We have been dealing with Mr*** for several months regarding his allegation about damages to his vehicle. Please see the log below. Please note that we have every voice message on file. We are holding them as it’s highly possible that we will need to engage the police
department in this matter. If you would like to review any of the recordings, please let us know.5/20/16Mr*** left a voicemail complaining that he found weeds on the property. He stated that he told one of our employees to spray them, the employee indicated he would return to spray them. Mr*** relayed that he was certain he would not return and that he was going to tell the board of directors He was very angry about the possibility that we “might” not return to spray the weedsWe have this voice message on file if you would like to review. 7/15/1st callMr*** called to report that we had trashed the interior of his convertible. He indicated that one of our supervisors had seen the car and confirmed that we had “trashed” the car. He asked where to send the bill for his time and trouble to have his car cleaned. We have this voice message on file if you would like to review.7/15/2nd callWe received an angry, rude voicemail from Mr***. He was furious that no one answered the call. He ranted about how our employees must be illegal because they do not speak English. He indicated he was going to be on the board of directors soon and would make sure we were fired. He also indicated he would report us to ***. He ended the rant by telling us he would see us in court. 7/15/16, 3rd callAnother voicemail message with an angry rant about not answering the phone, complained about us trashing his car and that our supervisor in the truck insulted him by offering a *** *** gift card. Again, another threat about him coming on the boardWe have this voice message on file if you would like to review. 7/15/16RC L***, regional manager, contacted Mr*** to try to calm him down. MrL*** was cussed out by Mr*** and was unable to calm him down. He ended the call. Because of Mr*** threatening and abusive behavior, MrL*** directed the administrative staff not to engage in conversation with him. 7/15/4th CallMr*** called again and left voicemail threatening a law suit and also again that he will call *** about all of our “illegals”We have this voice message on file if you would like to review. Email exchange with Property management company regarding the situation with Mr***. The property management company also suggested we file an harassment claim if this continues as there have been other similar instances involving this individual. He has now contacted us and asked to pay for an invoice from a car detailer that he choose to go to and for his time doing soWe have told him to send over the invoice and we will reimburse but, we will not be paying for his time. I wanted to keep you in the loop as due to his behavior, we will not have any direct contact with him moving forwardAlso, if he continues to harass the crews and expect a car detail each week we service, we may not be able to perform our duties at his buildingThanks for understanding and I will keep you posted if any other problems arise. Mr*** sent us an invoice for a full car detail as well as additional charges for his time. We do not accept that this was necessary based on our visual inspection of the car. We sent a certified letter to Mr*** with a *** *** gift card which is what we believe the value of a high end car wash to be and also outlining that we will no longer engage him directly based on his behavior. He refused to accept the certified letter or the *** gift card. Jason K***, one of our owners also called Mr*** to try to calm him down unsuccessfully. 8/22/16 Mr*** takes his issue to ***. My first dealing with Mr*** was last year with his carHe stopped me on site and yelled at me pretty goodI looked at his car and there were a few grass clippings in the vehicle but no damage to the vehicleI offered a carpool gift certificate to help have the car cleaned and that was not good enoughAgain there was no damage to the car, and what little was in the car you could tell the crew did their best to blow around a convertible with the top downI thought I had pictures of the car, but they are not on my phone anymore for some reasonOn March 7th he stopped Jarrett E*** on site while cutting the grass and claimed that a " few weeks earlier " while cutting the grass that we chipped a window on his condoAs I explained to Jim and the property manager ***, we had not cut the grass since the end of October, early NovemberSo there was no way we had chipped his window cutting the grass " a few weeks earlier " what I gathered from Colleen's email is he is now claiming damage to the car again, so I really am not sure what he is complaining about, the condo or the car, which is typical in what little dealings I have had with Mr***I hope this helps out, please let me know if you have any other questions.4/3/17Mr*** contacts our office several times today verbally abusing the woman that answered the phone. We have recorded his calls to her. The behavior was very disturbing. We are contemplating filing a police reportShould you like to review the recordings, please let us know. I received Jason K[redacted]s (JRGM) response
to the complaint I filed through the Revdex.com. I was saddened that he responded
with only derogatory comments regarding my wife & did not address the issue
of the branch cutting without permission. I am leery of the company’s ethics,
given that the crew damaged & improperly repaired siding damaged by the crew & then stated it was too much work to replace the whole piece. Also, what
LAWN CARE company would tell a customer “It’s only a tree?”I have listed my concerns
below. Where there is a question posed in the list, I expect an answer to that
question, as any reputable business owner would do.1. My wife & I contacted JRGM several times. I was told by Lisa that Jason would return our calls.
