Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to meAgain, I never ask Troy G [redacted] to test for asbestos, I still believe that he should have recommended that I hire someone to test for the obvious asbestosI would of readily agreed to any recommendation made by MrG*** Lead paint, meth, mold, and radon are not clearly visible and I readily agreed to test for them based on his recommendationInitially Troy G [redacted] did not return my phone calls or respond to my e-mails, and only after that did I get upset suggest small claims courtWith good initial communication, both of us could have saved a lot of time and frustrationAgain, I am the one that had to pay over $to have the asbestos removed and new heating ducts installed.I accept Troy G***'s compromise of a refund of $ [redacted] and will sign a General Release and agree not to post further complaints or negative reviewsPlease forward my e-mail address and mailing address to MrG*** [redacted] @gmail.com [redacted] Sincerely, [redacted]

Ok, Mr*** keeps stating that he was aware I don't offer asbestos testing but somehow wanted me to point out asbestos materials in the home (as well as trash left in the crawlspace, which is not an inspection concern, but more a concern between buyer and seller on cleaning out he house as move out)We all agree and have discussed in great detail that I don't offer asbestos testingIn my professional opinion as well as the opinion of the National Association of Certified Home Inspectors, who is the leading authority of home inspection Standards of Practice in the USA, you can not point out asbestos without testing or verifying it is ACTUALLY asbestosThat would be like a doctor telling you that you have cancer before actually testing for the diseaseHome inspectors can not be in the business of guessworkI have tried to make that as clear as possible MANY timesIf I am not going to offer asbestos testing services (something as a business owner I have no desire to get into), and am not trained and certified to do so, I can not get involved an any thing to do with asbestosMr*** does not seem to like this answer, but I am merely following NACHI standards and obeying the lawI am sorry if he was under some misconception that I would offer this guesswork service, but I do not and never haveHe claims it was obvious there was asbestos by looking at is, and maybe he is more of an expert than me in that fieldI really do not knowI do consider myself one of the best and most qualified home inspectors in Utah (as well as thousands of Realtors and clients have for many years)Not sure why this statement is being questioned? I have very high ratings and AWSOME customer feedback on a very regular basisIn all the threats and complaints Mr*** has made he has never once asked in any way for a refund of his inspection, which is something I offer if he is unsatisfiedI would have done that at any time, but I was not going to offer it due to his initial threat of small claims litigationThe most I can do ethically and legally to resolve this situation is refund his original paid inspection fee (which is also the most I am obligated to do in the contract he signed as well)If he agrees to drop this complaint and hopefully repeal his other negative reviews he posted online I will refund him the $*** inspection fee ($***-$** discount he was given)I will not refund the additional fees he paid for the mold testing, meth testing and lead paint testing, as there was no dispute about those entirely separate servicesPrior to the refund of the inspection fee he will have to sign a General Release, releasing my company from all further claims or actions and agree to post no further complaints or negative reviews about my company onlineIt would be as if we never did business in the first place.Refunding this fee is more than I want to do, as I honestly feel I offered Mr*** a complete and valuable inspection service, as I do and have done with thousands of other satisfied clients (even many clients buying old homes with possible asbestos I presume)Refunding him his inspection fee means I donated hours of my time and money inspecting his house, driving to and from the inspection site, and typing up an inspection reportThis of course id on top of all the time spend dealing with the complaints and disputesI will do this as a gesture of goodwill though as I do advertise 100% money back guarantee on services a client is unsatisfied withIf this compromise will satisfy him then have him reply with his email address and mailing address he prefers so I can email him the release and get a check mailed out as soon as I get the signed release back from him.Sincerely,Troy G***

