In August 2014, the Complainants contactedus through a referral from their trusted friend who highly recommended usbased on his own personal experience over numerous projects. Based onthat referral the Complainants contacted us regarding their kitchenremodel, interior house painting,...

and fire rating their garage. TheComplainants realized and stated repeatedly that it was short notice but thatthey were anxious to start immediately. They were moving out of their previous housewhere they were suing the landlord and they asked if they could live in the newhouse while it was being remodeled. We recommended against it but a week afterdemolition we were told that they were moving in.  We informed the Complainants at the outset that afull kitchen remodel requires planning and that when planned can be done in afew weeks. There was NO plan here. The customer could not make up her mindabout any aspect of the kitchen design. She was adamant about her budget butkept adding things and going over the budget. She chose items, we purchasedthem and then she changed her mind several times.  We have countless emails from her asking aboutall kinds of design cues and then changing her mind after we spent time helpingher decide. We recommended that they purchase in stockcabinets from [redacted] or [redacted] because they already moved intothe house and custom cabinets would take months to arrive. As usual, she didn'tlike anything from those stores. She chose and ordered custom cabinets. Theytook two months two arrive. They arrived in separate orders and some of theitems didn't fit because her kitchen designer made a mistake on the layout, which we fixed but it required ordering additional cabinets because they werenot in stock. The granite countertops could not be templated until the cabinetswere installed. She chose one style and then switched to another. She took aweek to decide which granite she wanted and after it was 100% installed shesaid she absolutely hated them. I have emails supporting all of this. From the beginning and throughout the entireconstruction process, the Complainants, who are husband and wife, couldnot agree on anything from the colors to the cabinets, countertops orfinishes. They operated as two separate customers so much so that thehusband forbid the wife from making further decisions about the kitchenremodeling, which we also have in writing via email. Throughout the entire process, the Complainantsdelayed the process because of their inability to make a decision at criticalmoments. Further complicating the construction process were the numerouschanges made after a decision had been reached. The Complainants falsely assert in theirnarrative that the work was not done well. Several conversations andmeetings have occurred in an effort to satisfy the Complainants. At onepoint, the Complainant stated that he is “looking for perfection.” It wasmade clear to the Complainant that Beantown Builders and Properties, Inc.has a very high standard but it is unrealistic and impossible to beperfect. Let me be clear that taking a camera and sticking it in the crevice ofa seam in an effort to find an issue is a problem of the customer not thecontractor. Anyone who looks hard enough can find something to complain about. We have been forced to stand in the kitchen from multiple angles and heights inan effort to recreate what the customer says she saw. If that much effort isneeded than I submit the problem is not the work but the customer. Our picturesof before an after speak for themselves. Contrary to the Complainants statements that thework was unsatisfactory is the Complainants repeated requests that theRespondent also remodel their bathroom too. Moreover, the Complainantsrequested several change orders and additional work, which also requiredadditional time.  Every aspect of the contract was completed infull. The customer claims that we left a hole in her subfloor. The house is oldand subfloor is made up of boards with knots in the wood. Occasionally, a knotwill break off and leave a hole. There are holes all over the subfloor. It isthe nature of the boards used at that time. The point is not whether should orshould not be a two-inch diameter hole in the boards but whether the holeaffects the structural integrity of the finish hardwood floor to be installed. It did not. We explained it thoroughly yet she claims it is a big deal andworse she says you can see into the kitchen. That’s a lie.  We also deny that we failed to communicatewith the Complainants or stopped communicating with the Complainants. TheComplainants called on weekends including Sundays and we answered. Also, theComplainants emailed us and that such emails and calls were answered in atimely fashion. We have a huge collection of emails from the customer includingher most recent email where she called our project manager a “PAB J.” I think that speaks for itself. If you don’tknow what it means just [redacted] it like we did. As of the date of this response, all work hasbeen completed in full and in accordance with the contract including theinstallation of the custom made radiator cover that the Complainants claimwas not installed (see picture included with this response). Of course, shedoesn’t like the cover but that is not our concern. The cover was custom made.It was brought to her before the final product was completed and a testinstallation occurred. She did not complain about it at that time. She waiteduntil it was finished and installed to say she wants a different cover. No, wasour response. We are done. She has filed a complaint with the state officeof consumer affairs. She writes threatening, foul language emails and sheexpects us to want to come back to her house and work with her.  This complaint is a bold face lie. It is pretextin an effort to get her kitchen done for free but we will fight this woman withevery fiber of our beings and our attorney is very good at defending frivolous claims. Lastly, they still owe a $1,000 balance on hercontract. They are not paid in full and we challenge them to provide evidenceto the contrary.
