Review: On 8/15/2014 my wife purchased stone necessary to create a backslash on our new house from samples provided by Bedrosians. While we were gone visiting my daughter and grandchildren in Pennsylvania, the stone was picked up from Bedrosians and installed by [redacted] & [redacted]l. When we returned,we found out the wrong rock was installed. When we went to Bedrosians to find what went wrong, they admitted they had written down the wrong number on the samples, so wrong stone was ordered. As they have admitted their error, they have provided us with the correct stone and paid [redacted] &[redacted]l to reinstall the stone. The problem is that they have refused to pay for the labor to remove the wrong rock and re-Sheetrock the area performed by our general contractor for $475. Their explanation it is their policy not to pay for labor on a redo, even if it is their fault! We are asking that they re-imburse us for the $475. Why should we pay $475 for their admitted mistake?Desired Settlement: Reimburse the $475

In mid-September, Bedrosians was informed by our customer that the wrong material had been installed in his place of residence while he was away on vacation. The total square footage of the installation was 4 Sq. Ft. Bedrosians determined that the wrong material had been ordered and supplied to the customer. In an effort to make amends for the mistake, Bedrosians offered to provide the correct material for replacement at no cost. In addition, Bedrosians agreed to pay the requested fees for both demolition and re-installation of the stone, as outlined in the contractor's proposal bid submitted to Bedrosians on September 24, 2014. This amount is five-and-a half times Bedrosians regular reimbursement price per Sq. Ft. for demolition and removal of material. It was Bedrosians top priority to ensure the situation was rectified.

Bedrosians sent the customer a release letter explaining the situation and reimbursement amounts. This customer did not agree to sign the release letter, although his contractor signed. Instead, the customer alleged we denied him payment in the amount of $475.00 for demolition. No bids for this amount were submitted to Bedrosians. The only bid we received was for the contract price of $1,130.00 which we agreed to pay.

Finally,the customer misstates our reimbursement policy. Our policy clearly states that this is the customer's responsibility to inspect all material prior to installation to verify the correctness of the shade/color, sizing, and finish and to determine its appropriateness. The costliness and inconvenience of removing material after its installation necessitates the customer's inspection prior to installation. Our policy clearly states that installation of the product constitutes acceptance, which is a well-known industry standard. In this circumstance, the customer purchased the material, went out of town, and while away had the material installed by a third party.

Bedrosians Terms and Conditions are clear. The material used must be inspected prior to installation to determine appropriateness, as installation constitutes acceptance. Nevertheless, Bedrosians agreed to compensate the customer the amount requested in the sole bid proposal received, for the contract price of $1,130.00.

Bedrosians has taken exceptional steps to rectify this issue for its customer and communicate our proposal solution.

Hello , we would also like to add that Bedrosians did offer to pay half of the 475.00 although we were not at fault for checking the correctness of the material before installation but the [redacted]"s did not accept the offer.

I am rejecting this response because:The writer is wrong on several counts. First, I would agree with the writer of this response regarding the cost of demolition being excessive if our backslash was 4 square feet (for $475), however our backslash is actually 18 running feet at 1 1/2 feet high or 27 sq ft., so the price per square foot for the demolition and re-Sheetrock was within his reasonable amount. Second, we were told by Bedrosians that they were not paying for any of the demolition costs and did not ask for us to submit any bids for them to consider for the removal of the wrong rock and wall repair, so we had our general contractor do the work. Thirdly, I did not sign the release as it contained language preventing me from filing this complaint or filing a claim in small claims court. Fourth, their "policies"were not made clear to us regarding redoes, nor would the average consumer be expected to know the rules of the trades/industry. Finally, I did accept the offer of halfof the cost as this whole problem was Bedrosian's fault because they ordered and supplied the wrong rock, which they admitted. Why should I pay anything for their mistake?
