Complaint: ***
I am rejecting this response because: The first time I went to bayview auto I was told that they can put me in a car for a $down with in-house finance so I put $down and a couple weeks went by and it was Christmas I asked for a refund and john said they don't give refunds. So it took me a couple weeks to save up and went back in with $more then I test drove the vehicle and the fill water light was on and I was told that the car runs perfect and that the light was just an electrical glitch. So I took there word and decided to purchase. Then john tells me can I come up with $more in weeks mind me I'm pressing for time I needed to get to work so I said yesdays later it overheated and stopped running in wahiawa. We called ***'s auto for a tow and to check and fix the vehicle. After checking out the car he informed us that it's a hole in the radiator and possibly the head gasket needed to be changed due to a patch job on the radiator. So he said that bayview auto had to know about that patch on the radiator and therefore sold me a lemon. So we informed bayview and john said they going get there mechanic to look at it and work with us on fixing the car. They towed it to there lot and was checking on it.Then they asked for the remaining $down payment I had told them it broke before the payment was due and I would pay them when the car was fixed. So we kept calling for weeks and finally got contact and now the first month payment was due and still no car. They was rude and threatened to send me to collections if I didn't pay the down payment and first month and also towing and fixing of the car.I am so stressed out living paycheck to paycheck as it is and I want no more shady dealing with bayview auto.I just want my money back and forget that I ever went there
Sincerely,

Subject: complaint response, ID OF [redacted] In response to complaint   Mr. [redacted] purchased a saab wagon from bayview auto sales.  He purchased...

this vehicle with the understanding that it was sold AS IS,  AS IS means the vehicle is sold the way it sits with all problems known and unknown and signed several contracts stating this. Mr. [redacted] financed this vehicle with a company we commonly use (family lending llc.) Part of our dealer agreement with family lending llc. is that the customer must complete all down payment monies and monthly payments must be made in a timely manner in relation to due date. When these things do not occur as stated in the contracts the vehicle is repossessed. The requirements on this contract were not met by Mr. [redacted], in that he did not complete his down payment nor did he make any monthly payments. This is a direct breech of contract.  Bayview auto sales would be happy to reinstate this contract and repair the relationship between Mr. [redacted] and family lending llc. If the customer chooses to complete this transaction.  In regards to the vehicles servicing, no work has been done only inspected. The customer over-heated the vehicle causing a much bigger problem than just a radiator repair. Due to over-heating the vehicles head gasket is now warped, the fix for this is costly and labor intensive. If Mr. [redacted] would like to bring this acct current with family lending llc then  bayview auto sales would be willing to share in the repair bills. However time is of the essence due to late fees and storage fees that are being incurred. The vehicle is presently at SOS recovery and service incurring storage fees daily. Bayview auto sales would be happy to discuss this with the customer as has been done already. Feel free to contact us at [redacted]  I hope this clears up the matter, and we are happy to answer any and all concerns that may come up in the future. If the past due amounts of the down payment, monthly payments, and bills incurred by bayview auto sales pertaining to the saab wagon that Mr. [redacted] purchased are not paid in full and recieved by Bayview auto sales by March 10th 2015  then Bayview auto sales will consider this a voluntary repossession as stated on the pre-repo agreement contract signed at the point of sale.                                         ... Sincerely,                                                                                                                                                          Edward ** S[redacted] ceo

Initial Business Response /* (1000, 5, 2014/04/16) */
April 15, 2014
To whom it may concern,
This letter is in response to the B.B.B (Revdex.com) complaint made by [redacted] against Bayview Auto Sales LLC. Mrs. [redacted] was a habitually late in-house financing...

customer. At one point we did not receive any payments from her for over 3 months. She bounced checks. moved, and did not update us with her address change. We have made phone calls to Mrs[redacted] and had sent her demand letters` Bayview waived late fees, gave her [redacted]. ALLL credits towards her vehicle, and tried to work with her in every possible way. The last conversation that Bayview Auto Sales had with Mrs.[redacted] was on March 30'", 2014. This conversation had ended with her calling myself.A [redacted] CEO, "A fker and your ae wife." She then went on to say and I quote "Come get your fking car I won't give you another dollar." Unfortunately I had multiple conversations with her of this natue. Her nasty deminer and general disregard for her signed agreement was habitual. The repossession order was given after our final conversation on 3/30/14. The vehicle was repossessed on 3/31/14. She was sent an updated demand letter to include the $489 balance and the $750 repossession fee. If she would like to recover the vehicle she can pay the balance and the vehicle will be released to her. lf you have any further questions pertaining to this matter you may contact me at any time.

Initial Consumer Rebuttal /* (3000, 7, 2014/04/18) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This is in response to Bayview Auto Sales represented by this [redacted], the CEO. First of all, I never conduct any business with this ** & the last time talking to him was not March 30, but the 28th. Friday. Calling me an in habitual late in-house financing customer is ridiculously funny. If it's true, they should have repo the jeep at that time especially three months of no payments and check bounced?
First of all, I withhold the second in-house finance payment which was due on May 14, 2013. Why, I didn't receive the car registration for three months (March, April, May) if its not been for [redacted], new manager at Kaneohe. Within this time period, I was cited twice by the police for expired safety check. Reason; no registration given to me after several phone calls with [redacted], **, [redacted], and [redacted] the title clerk. As a matter of fact, I never heard from any of these trio plus [redacted] after several failing attempts of phone calls enquiring about the registration status. When [redacted] took over in May, I told him that I will return jeep and get my $3,000 down payment back plus the first payment made
Final Business Response /* (4000, 11, 2014/04/26) */
Vehicle was repossessed due to non-payment. No correspondence is necessary.