I ([redacted]) have yet to receive a return call so that I may discuss this issue
with him directly. Why has he not
returned my calls?2. Specifications with
regards to our lawn maintenance were emailed to UPA in Mar 2014. Other than our
own home, other homes in our neighborhood have varying specs regarding their
lawn care. Why did the JR crew choose to
ignore our request? Other trees & bushes on the street (some blocking sidewalks) have the same
low hanging branches & they were not cut.3. The tree & the
length of the branches never extended out of our yard or onto the sidewalk. WHY
DID JASON INSERT THE WORD PEDESTRIANS IN the RESPONSE? 4. Why did Jason K[redacted] tell my
wife on Oct 21 to contact property manager, then tell the property manager on
Nov 9 that we had to contact JR, then respond thru Revdex.com “that she (my wife)
needed to contact her management company”? Again, why is JR refusing to
contact me, [redacted], directly?5. On Oct 21, Jason informed my wife that the tree would not die. Why won’t he put that in
writing? A reputable company stands behind their words.6. My expectations: A.
that you contact me via the phone number I provided. B. that you stand behind
your words about the health of the tree for a period of 1 year from the date of
the incident in writing.

On Oct. 20, 2015, crew members servicing the site at [redacted] pruned the lower limbs on a maple tree in the front of the house. We are contracted to provide these services.  The homeowner, [redacted], came out and was highly agitated. She began a verbal assault demanding that we replace...

the tree that we had pruned lower branches on,  informing us that we had no right to come into her yard and destroy her property without permission.  The cuts made to the tree are non-structural cuts. If not done, this would prevent the teams from servicing the lawn to the standards required in our contract. The contract requires mowing and maintenance for the area beneath the tree to include the tree ring. Steve Weiler, the production manager, was on the site at the time and was informed by the crew of this issue.  Below is a statement from Steve."I heard a commotion at the end of the street, I walked up to the home and a woman who identified herself as the homeowner began yelling at me and the crew members that we had "killed her tree and that we had no right to cut anything off of anything in her yard!" I tried to assure her that while I understood she was upset the tree should not experience any adverse effects from these small limbs being cut at this time of year. This was met with expletives and my being told that she demanded we "make it right by replacing her tree or she would sue James River and win!  I informed them that it was a mature maple tree and trimming those few branches should not cause death of the tree and that I could not justify replacing a tree that was just pruned and is clearly not dead.  Upon completion of site work that day I notified the Property Manager, [redacted], of the situation by phone and she stated that "they are not on a no cut list to my knowledge, and that the trees in the turf areas are our responsibility unless otherwise specified."  I notified an owner of the company, Jason K[redacted], who came out to the site and inspected the cuts that were made on the tree.  Please see Jason K[redacted]'s Statement:"I spoke to the homeowner on the phone which was a difficult conversation because of her intense emotional state. [redacted] was saying that we have killed her tree and that we will replace it.  I explained that we did not damage the tree and that these cuts were consistent with what was in the contract.  She demanded that I give her a guarantee in writing that if the tree dies we will replace it.  Because of her unwillingness to discuss the situation in a calm collective manner there was nothing I could say or do to appease her.  I politely told her that she needed to contact her management company, and that I could not help her further." The contract that was signed between James River Grounds Management and [redacted] dated April 3, 2014, states in the Definition of Services in Attachment 'B', section 'Pruning': "Low hanging branches will be removed from trees as needed."  This is done in an effort to not be an obstruction to the crew while doing the service and pedestrians in general.  There is no information that is included in this existing contract that would exclude the residents of [redacted] of maintenance services to include tree pruning.  Please advise as to what other information may be needed.
