On 09/26/14, Mr. [redacted] brought his equipment to Beeler Tractor Co. for repair. The tractor was pushed into a repair bay as it was knocking. We did a check of the valves and adjustment of the valves with no changes made. We removed the cylinder head and found the # 3 piston higher than # 1 and # 2 causing the piston to strike the valves on # 3 cylinder. The engine was removed and disassembled to create a repair estimate. Two estimates were provided to the customer. The issue of warranty was then brought up. The tractor was purchased 08/12/2011 with a three year of 2000 hour manufacturer warranty. The tractor was now out of warranty. Beeler Tractor Co. contacted New Holland (manufacturer) and asked if they would be willing to help with the repair cost. Their response was no, the manufacturer warranty has expired and the tractor is out of warranty. We informed Mr. [redacted] of New Holland's response.Mr. [redacted] then called New Holland and they struck a deal. The manufacturer would pay $1000.00 of the repairs if Beeler Tractor Co. would pay $1000.00 of the repairs. We agreed and the decision was made to repair the engine.Beeler Tractor Co. was then contacted by New Holland stating they would no longer honor their end of the agreement as Mr. [redacted] had called back to the manufacturer numerous times and had used harsh vulgar language toward one of their phone representatives.Beeler Tractor Co. did honor our end of the agreement and willing to honor the manufacturer's word also. Mr. [redacted] agreed to the agreement ad we were willing to honor the manufacturer's word also. Mr. [redacted] agreed to the agreement as verbally made between Mr. [redacted] and Beeler Tractor Co. Beeler Tractor Co. also proposed the Mr. [redacted] could pay 1/2 the bill upon completion and make payments on the balance. This agreement is in writing and signed by Mr. [redacted], as is the original repair order.Upon completion of the repair on 02/10/2015, Mr. [redacted] came in the pickup the tractor and again was upset at the conditions of the tractor failure. He was informed the tractor had failed, in our opinion, due to lack of maintenance. We have no record of Mr. [redacted] purchasing maintenance parts between the date of purchase and the date of failure.Mr. [redacted] signed the payment agreement and wrote a check for the sum of $2200.00. The next day we received a phone call from Mr. [redacted] stating that he had made a mistake and had written the check accidentally on an old closed account. He offered no form of replacement for the check, only stating his mother would be home in a week or so. The following day we called Mr. [redacted] expressing our concern about having a bad check. We asked that he either replace the check or return the tractor. He stated that would be difficult as he did not have a trailer. We offered to pickup tractor and return the check to him. Mr. [redacted] stated if any employee of Beeler Tractor Co. came to pick up the tractor "there would be a problem". We told Mr. [redacted] that we had no choice but to deposit his check as that was the only form of payment offered. Mr. [redacted] used a profane comment and we ended the phone call. After depositing the check, it was returned marked "Not Sufficient Funds", not "Account Closed". Mr. [redacted] came in to b uy back his check and upon finding out the check was at the bank became angry with our bookkeepers and stated he was not coming back. We still have the returned check and are working on a resolution.Thank you,[redacted]

Review: I am reaching out on behalf of my Mother. Her and my Father purchased a New Holland tractor before my Fathers service connect death. She has been through a lot and is suffering from secondary PTSD. The tractor was properly maintained and had 260 hours when the engine began to knock loudly. This occurred Mother's day weekend 2014. The following week I reached out to Beeler Tractor. I was told after giving my Mother's information; that the tractor was not under warranty. I called in the past and was told the same regarding the warranty; when the tractor was do for service. So, I was told twice that tractor was no longer under warranty. I had a mechanic take a look and he advise me to take it to the dealer and see what they can do; The tractor is two years old and doesn't even have 300 hours. I didn't bring the tractor to the dealer until September, and was unable to find any paper work on it. I told the service manager Brandon; that tractor started to knock, I called in the past but I feel New Holland should do something. The tractor was knocking because it need a crankshaft, and do to the fact it wasn't under warranty"it only had a two year warranty" New Holland wouldn't do anything. I didn't think that was right because I took very good care of that tractor, and it didn't even have 300 hours. After making some call New Holland and Beeler tractor offered to give me $2000. It is at this point I requested the paper work on file at Beeler. Its then I found out that the tractor had a three year Power Tran warranty that should have covered the issue to tractor. They will not honor the warranty. I was charged $4200 and no discount is showed on invoice. They lied to me and the tractor was not ready to pick up until 11Feb.Desired Settlement: I would like something to be done. I would like to discuss this matter with someone in more detail. I feel that Beeler should be responsible for the warranty that they lied to me about.

Response:

Beeler Tractor did not follow the warranty that the tractor had. The issue occurred on the tractor May 11, 2014; when I reached out to Beeler by phone they told me it was no longer under warranty. They stated that tractor only had a two year warranty. When I brought the tractor in the service manager for Beeler Tractor again told me that tractor only came with a two year warranty. When I requested the paper work from the office. I found the warranty paper work and it stated that the tractor had an additional power-train warranty giving it additional year. Therefore, when the problem occurred and I called the tractor was under warranty. Beeler/New Holland will not honor because the date on work order is past the warranty date. The tractor started to knock before the warranty ended. Beller tractor lied to me and they want me to replace the engine and the tractor doesn't even have 300 hours. The tractor has always been properly maintained and recommended oil has been used. Beeler tractor needs to honor there warranty, replace the tractor, or buy the tractor back at the full price that was paid for it.
