We (Superior Foundations Limited) installed a foundation on *** for Mr*** ***, under the direction of *** *** (***The foundation was completed on November 19, when the floor
was pouredI myself was present for the pouring of the floor, and at this time the foundation was backfilled and the rear wall was straight and free of any cracksSeveral weeks later I was contacted by *** to go observe the foundation and then by Mr*** *** himself When I went to the site there was a large retaining wall installed in the back yard which was not there when we completed the foundationUpon looking at the foundation I noticed the rear wall was pushed inward and cracked in several placesThis was due the machinery working in the back yard in close proximity of the foundation wall with no lateral support on the walls (first floor framed on the house or lateral bracing or some other sort)This work was done by Mr*** *** himself it has nothing to do with Superior Foundations Limited We gave Mr*** *** a letter stating what happened to the foundation and how it could be fixed but unfortunately he is on his own with these cost

-the cracks started just a week after the foundation was put and *** ***(the excavation company who did the excavation)believes he should take responsibility for the cracks ,because he removed the wood too early and did not try to fix the foundation at the very beginning when it was much easier

In response to the rebuttal from *** *** stating that *** *** *** quoted saying that we (Superior Foundations Ltd) should take responsibility for the cracks because we moved the wood to earlyFirst of all we have been working with *** *** for many years and have a excellent business relationship with him and he at no point mentioned that we were responsible as *** mentioned*** *** knows that whoever installed the retaining wall broke the foundation wall he will have to get hold of whoever *** hired and get them to fix itWe are done with this matter and there will be no more correspondence from Superior Foundations Limited
