The information provided in the complaint in incorrect and inaccurateTexas Star Title co was in receipt of a signed earnest money contractThe buyer has maintained he did not authorize a surveyPer the terms of the contract the buyer executed, it clearly states that within days after the effective date of the contract, buyer will obtain a new survey at buyer's expenseIt also states that the title policy will be amended to read "shortages in area at the expense of the buyerThis also requires a surveyThe survey was ordered per the contract and provided to all parties on February 20thThe lender requirement was not a factorIn addition, Per the TREC contract, item 18Bii and iii, if no closing occurs, escrow agent may "(ii) require payment of unpaid expenses incurred on behalf of a party, and (iii) only deduct from the earnest money the amount of unpaid expenses incurred on behalf of the party receiving the earnest moneyThe buyer was included on numerous e-mails regarding the ordering of the survey, to include the actual delivery of the surveyHis agent was also notified of the reduction in earnest money on March 10th and again on March 27th, and he acknowledged receipt and indicated he would notify his client

In response please note that per the contract the buyer/borrower executed and initialed, item **, states that within days after the effective date of the contract, buyer will obtain a new survey at buyer's expense, and Item 6(8) states the title policy will be amended to read "shortages in area at the expense of the buyerThis also requires a surveyThe survey was ordered per the contract and provided to all parties on February 20thThe survey is not contingent upon financing or the direction of the lenderIn addition, per the TREC contract, item 18Bii and iii, if no closing occurs, escrow agent may "(ii) require payment of unpaid expenses incurred on behalf of a party, and (iii) only deduct from the earnest money the amount of unpaid expenses incurred on behalf of the party receiving the earnest money.”
Email correspondence indicates the survey is required per the terms of the contractAt no time after the parties were notified a survey was required, up to and including delivery of the survey, did the lender, buyer or their agent object to the surveyIt was not until the contract terminated and parties were advised that funds would be deducted from the earnest money that objections were raisedThe buyer’s agent was notified several times that the contract his client executed required a surveyHe was also notified that the survey would be reduced from the earnest money on March 10th and again on March 27th

The loan officer did in fact inform the title company that we were first time home buyers and were not yet approved for the loanTherefore he asked Texas star title not to move forward with the survey until we were actually approvedTexas star title performed the survey anyway and then proceeded to keep the expense from my earnest moneyI have emails from Sean Ruffin to myself and Texas star title asking them to hold off on anything until he was fully sure that we would get approvedI just have a hard time believing a company like this would just keep someone's money who was doing nothing more than trying to buy a homeI read about several of these title companies on the internet, and now everyone will be reading about one more greedy title company that does not stop at preying on unknowing first time home buyersHard working people who give their money in earnest of getting a home, get robbed by people who figure if they can't get paid the legitimate way, due to a loan denialthey will just keep the money anyway. I will pursue this matter as far as I can for as long as I canIf nothing else future home buyers will learn about Texas Star title and warn lender's and other potential buyers to stay awayAfter all I'm sure there are plenty of other title companies willing to do the job without steeling from unknowing immigrants, and first timers
