Review: On Saturday, November **, 2014, I attended the Pine Bar & Grill for their Champagne Brunch with my sorority sisters. As part of their Champagne Brunch their offer complimentary Mimosa's or Bellini's and free meals for children. After spending over 20 minutes trying to understand my bill, I decided to just pay it and figure it out later on. On Tuesday, November [redacted], I contacted the restaurant to speak to a [redacted] because my bill did not add up correctly. (I have copies of our bill with incorrect sales tax applied) I asked him how can he charge me sales tax on complimentary items and he said that is the way it is. Our total bill came to food and beverage bill came to $201.75 however they charged us $271.75 (for our food and beverages and removed the items that were complimentary by adding a line subtracting them out)+ 8.875% tax on the total items including the complimentary items ($24.12) and then added 20 % gratituity on top of that leaving out bill to be $371.72. When I spoke to the [redacted] at the time [redacted] he informed me that is how it is. I asked him if it was legal and told him I need to speak to my friend who is an attorney and joined us at brunch to see if that is correct. He took my name and phone number. I then contacted NYS Dept of Taxation for assistance and spoke with a representative there, who was super awesome, in explaining the process and what are my options for action steps.Desired Settlement: I would like to pay sales tax only on what was not complimentary and also for them to be honest and make sure everyone else who was overcharged to be refunded. It is not fair to be dishonest especially when patrons are willingly coming to support a good restaurant. The food was great and although service was not as prompt and many patrons left, we did appreciate the staff. However, it is not ok for management to take advantage of their patrons.