*** hired me to inspect this older home in Salt Lake CityHe asked my to do the complete home inspection packageI offered him an inspection package that included the standard home inspection, infrared thermal imaging, mold testing and meth testingI told him I did not offer asbestos testing
servicesI have never in years of business ever gave any client the impression I offer asbestos testing services, nor does my website or any other company marketing materials imply that, and he also signed an inspection agreement contract that clearly states that asbestos testing is not included in the inspectionAs a member of NACHI (National Association of Certified Home Inspectors) I follow their international Standards of Practice (which I mailed him as well), which state asbestos testing is not part of a home inspection serviceI am not qualified to test for asbestos and he knew thatI can not look at building components and guess if they may possible be asbestos based or notThat would be very unprofessional and illegalHe knew up front I did not offer this service and should have sought out a company to test for asbestos if it was a concern to himI have done everything reasonable to remedy this situation, but the reality is I can not do something I am not qualified or licensed to doHe threatened small claims litigation so I sent him a page certified letter explaining my side of the story and the terms he agreed to in the contract he signedSince then, after realizing he has no chance of winning a court case because I fulfilled my end of the contract and his claim is frivolous, he has been harassing me, emailing me and posting bad reviews onlineHe received all the valuable services he paid for and found out many important issues about the home he was buying when I did the inspectionThe reality is that he chose not to hire an asbestos testing service during his home buying due diligence periodHad he done so he could have negotiated with the home seller for repairsNow, due to his lack of due diligence he want to pin this issue on my company. In years of doing business I have never had a serious complaintI am a very through home inspectorI have a very good reputation around Utah, and have very high reviews online, with the exception of this unreasonable clientI have exhausted every effort to please this guy (I have probably spent hours responding, emailing, etcto him), and will not spend anymore of my valuable time trying to remedy a situation in which he refuses to see the fault on his partHe didn't even attend the home inspection, even though I recommended he do soHis claim is unfair and frivolousI would hope after all the years I have been an accredited business with the Revdex.com with an A+ rating I would hope your company can see the truth of the situation hereI have attached the letter I mailed himI can provide additional documentation such as the contract he electronically signed, NACHI Standards of Practice, etcif needed.Sincerely,Troy G***Owner, Behind The Scenes Home Inspections###-###-#### Direct

I am rejecting this response because:I never expected Troy G[redacted] to TEST for asbestos. What I did expect was a complete inspection of the heat distribution system including fans, pumps, DUCTS, piping and insulation as stated in the Behind the Scenes Home Inspection Protocol. In Troy G[redacted]'s report he marked that the ducts were uninsulated. As it turned out all of the return ducts were insulated and some of them were covered with very obvious asbestos type material (I am not trained in asbestos and my first thought when I noted this material was that it had to be asbestos. I immediately had the material tested and it did test positive for asbestos). In Troy G[redacted]'s  response e-mail to the Revdex.com, he states that prior to my purchase of the house he told me that he did not test for asbestos is a lie. The subject of asbestos was never brought up until after I purchased the house. I agreed to every test that Mr. G[redacted] recommended and I would have readily hired an asbestos inspector if he had suggested it. Again, no mention of a possible asbestos problem and no mention of the discarded heating ducts and trash in the crawl space. The discarded ducts and piles of trash in the crawl space should have been included in the inspection report even if they did not include asbestos.I chose Behind The Scenes Home Inspections based on a very professional web page. On this web page Mr. G[redacted] basically states that he is the best inspector in the area and that he is so confident that he offers a 100% money back guarantee. What good is a guarantee if it is not honored? I did mention small claims court to Mr. G[redacted] and his response was that it would be a breach of the contract that I signed? Again, no effort to remedy the problem, just letting me know that I do not have the option of small claims court.Troy G[redacted] is turning the facts around to make him look like the victim. He has done nothing to resolve the problem, no compromise, nothing. The fact is I am the one who is paying over $7000 to have the asbestos problem resolved. Prior to this event I have never complained to the Revdex.com or posted a negative review about any business. If Troy G[redacted] responds to other clients like he responded to my concerns the public needs to be aware.I have pictures of the trash and the discarded asbestos containing heating ducts in the crawl space and pictures of the very obvious asbestos in the heating system if you would like me to send them to you.
