distributor of roofing and building materialsAs a roofing and building materials distributor, Beacon typically sells materials to roofing contractors hired by either general contractors or homeownersIn this case, Beacon had no contract with the homeowner nor did it have any interaction with him prior to his complaints because Beacon's customer was the homeowner's contractor. From his complaint, it appears that the homeowner is upset about the delivery of shingles and synthetic underlayment to his residence and alleges damage to his driveway caused by that deliveryAfter investigating this complaint, I understand that the homeowner's driveway was damaged prior to Beacon's delivery and that Beacon did not cause further damage to the drivewayUpon hearing from the homeowner that there was alleged damage to his driveway, the Branch Manager and Operations Manager immediately scheduled a visit the homeowner's residence for August 30, to investigateI will address the homeowner's specific claim below. The homeowner states, "Beacon delivered roofing shingles to my home and cracked the cement driveway.' Not soWhen Beacon's delivery driver arrived at the homeowner's*** *** *** *** *** Bethesda, MD *** *** *** www.beaconroofingsupply.com ** ***ReC| Ved: Sep O5:28pmBeacon Roofing Supply 05:48:p.mO3- 14-15*** *** September 14, Page 2residence on August 23, 2016, he did not drive Beacon's truck into the drivewayRather, he parked the truck on the street and used a forklift to deliver three pallets of shingles and synthetic underlaymentThe homeowner's contractor directed Beacon’s driver to deliver the pallets in two locationsOne pallet was delivered onto the grass to the left of the driveway and two were delivered to the upper right side of the drivewayEach pallet was delivered individuallyBeacon's driver took pictures of the pallets, which show no damage to either the grass or driveway where they were placedSee Exhibit A.On August 25, 2016, the homeowner indicated to Beacon's sales person that he thought our truck had damaged his drivewayOn August 26, 2016, the Beacon Branch Manager and Operations Manager scheduled a visit to the residence for August 30, Upon arrival at the residence, the Branch Manager and Operations Manager observed large cracks in the driveway at the end of the driveway closest to the street and spider web cracks throughout other areas of the drivewayOur Branch Manager and Operations Manager observed that there was grass growing in the cracks of the driveway, which would not be the case if the cracks had been created less than a week beforeSee Exhibit BThe homeowner indicated he knew there was a pre-existing problem with his driveway, but he thought Beacon had exacerbated the problemThe cracks the homeowner complained of, however, existed years ago, as seen in the photograph attached as Exhibit C taken in April, by *** MapsI am advised the clophotographs in Exhibit B depict the same cracks seen at the end of the driveway in Exhibit C.Following Beacon's investigation, on August 31, the Branch Manager informed the homeowner that Beacon had determined its equipment did not cause any damage and that Beacon was not responsible for repairing any existing damage in the drivewayIn response, the homeowner requested to speak to someone “higher up." On September 1, Beacon's Regional Sales Manager called the homeowner and explained again that Beacon's internal investigation concluded that the cracks in his driveway were not caused by Beacon's equipment."As a long-standing member of the local business community, Beacon places great emphasis on its reputation with homeownersCustomersatisfaction is extremely important to BeaconAs a result of its commitment to customersatisfaction, Beacon thoroughly investigated the homeowner's claim that it had damaged the drivewayBased on the photographic evidence in Beacon's possession and the observation of the driveway in person, Beacon determined that it did not cause the cracks in the driveway. The forklift weighed approximately 8,lbsEach pallet weighed approximately 3,lbsfor a total weight of 11,poundsFor context, the Department of Transportation’s Federal Highway Administration classifies trucks up to 14,lbsas "light duty.” Similarly rated vehicles include the *** *** 1500, *** *** and *** ***Typically, concrete would not crack under the weight of those vehicles or a forklift of the same weightIn the absence of any evidence that Beacon caused damage to the homeowner's driveway, we respectfully request that the complaint be dismissedCertainly, if there are additional facts that may bear upon this situation, we are happy to review them so that we can ensure that Beacon has done all that reasonably can be expected of itIf you have any questions, please feel free to contact me
