I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of why I am rejecting this response appear below:
#I have a screenshot of your warranty at time of purchaseIt implies a lifetime warranty instead of one year as your work is the bestI had a fence for ten years that never movedYours has moved 1/years after installation.#I never implied you are responsible for my dogYour fence, however, should remain upright to confine my dogThats why I bought it. #I contend you are responsible for the materials you installAnd even if not, you should be as a man of good businessHinges and so forth are not even a main problem so it doesn't matterIt was pointed out to show the overall work on this install. #you 100% told me you stopped using the fence company because of lack of uv inhibitors and customer identity theftIf those aren't the reasons, it would be curious to know why you stopped using themAnd a date of discontinuance compared to their out of business date would be curiousas for fading, I agree, everything fadesNot in and a half yearsAnd I supposedly have a lifetime no fade warranty in writing. #5.not saying you're responsible for my heaving drivewayBefore then, fence was blowing openYou even asked ME why the gate was installed the way it wasHow do I know I do know it sags in the middleAnd you tried to add more concrete at time of install when you inspected the work. #You readily admit the posts are above the frost lineyou told me upon install that "belling out" the bottoms would prevent heavingI would not have known this if you hadn't told meIt just didn't workShould I take responsibility for your expert decision on that issue? No problem if it doesn't cause heavingI rely on your expertiseWhy would I pay $for a fence that will not stay in place? Your expertise as a fence contractor is why I hired youIts unbelievable to me that you would install it this way knowing what would happen, imply a lifetime warranty, including labor, then delay and deny my calls for a year and a half. #Your crew has been out here ONE TIME...WITH NO TOOLS TO REPAIR FENCEthey moved hinges on gate and stated they would be back in May of this year to repair postsNo one ever cameWhy? You have been here twiceIn April 2014, you promised repairs would be doneNo one ever cameIn April 2015, same responseAnd again, nothing was doneOn top of it, you come unannounced when I'm not hereIts simpleI have dogsThey poopIts cleaned every weekIf I knew you we're coming, it would be cleaned on that dayFact is, workers have been here one time in a year and a halfYou have been here twice to promise repairs but not deliver. #As for my threats, they are not threatsThey are the simple actions I will take to resolve the issuesI have had a year and a half of promises yet no actionI hired you on your work, word, and warrantyI haven't seen follow through on any of thatI don't like taking these stepsAs a matter of fact I've been very patientNot until I filed this complaint have you even offered to have workers ACTUALLY come out with tools to attempt to fix the posts If this was years later, I maybe could understand a few posts movingI don't live on a fault lineNo way these posts should be like thisI will accept your offer to fix, if it is a permanent fixOr if another fence company says it's not your faultI cannot accept a solution that says you will only TRY to do something and then absolve yourself from further problemsPounding posts back down when they are not installed correctly is not going to fix anythingThere are ways to fix this problemIt seems you dont want to offer a real fix at allIf you want to be a business that adheres to the minimum while promising the world orally and in writing with a lifetime warranty that doesn't say it excludes anything, that's your prerogative If I find, from other companies that come to look at your work, that it is done correctly, you will have my utmost apologies For your workNot for the promises and falsehoods I have read in your responseEven then, I expected more out of you and your businessYou told me you were top notch and would always be there for problemsTo say you've been out here multiple times is blatantly falseYou even apologized to me and in this complaint for the delayIf you still want to try to work something out, I'll give you some timeI don't believe tapping posts down will solve this problemIf you want to agree to tapping posts down or whatever as it occurs, I will accept thatAnd I will never understand why you cannot spare one day of your workers time to make a well paying customer happyIt took me a long time to file a complaint and have been very pleasant about it all until now.You have tried to blame me and portray me as some lunatic making threatsAgain, I've been patient for a year and a half of promisesIf you would've just come out and tried, I would've been happyNow you want to try, but as a last , one time, offerWell, you have NEVER tried to repair the postsNot one timeIf you want to work with me, let me knowIf not, I will call out a few other contractors to check the work and proceed from thereI do appreciate your time and hope there is a solution that you can offer that helps meOne day of work for you is thousands for me to hire someone elseAnd I cannot do so without voiding my warrantySo I am stuck having to solve this one way or the other.that's why the "threat" of a lawsuitYou won't repairAnd I cannot have someone else repair it without voiding your warrantySo what recourse do I have? We will seeAnd tell me what you will do when this fence blows over in a few years from nowIs there a warranty then? I expect nothing from you at all at this pointSome of your points are absolutely falsewhen have your workers been out here to repair posts? Again, tapping down posts is acceptable, but not if it's just going to happen again in a year and you are no longer responsibleIf that is your only.offer, I will take my chances with other avenues. Sorry for the delayed response. I
wanted to seek appropriate counsel and have accurate information in place prior
to responding. I’m going to address all of the
concerns, issues and accusations [redacted] has brought up in emails to me and
to the Revdex.com. #1.  The True Lifetime Warranty covers...

