The statements they are claiming are false .  There was no delivery in the front of the store by the cigarette rack. They retrieved the carton from somewhere out of my view. When I called the first time  about this matter, I spoke to a woman who said she was the manager, I asked her why the packs  weren't counted in front of me and she told me I could have counted them myself. They are lying.

The complainant came to our store to buy a carton of cigarettes. The carton she wanted was sold out, but
we were in the process of getting our...

cigarette delivery, so the manager said she would look through the
delivery to find the carton.
Our cigarette delivery differs from the complainant’s point of view. First, we were getting the delivery as the
complainant was in our store, not prior to her arriving. Second, the cigarettes were delivered thru the front
door, not the back of the store. They were being counted in our cigarette area which is located next to the
registers, not in the back of the store. This is all in plain view of customers, employees and numerous
cameras.
The complainant was standing by our 1~ register, which is located within 4 feet of our cigarettes. The
delivery was in front of the cigarette racks, not the back of the store. The complainant moved toward the
cigarette racks to watch the manager look for the carton. This is in plain view of everyone.
Once the manager found the carton, she ripped off the top flap to show the other employees what carton
she took, as they were still checking the cigarette delivery in. As we explained to the complainant, we
needed to show what carton was taken, so as the other employees verify our delivery, they would know why
they are short a carton.
The manager then walked 2 feet to the register and handed the carton to the cashier. The complainant
asked why it was open, the cashier explained what the manager did and pushed on both packs (which were
now showing) to show it was a full carton.
The cashier then placed the carton into a bag, the complainant paid for the cigarettes and left store,
The manager was always in plain view of the complainant, never went to the back of the store. We do NOT
open cartons to count packs.
All of this is captured on our security system. From the time the manager found the carton, ripped off the
flap and then gave the carton to the cashier is just a few seconds. She did NOT take a pack out and then
somehow rearrange the packs to make it look full. The camera clearly shows the carton and the cashier
pressing on the packs, as well as being placed into a bag.
We offered the complainant to view the footage, but she declined. We never stated to the customer they
should count the packs prior to leaving the store.
We can not show what happened to the cigarettes once she left the store and for the 2 days which passed
before she noticed a pack was missing.

Review: On 8-20-14 I went to the location to purchase a carton of cigarettes. The gentleman told me that they were out of cartons. As I was exiting the store a woman told me to wait, she said that the cartons just came in that morning, so I waited. She goes to the back of the store and comes back with a carton of my brand of cigarettes. As she is ringing me up I noticed that the carton of cigarettes are opened. I asked her why is it opened. She states that when the cigarettes first come in they have to open the carton to make sure that it's a full carton. I accepted her explanation, took the carton and left the store. I returned home, sat the bad with the carton of cigarettes down, and didn't think anymore about it until today 8-22-14 when I ran out of cigarettes. I took a pack of cigarettes out of the carton and I noticed that there were only 9 packs in the carton. A carton holds 10 packs of cigarettes The packs we we arranged to make the carton look full. I called the store, and spoke to the manager to try to resolve the issue and was told that I should have counted the packs before I left the store because no one took any packs out they have it on video. I want my money back for the pack of cigarettes I did not receive.Desired Settlement: I want reimbursed for the missing pack of cigarettes or a pack of cigarettes
