The customer called and spoke with me several times regarding the delivery 12/2. I thoroughly explained our pricing and loading...

procedures. The customer did mention that he had a small amount of concrete 4-5 cubic yards. I very clearly explained to him that the pricing included 5 tons of weight and that he could not fill the container with any more concrete than the small amount he said he had from tearing up a small section of sidewalk. We have very specific guidelines regarding how much weight from concrete and or other heavy material we can handle in a 20 yd container.
He mentioned that the rest of the material would be very light and of minimal weight, I believe he was getting rid of an above ground pool.
We delivered the container as scheduled 12/2 and the customer signed the ticket agreeing to the terms and conditions. The ticket clearly states that the customer should not overload the equipment and that we are not responsible for damage to customers pavement resulting from the weight of the container.
On 12/3, the customer scheduled a second dumpster to be delivered and the full one picked up. It weighed about 3 tons and was a typical load with no issues.
On 12/10, the customer scheduled pickup of the last container. When the driver arrived, it was obvious that the container was overloaded with dirt and concrete.
We can only take dirt and concrete material up to 60% full of a 20 yd to safely pickup and haul the container. If the customer had been honest and explained that he was getting rid of 20 plus yards of dirt and concrete, we never would have agreed to let the customer put that much heavy material into the container or mix the load with trash. The customer specifically stated there was a small amount of concrete and no other heavy materials. At no time did he mention there being any dirt. The customer was well aware of our concerns and guidelines from the beginning. The dumpster did damage the customers driveway because of the excessive weight of the container from improper loading. Had the container been filled with a reasonable amount of weight and material like the first one, the damage would not have occurred.
We brought an additional container at no charge for the customer to unload some debris so that we could pickup the container.
Our company covered the hundreds of dollars in additional weight fees that the customer would have regularly been charged for disposing of the additional weight, an extra delivery, and pickup and dump fees of the additional container. In no way did the company offer to repair the driveway.
I have included pictures of the customer signature and pictures of the overloaded container.