the
installation of the fence, that if it were to come apart during a gust of wind,
we will put it back together. The True Lifetime Warranty DOES NOT cover the
movement of posts in any direction. We have never had or have we ever heard of
a fence company, guaranteeing to keep the earth from moving or posts from
moving. To be absolutely clear, The True Lifetime Warranty DOES NOT cover the
manufacture of the fence itself. The manufacture’s product warranty covers the
manufacturer of the fence itself. Also, Michigan Fence Solution’s installation
warranty does not cover damage from natural disasters, excessive use or normal
wear and tear. Gates are covered for 1yr by our installation warranty and 1yr
under a manufacturer’s warranty. We have responded to [redacted]’s
call when his fence did come apart and we repaired it. #2. At NO TIME is Michigan Fence
Solutions responsible for the safety or retention of any animals. This is a
ridiculous insinuation. #3. Michigan Fence Solutions does
not manufacture or produce the fence material, the hinges, or powder-coat the
hinges. All of the material is covered by a manufacturer’s warranty. If that
manufacturer goes out of business it is not the responsibility of Michigan
Fence Solutions to provide free replacement materials. #4. At no time was [redacted] told
that his fence lacked UV inhibitors or coating. It was mentioned to [redacted] that
the manufacturer of his fence had an issue with some other fences but those
fences were produced after his fence.  [redacted] fence was not part of the defective lot. All vinyl will fade gradually.
Some fences may fade more than others depending on the quality of the materials
and the amount of inhibitors put into the fence during the extrusion process. #5. Regarding [redacted]’s Gate:
We responded to [redacted]’s call regarding his gate issue in early of 2015. My
installers made adjustments to his gate to allow it to clear his driveway,
which was heaving due to the cold. [redacted] wasn’t happy with the adjustment
because it left holes in the posts. Those holes can be covered by screws.
Again, we are not liable for the heaving of [redacted]’s driveway. Additionally,
[redacted] has a large Huskie that jumps on the gate. I witnessed this first
hand upon going to [redacted]’s house in 2014. Again, Michigan Fence Solutions
is not responsible for excessive use damage or normal wear and tear. #6. [redacted] states we didn’t install
the fence below the frost line. We never stated we were going to. Fence posts
in general are NEVER below the frost line. All 6ft high vinyl privacy fences
are installed with 9ft posts or shorter; [redacted] uses 8ft posts for example.
That is 3ft of post in the ground and 6ft out of the ground. The frost line in Michigan is 42”. Michigan
Fence Solutions has never installed a fence post below the frost line and has
never stated it would. We install our fences according to standard installation
procedures outlined by our manufacturers. There is a no building code in Michigan that requires
fence posts to be installed below the frost line. Michigan Fence Solutions has
addressed [redacted]’s complaints multiple times. Michigan Fence Solutions will
one last time send out a crew to see if the posts can be pounded back into the
ground to level out the fence.  The crew
will not be out until the entire rear yard is clear of dog feces. Every time my
crew or I have gone to [redacted]’s home we have had to deal with a yard covered
in dog feces and the smell that accompanies it. This is a health hazard and we
will not return until the yard is safe to walk in.  We will attempt to make the gates posts more
attractive by filing the holes with screws. This is all Michigan Fence
Solutions will do. If this is unacceptable to [redacted] then he is welcome to
seek resolution elsewhere. [redacted] can contact Michigan
Fence Solutions at [redacted] to set up a scheduled time when he will be home
to meet with my crew. My installers work from 9am to 5pm Monday though Friday.
They will not begin a job at 5pm. We will not deal any longer with
[redacted]’s threats of going to neighbors, going to news channels and the
threat of filing a case against us or accusations that I am attempting to
“skate” my warranty. While we may have lapsed in our response time, we have
always addressed issues with [redacted]’s fence and even those issues outside of
the warranty period. My installers and I have won the [redacted] for three consecutive
years. We have hundreds and hundreds of happy customers and positive reviews. After my installers make one last
attempt to make adjustments to [redacted]’s fence, Michigan Fence Solutions will
terminate its relationship with [redacted] due to [redacted]’s threatening
