To Whom it may Concern,         As owner of McKinney Custom Pools we are always want to find a way to resolve problems when they are completely at our fault.  Our problem with the complaint Is as follows.  1.  Our contract reads under our deck warranty that all acts of nature and soil conditions will not be covered under warranty.    2.  The palapa company who installed the patio are 100 percent wrong by what they had written.  We have been installing and building patios and palapas for over 12 years and understand whats needed in the south Houston area to build something correctly.  First of all they know that this palapa was done without any city approval and  without any engineered drawings to back up their statement.  Any legit company performing patio and palapa structures would know these two items would need to be done.  And when having an engineer draw up the structure they would show that footers under the post would need to be done due to the weight and wind load these structures carry.  The palapa was just thrown on top of a pool slab that was not installed to carry the weight of such a structure.  3.  The soil conditions we have here in the south Houston area is called Gumbo soil.  Its called this due to the expansions of it.  The definition is as follows: any of various fine-grained silty soils that become waxy and very sticky mud when saturated with water. so in combination of the soil and weight of the palapa its a no win situation.  solutions         Overlaying was something we were and still are willing to do to help the customer out.  By Doing this we are not excepting any responsibility of this issue but will help her out.  There are many ways to fix this issue  #1. hydraulics and pump cement under it to lift the sections back up to where they started. #2 Which we are willing to do, grind spray deck off the existing and overlay with a bonding agent and raise it and go back with the same texture and color.  #3. to the home owners liking,  which is not the only correct way to do it would be remove by jack hammering it up and re lay it.  Overlaying concrete is done everywhere in the industry and is a very effective way to fix concrete.  I'm sorry we cannot please this customer, but will certainly do our best in the future to notify people of the possibilities when installing un approved un engineered and un pre paired footings and piers.Thanks Jeremy M[redacted]

From: [redacted] Sent: Thursday, September 24, 2015 11:40 AM To: drteam Subject: Complaint # [redacted] Attn:  Complaint Dept. I was told this complaint number was closed due to expiration of a return response.  I was waiting on some documentation to dispute the Vendor (McKinney Custom Pools) claim that the installation of my palapa was the cause for the patio problem. As stated in my first correspondence to the Revdex.com, the problem starting appearing in April of 2014.  The 2 quadrants of the patio were not poured correctly to drain to the middle drain for the patio area in question.  There is no way my palapa could be the cause when it was installed until May of 2014. [redacted]  [redacted] Mr. McKinney want to pour cement over the top of my existing patio, which is only a band-aide for the problem.  It will only be a short time before all the water in between the 2 layers will cause the upper layer to break apart. The only way to repair it correctly is to break out the 2 quadrants, build up the low side to slope towards the drain and repour the cement.  I am collecting bids from patio install companies now and will submit as soon as possible. Thank you,[redacted]

We did send the deck crew out to the homeowner to fix the problem for her free of charge.  To overlay the existing concrete is a very common and accepted form of decking and is used in all construction practices.  We did an overlay on her existing concrete at the time of original...

construction and there has been no issues with it.  On the decking we poured the homeowner built a covered structure after our project was finished.  We were not informed that a large structure was going to be added at a later date.  If we had been told about it we would have engineered the decking to withstand the load and put in footers and or beams like we do with all of our projects when we build or know a patio structure is going in.  Because this structure was added the decking shifted by 1/4" and has caused the drainage issue, it is not due to anything that we did originally that was all permitted and inspected.We have absolutely tried to remedy the deck for the homeowner to what is industry standard and acceptable.  We do not feel that we should have to take on a large cost of demo and new concrete when we can fix it correctly the way we suggested.
