on his payments and the reporting was accurate*** *** took out a loan with us on July 5, with payments of $being due on the 20th of each month, with payments to begin on August 20, Below is a table showing his payment history: August 29, $September 14, $December 16, $February 7, $February 24, $1,March 27, $May 19, $June 26, $July 17, $ As you can see, in December 2016, he was paying October's paymentThe first payment in February was applied to November, with the second payment being applied to December, January, February and March with the remainder being applied to principalThank you for your time with this matterIf you should have any further questions, please feel free to contact me at *** *** *** *** Sincerely, *** ** *** Risk Mitigation Manager

I'm writing in response to the above referenced complaint from our member, *** ***oShe stated on 12/20/2017, she was charged three overdraft fees for one itemOur system pays debit card items in the order in which they are presentedHowever, when a company authorizes those transactions, they
may hold the funds for a later settlementIt was these held funds which decreased her available balance and therefore charged her the fee when authorizing three different transactionsRepresentatives from the Credit Union have explained this process to *** *** on several occasions*** *** our Member Services Manager, called her again upon receipt of this complaint*** *** is aware of the process, but does not like itShe also informed us she would like to continue to participate in the programWe do understand her feelings on this matter and have looked at various posting methods in previous yearsHowever, our current process seems to be the most beneficial to the member, as far as allowing transactions to approve and payWe have contacted our core processor to explore other possible solutions, other than posting order, which may make this process simpler and beneficial to our membershipPlease contact me should you need additional follow-up

Once those payments become late, they are reported at the beginning of the month, following the date the account went over 30 days late. So, when we look at reporting we need to keep three dates in mind:1.) For example, August's payment would have been 30 days late on September 21, 2016.3) The month in which delinquency would have been reported to [redacted], which would be the month following the date the payment went over the 30-day threshold. In this example, it would be October 2016 to report a late payment for. August.For Mr. Mack, we reported twice he was 30-59 days late and once he was 60-89 days late. I am attaching an excel spreadsheet which considers the three dates listed above, as well as, the dates and amounts of the payments he made. For easier reference, I've color coded the payments received with the monthly payment to which they were applied. It’s also important to take into consideration our loan plans require a payment every 30 days.I have again reviewed his dispute and still do not believe the credit union has made an error in reportings[redacted] [redacted] loan delinquency.Should you have additional questions, please contact me at [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I disagree because if I was late and or didn't pay in the months of October 2016 and November 2017 those two months are not reflecting late payments on my credit reports so I would assume that I wasn't. As far as the payment history goes that was provided, what I paid on December 16,2016 applied to October 2016 payment and the payment paid on February 7, 2017 applied to November 2016 payment. But how was I late and or 60 days late(as my credit report shows) for February 2017 when I paid $1000.00 on February 24, 2017 which would have taken care of December 2016 and January 2017 late payments, which also included and or covered February payments as well? Then you are reporting late for March 2017 in which it wasn't even due yet after I made the $1000.00 payment on February 24, 2017(in which you stated covered March 2017 payments as well and then the rest was applied to the principal) and made another payment on March 27, 2017. So your reporting is NOT accurate or correct and needs to be updated ASAP.
