I, *** & *** Jr. called landcaster conrwall apt. in Beaumont, TX to inquire about 2 bedroom availability. We were told that there was availability, and the management said to come fill out application right quick because they were about to close for the day and they would process it the next day on the 13th. We were told on Tuesday the 13th was that all we needed to do was bring 3 money orders filled out to landcaster apartments, one for a $250 deposit and two for $30 each application fee. We asked about the $250 deposit they wanted up front because they didn't even process our application yet. Mgr. response was the deposit was to hold the apt. for us because the availability was going fast. (no other reason was given) Mgr. never went over or explained anything on the application to us, we had no knowledge to their rules and regulations. So therefore, on Wednesday the 14th we were finally given a call and told our application was denied. So *** Jr. asked about our $250 deposit and to my surprise the management said we do not get a deposit back! I asked why and management response was we falsified information on the application. My response was no maam we didn't everything was honest and true on the application. The management response was because we left a blank on the application its considered falsifying to them (as I stated earlier in this complaint no one ever went over the application with us about any of their rules and regulations). And their other reason we were told we were not getting our deposit back was that because of our credit report didn't meet their standards. So they lure you into bringing them money for deposit and tell you it's only to hold your apartment but tell people they can't get their deposit back base on their specifics. That's not right that's stealing from the public. We live on a fixed income and have a 1yr old daughter and cannot afford to lose $250 that we should not have had to give in the first place because we were not even approved yet. Last but not least while we were in the office on Monday the 12th filling out our application for the apartment we heard one of the management person say that they were going to toss out someone's application and deny them and keep their money and we heard them say because their application was filled out with sloppy writing. We can testify to this.
The co-applicant *** Jr. falsified his application at Lancaster Cornwall Apartments. Mr. signed the Lancaster Cornwall Resident Qualification Standards that state, "Anyone who falsified any information on their application will be denied acceptance and the security deposit will be forfeited as liquidated damages.
Their deposit was forfeited for falsifying the leasing application.
BACK IN 2014 I BEGAN STAYING AT LANCASTER, AT THAT TIME I FILED A COMPLAINT TO Revdex.com ABOUT THE APARTMENT CONDITIONS WHEN I MOVED IN. ALTHOUGH THE COMPLAINT WAS DENIED, THE APARTMENTS CAME TO FIX EVERYTHING THAT WAS WRONG RIGHT AFTER. COUPLE OF MONTHS DOWN, LANCASTER DOES SPLIT PAYMENTS. IN APRIL I WENT IN AND ASKED FOR A SPLIT PAYMENT, THE MANAGER IN THE OFFICE DENIED MY REQUEST FOR A SPLIT PAYMENT BECAUSE SHE STATED THAT I HAD A BALANCE. I KNEW NOTHING OF THIS BECAUSE I NEVER RECEIVED ANY LETTER STATING SO. SHE BEGAN EXPLAINING THAT I DID A SPLIT PAYMENT IN JANUARY BUT SHE NEVER RECEIVED THE SECOND PAYMENT THAT WAS SUPPOSED TO BE MADE ON OR BY THE 15TH. I TOLD HER THAT I DID AND I HAVE THE MONEY ORDER TO PROVE IT AND A LEGER FROM MT BACK SHOING RENT WAS PAID. AFTER I SHOWED HER THE INFO, SHE STATED THAT IT WAS BECAUSE I DINT SIGN THE PAPER FOR SPLIT PAYMENTS. I EXPLAINED TO HER THAT I DID. AND BEFORE I MADE MY SECOND HALF, CALLED TO VERIFY THE AMOUNT. WE WENT AROUND AND AROUND DEBATING ABOUT THE PAYMENT. SHE THREATENED ME SAYING SHE WAS GOING TO EVICT ME IF I DIDN'T PAY THE BALANCE FROM JANUARY. I TOLD HER ITS UNPROFESSIONAL TO TELL ME I HAVE A BALANCE FROM JANUARY & ITS CURRENTLY APRIL. HOWEVER, BECAUSE I HAD NO WHERE ELSE TO GO, I PAID THE BALANCE. AT THE SAME TIME, I HANDED HER A WRITTEN LETTER STATING THAT THIS WOULD BE MY 30 DAY NOTICE. EVEN THOUGH MY LEASE WAS NOT UP UNTIL END OF JUNE, I GAVE HER MY 30 DAYS TWO MONTH BEFORE I HAD TO MOVE OUT. AT THE END OF JUNE, I DID MY WALK THRU AND RETURNED MY KEYS. IN 2016, I REVIEWED MY CREDIT REPORT AND PRO COLLECT SAYS TT I OWE LANCASTER OVER $800. WHICH WAS INCREDIBLY WRONG. I CALLED THE MANAGER AT CORNWALL AND ASKED HER WHAT THE CHARGE WAS. SHE EXPLAINED IT WAS BECAUSE I NEVER GAVE MY 30 DAYS AND I DIDNT PAY THE LAST MONTHS RENT. I EXPLAINED TO HER THAT IT WAS WRONG BECAUSE THE APARTMENT THAT I MOVED INTO CALLED AND VERIFIED THAT MY GAVE MY 30 DAYS AND MY LAST MONTH HAD BEEN PAID BEFORE THEY ACCEPTED MY APPLICATION. SHE TOLD ME TO BRING HER THE PAPER THAT SHOWS Y APARTMENTS VERIFIED THAT INFORMATION AND SHE WILL CORRECT IT. HERE IT IS, THE END 2017 ADN IM DEALING WITH THE SAME ISSUE. I RECENTLY MOVED TO HOUSTON, I BEGAN FILLING OUT APARTMENT APPLICATIONS, AND IT CAME BACK SAYING I STILL OWE LANCASTER MONEY. I WAS UNDER THE IMPRESSION THAT IT WAS REMOVED. SO I CALLED THE MANAGER IN LANCASTER AGAIN, AND SHE TOLD ME THAT SHE NEVER GOT. BUT I EXPLAINED TO HER THAT I DISTINCTLY REMEMBER HANDING IN TO HER AND WATCHING HER MAKE A COPY. SHE BECOME IRATE WITH ME NAD STARTED YELLING. THEN SHE HUNG UP IN MY FACE. WHEN I TRIED TO CALL BACK, SHE WOULDN'T ANSWER THE PHONE. WHEN SHE DID ANSWER, I ASKED FOR THE CORPORATE OFFICE NUMBER, SHE SAID THE NUMBER SO FAST THAT COULDN'T GET ALL OF THEM THEN HUNG UP IN MY FACE AGAIN. I TRIED GETTING THE NUMBER A FEW MORE TIMES. WHEN I FINALLY GOT IT, I CALLED TWICE. EACH TIME THEY SAID SOMEONE WOULD GET BACK WITH ME. TWO WEEKS PASSED. I CALLED AGAIN, THEN SOMEONE CALLED ME A FEW DAYS LATER. THE REGIONAL MANAGER THAT I SPOKE WITH WAS SO RUDE. SHE KEPT CUTTING ME OFF WHEN TRYING TO EXPLAIN MY ISSUE. I EXPLAINED TO HER I HAVE PROPER DOCUMENTATION SHOWING THAT THE INFO REPORTED WAS INCORRECT. SHE TOLD ME TO SEND IT TO HER. I SENT OVER THE PAPER WORK AND SHE HAS YET TO GET BACK WITH ME.
