Revdex.com: I have reviewed the offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear belowThe reason I am rejecting the offer is because not all the facts were addressed in the letter by [redacted] the manager of the propertyI would like to address them in the preceding paragraph and have it resent to the business in questionDespite [redacted] claims, I am the only one actively trying to get this resolvedI have made so many suggestions on how to solve the situation all falling upon deaf earsI asked for a sit down discussion between myself and the other tenant which was never even considered by the management as well as many other suggestionsShe wanted to only focus on one particular police report while I have stating there was no noise heardAll of these officers told me they stood outside for minutes and heard no noiseThe last officer even said she thought she had the wrong apartment because she could not hear any noiseIf it is necessary I can contact these officers again about this situation besides what is in their reports and have them let you know about the situationThe reports can be faxed or attached to you for your records and the one stating that noise could be heard was because the action scenes come in so much louder and I was just letting the officer know that it was not quiet hours but agreed to turn it downThe quiet hours for our apartment do not begin until 11pm all of the police reports are time stamped before this timeAlso, the counties noise ordinance does not go into effect until 10pmThe lease states we as tenants have a right to “quiet enjoyment” unless a bona fide complaint has been made and I would say that complaints stating no noise could be heard to complaint stating there was noise heard would satisfy it to be proven not legitimateTherefore, because they are allowing these non “bona fide” complaints to continue my right to “quiet enjoyment” is being disturbed by continuously having to answer to the door to the responding officer not to mention wasting his timeThe management's response only says [redacted] County Sheriff's department when talking about the one complaint that she chose to use when stating no noise could be heard, but used the direct officer’s name in the only complaint where noise could be heard trying to manipulate the factsWhen this all started even after the one officers statement the office told me I was doing nothing wrong and it was completely the other tenants faultShe went through a long list of things that would happen to them if this did not stop none of which have been followed through uponMy mother and I heard her saying all this and we are prepared to testify under oath to the validity of these statementsAll I want is for the apartment to make this injustice right and stop allowing this harassment of myself and my family to continue I would like to be moved to another building within this community now versus when my lease is up so I can be away from this neighbor as I fear for my safety and have told the management this multiple time, but this just chose to ignore my statementsI have the dates and times of all of the statements she made as well as all of the written correspondence between myself and the apartment complexI also have the police reports all of them except the most recent that I have yet to request from the apartment management Regards, [redacted] PSAt this time I am still waiting to hear back from the management as to reapplying for an apartment and being moved to a new unitThey have yet to answer and it has been around five days since my first emailI would think they would just be able to "transfer" me, but they have stated they are not able to do this which to me does not make since because of the circumstances that are surrounding this issue are very serious

This email is in response to your letter from our resident *** *** who resides at *** *** *** *** *** *** ** ***. I would like to respond to the comments that *** *** made
On 10-13-13, the *** Sheriff's Deptresponded to a call in regards
to loud noise coming from *** *** apartment. It is correct that upon the police arriving that no loud noise could be heard. As far as complaints being made by the upstairs neighbor on the previous residents this is correct. Two complaints were confirmed to be true and the third was unable to be confirmed
On 10-17-13, when the police were called to *** *** apartment for a loud noise complaint, Deputy *** did confirm loud noise was coming from *** *** apartment and that it could be heard from the parking lot. Officer *** also confirmed that he had to knock repeatedly to get someone to respond. *** *** told the deputy that he was watching the newest *** *** movie and argued that it was not after PM, however he did agree to turn it down. In addition to the complaint about loud noise, the neighbor also complained about *** *** dog constantly barking when left alone I did explain to him that the dog was in a new home and just needed time to adjust to its new surroundings
On 10-22-13, I received a call from *** *** upstairs neighbor that the dog was still constantly barking so I walked over to listen for myself. The dogs barking could in fact be heard in the upstairs apartment. The complaints in regards to the dog barking did continue into the beginning of November. After about the first week in November *** *** neighbor indicated that the dog was no longer an issue however the loud TV noise was still an issue. It has been explained to both households that management could not determine if there is truly a noise issue with the TV. We have exercised proper due diligence by repeatedly verifying with neighbors in the building whether others have been disturbed
*** *** also says in his letter that his neighbor "creepily stares at him and his fiancé when they leave in the morning." Ironically this same type of complaint was made by *** *** neighbor in describing dirty looks being made by *** *** and his fiancé to him and his girlfriend making "them feel very uncomfortable.”
On 2-24-14, *** *** was offered the opportunity to terminate his lease prior to his lease expiration date with no absolutely no lease termination financial penalties He would only have to give a day written notice *** *** declined this offer
*** *** has since asked to move to another building at lease renewal and we have approved this with the understanding that he must reapply and meet all Section tax credit criteria We have even agreed to waive his application fees and reimburse him the cost of switching over his utilities At this point it is up to *** *** as to whether he would like to accept our offer to terminate his lease with absolutely no penalties, or relocate elsewhere in the community

Review: I have had a very negative experience ever since I moved into [redacted]. I live in Building[redacted]. On the second day of living here, October 13th at 10:30P.M.,I had the police called on me for a noise complaint by the residents above me who have been harassing me ever since. The police officer opened the door to find myself, my girlfriend, and her eight year old sister inside watching a childrens movie. She asked if we had been playing music and I told her no and she said sorry for disturbing us and left as the female officer stated no loud noise could be heard. I found this odd, but ignored it and asked my friend who lives across the hall. He told me that the resident living in Apt. [redacted] had harassed the last tenant in such a way, but prior to moving in I was never informed of this. Following this incident, the police continously came throughout the month of October and time after time stated they could not hear any noise. I have all of the reports to back up each incident. I contacted the office numerous times throughout this period and they never made any attempt to properly remedy the situation. He finally stopped for the months of November, December, and January and then began calling again in Feb. The officer that showed up was very nice and once again stated she could hear no noise even saying she had stood outside of my door for a few minutes before knocking and still could hear nothing. The office ignores my requests to address the issue and just saying they can't determine one way or the other. I would say multiple police reports stating that no noise is heard is plenty. I feel like the man is clearly psychologically disturbed and I fear for the safety of my fiance and my dog. I am being mentally abused and harassed by this man and the office will not help protect it's helpless tenant. I feel helpless in this situation because the office will not help and the main stomps on the floor and causing my property damage.Desired Settlement: Have the neighbor to discontinue harassment by making him sign some sort of agreement to stop calling the police and wasting resources. The police continuously are called, show up, and state that no noise can be heard. Additionally, the guy creepily stares at me and my fiance as we leave in the morning. My other neighbor has also stated that he does the same thing to her. I really feel uncomfortable and unsafe living in this situation. I have multiple reports saying that no noise is heard.
