On 09/26/14, Mr [redacted] brought his equipment to Beeler Tractor Cofor repairThe tractor was pushed into a repair bay as it was knockingWe did a check of the valves and adjustment of the valves with no changes madeWe removed the cylinder head and found the # piston higher than # and # causing the piston to strike the valves on # cylinder.The engine was removed and disassembled to create a repair estimateTwo estimates were provided to the customer.The issue of warranty was then brought upThe tractor was purchased 08/12/with a three year of hour manufacturer warrantyThe tractor was now out of warrantyBeeler Tractor Cocontacted New Holland (manufacturer) and asked if they would be willing to help with the repair costTheir response was no, the manufacturer warranty has expired and the tractor is out of warrantyWe informed Mr [redacted] of New Holland's response.Mr [redacted] then called New Holland and they struck a dealThe manufacturer would pay $of the repairs if Beeler Tractor Cowould pay $of the repairsWe agreed and the decision was made to repair the engine.Beeler Tractor Cowas then contacted by New Holland stating they would no longer honor their end of the agreement as Mr [redacted] had called back to the manufacturer numerous times and had used harsh vulgar language toward one of their phone representatives.Beeler Tractor Codid honor our end of the agreement and willing to honor the manufacturer's word alsoMr [redacted] agreed to the agreement ad we were willing to honor the manufacturer's word alsoMr [redacted] agreed to the agreement as verbally made between Mr [redacted] and Beeler Tractor CoBeeler Tractor Coalso proposed the Mr [redacted] could pay 1/the bill upon completion and make payments on the balanceThis agreement is in writing and signed by Mr [redacted] , as is the original repair order.Upon completion of the repair on 02/10/2015, Mr [redacted] came in the pickup the tractor and again was upset at the conditions of the tractor failureHe was informed the tractor had failed, in our opinion, due to lack of maintenanceWe have no record of Mr [redacted] purchasing maintenance parts between the date of purchase and the date of failure.Mr [redacted] signed the payment agreement and wrote a check for the sum of $The next day we received a phone call from Mr [redacted] stating that he had made a mistake and had written the check accidentally on an old closed accountHe offered no form of replacement for the check, only stating his mother would be home in a week or soThe following day we called Mr [redacted] expressing our concern about having a bad checkWe asked that he either replace the check or return the tractorHe stated that would be difficult as he did not have a trailerWe offered to pickup tractor and return the check to himMr [redacted] stated if any employee of Beeler Tractor Cocame to pick up the tractor "there would be a problem"We told Mr [redacted] that we had no choice but to deposit his check as that was the only form of payment offeredMr [redacted] used a profane comment and we ended the phone call.After depositing the check, it was returned marked "Not Sufficient Funds", not "Account Closed"Mr [redacted] came in to b uy back his check and upon finding out the check was at the bank became angry with our bookkeepers and stated he was not coming backWe still have the returned check and are working on a resolution.Thank you, [redacted] ***
