Thanks for your prompt attention to this complaint. I will respond to each of Mr. [redacted]'s allegations, and I will include copies of the written documentation on which my response is based.

Please be assured that I have NEVER guaranteed the overall results that any client might...

anticipate. Beautiful Body Contouring cannot be responsible for all of the factors that might affect the final results, such as poor diet, fattening diet, overeating, lack of proper exercise, thyroid or other hormonal imbalances ar\d many more. To "guarantee" results in the face of these issues would be senseless.

Mr. [redacted] paid $750.00 for 12 treatments on December 21, 2013 for his wife, [redacted]. Prior to starting her treatment, she voluntarily signed the Beautiful Body Contouring Consent Form (enclosed). As I pointed out in my letter to Mrs. [redacted], the first sentence in the last paragraph, entitled Acknowledgement, clearly states that "I understand and acknowledge that payments for the above services are non-refundable. By my signature below, I certify that I have read and understand the contents of this Consent Form for Beautiful Body Contouring."

She received her first treatment on December 23, 2013 and completed the last treatment on February 3, 2014, as listed on the Patient Appointment Record (enclosed). Measurements were taken before and after the first treatment, and the identical measurements were performed on January 8, 2014, January 22, 2014 and February 6, 2014, as reflected on the enclosed Measurement Tracking Form. Review of the measurements shows that t^rs. [redacted] consistently lost inches until the last treatment. Inexplicably, she gained some of those inches back at the time of that measurement only.

As I explained in my letter to Mrs. [redacted], there is no way to know why her measurements increased on that occasion, but that occasionally will occur, and it will usually reverse itself with additional treatment. I have enclosed a copy of the letter that I wrote to [redacted], in which I offered her six additional treatments (a $600.00 value) at no additional cost to her, as I firmly believe that she has a good chance of improving her measurements with those extra treatments. Rather than accepting this opportunity, hKr. [redacted] chose to begin a campaign of harassment, including his complaint filed with your organization.

As you can see, my books and records are open to you, and all of the pertinent documentation is included with this response.

Finally, I feel that I should set the record straight regarding the INCORRECT allegation that my husband, [redacted]. [redacted], MD, had a complaint filed against him by the [redacted] regarding "another treatment that didn't work." The [redacted] did file a complaint against my husband's company, Snore Formula, Inc., approximately 10 years ago. The nature of the complaint was their allegation that a false advertising claim was made. THERE WAS NEVER ANY ALLEGATION THAT THIS WAS A CONSUMER ISSUE! The complaint was resolved by putting a warning on the label. No fines or penalties were assessed.

I hope that this response covers all of the outstanding issues. In spite of the obvious hostility of Mr. [redacted], my offer of the six additional free treatments for Mrs. [redacted] is still on the table.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Mrs. [redacted] obviously chooses to forget what she tells clients. Your word is everything in life and in business. I asked her specifically when I purchased the treatments if they were guaranteed and she replied "yes I have many customers who love us". My wife did not see consistent loss of inches. Any losses were very minor and are probably a result of the change of diet they told her to do. On February 8th, I spoke directly to Mrs. [redacted] as well as the supplier of the equipment. She flat out told me she was going to refund our money more than once on the call. I can see now that her word means nothing and I have every right to let the public know. I may never see my money, but I guarantee I will do everything I can to make sure she gets fewer people to scam and lie to. I will probably get more satisfaction preventing her from doing this to other people even if it is only ten. I guess she would rather lose $7500 than be honorable and keep her word to me.

Review: Dr [redacted] along with his wife [redacted], own and operate Beautiful Body Contouring in Scottsdale AZ. They sell body sculpting treatments done by cool laser. I purchased a 12 treatment package from [redacted] on December 24th 2014 for my wife. At the time of purchase, I asked her specifically if the treatments were guaranteed and she said emphatically yes. The advertising states that client will lose inches using this treatment. My wife completed the treatments and followed all instructions. There were very minimal results if any. In fact she actually had gained inches after her last treatment. I called Ms. [redacted] and while on the phone with the man who sold her the machines, [redacted], she stated that she would refund my entire purchase price. this was said on 2/8/2014. Today 2/13/2014, we received a latter staitng that after consulting with her husband Dr [redacted] as co-owner, she would not refund our money although she had promised to do so. Upon further research, Dr [redacted] has had a complaint filed against him by the [redacted] regarding another treatment he sold that didn't work.Desired Settlement: Refund of entire purchase price of $750 as promised.
