In November, 2014, Mr. and Mrs. *** (collectively the “***”) purchased the LeafGuard system from LeafGuard of Central Texas, Inc. (“LeafGuard”). At the time of the sale, LeafGuard and *** discussed the need for an additional downspout on his home. After careful examination and discussion, it was decided jointly by LeafGuard and *** that an additional downspout would probably not be needed, however, if *** ever noticed an issue with overflow, they should contact LeafGuard to add the additional downspout. At the time of sale, LeafGuard only charged *** for the materials that were installed and *** was not billed for the downspout that was not included in their original system. As mentioned above, LeafGuard requested that *** take a look at the installed LeafGuard system when it rains to ensure that the gutters were not overflowing and the additional downspout would need to be added. From November 2014 through April 2018, *** expressed no issues or concerns to LeafGuard regarding their gutter system. In April 2018, *** notified LeafGuard that their LeafGuard gutters were clogged and wanted to add more downspouts and LeafGuard. Per the written contract between LeafGuard and ***, LeafGuard unclogged the gutter system at no charge to ***. However, when the issue of the additional downspout was discussed, *** was unwilling to pay for the labor and materials associated with its installation.Approximately seven months later, in November 2018, *** again called LeafGuard to unclog their gutter system, which LeafGuard, again, did free of charge to *** as part of their lifetime warranty. Also, again, LeafGuard informed *** that the only way to fix the issue permanently would be to add an additional downspout. To add the downspout, LeafGuard informed *** that the fee for labor and materials would be $150. *** acknowledged LeafGuard’s recommendation by signing off on the service ticket the technician used to explain the work performed and work that needed to be performed. For the next seventeen months, LeafGuard has not heard from *** regarding any issues with clogs or with approval to add the recommended additional downspout. Apparently, now that *** is planning on selling their home, the issue is again rising to the forefront.From 2014 to today, LeafGuard has stood by and performed work at the *** residence under its lifetime no-clog warranty. Despite several increases in labor and material costs over the years, LeafGuard is still willing to add the additional downspout at no additional cost than the estimate provided in 2018.
