LeafGuard Northwest, Inc(“LeafGuard”) has complied with all of its contractual obligations owed to the Customer, who purchased a LeafGuard gutter system in When the Customer purchased her LeafGuard gutter system in 2000, she received a limited “no clog” warranty Specifically, the warranty guarantees that water will remain “free flowing” throughout the LeafGuard gutter system If water does not, LeafGuard will come out and clean the LeafGuard gutter system at no cost to the customer And, as the Customer indicated in her complaint, LeafGuard has cleaned her LeafGuard gutter system at no cost to her What the Customer complains of in her Revdex.com complaint is that LeafGuard will not clean out her underground drains First, LeafGuard did not install the Customer’s underground drains and has no way of knowing the condition of the underground drain(s) when LeafGuard installed the LeafGuard gutter system in or now More importantly, the warranty that the Customer received expressly states, “This warranty applies to the Leafguard gutter system only, and does not apply to any underground drains.” When the Customer contacted LeafGuard in regarding the underground drain(s) potentially being clogged, LeafGuard advised her that pursuant to the contract that she, and not LeafGuard, is responsible for the cleaning of the underground drains If her LeafGuard gutter system becomes clogged again, LeafGuard will continue to honor its warranty and cleaned the LeafGuard gutter system at no cost to the Customer But, LeafGuard has no obligation to clean the Customer’s underground drain(s)

As the Customer indicated in his complaint, LeafGuard Northwest, Inc(“LeafGuard”) has responded to his calls for service over the years Based on information that we have gathered from the Customer, the Customer had his roof replaced after LeafGuard had installed the LeafGuard gutter system on the Customer’s home When the roof was replaced, the roofer installed flashing Potentially, this was/is causing the problems that the Customer is experiencingNevertheless, LeafGuard agreed to and has replaced the corner that the Customer had a concern with We made sure that it was thoroughly sealed by water testing it on two different occasions to make sure that it was working properly, and it is We advised the Customer that the issue with water gettingbehind the gutters might be associated with the roof In the interest of customer service, we will again go back to the home to check and make sure that the corner is still working as designed LeafGuard will do all that it can to assist the Customer with his problem Yet, at this time, LeafGuard believes that it has done all that it could So, LeafGuard consider this matter closed

Although LeafGuard Northwest, Inc(“LeafGuard”) strives to have every job go perfect the first time, sometimes it does not. This was the situation in this case. However, when things are not perfect, LeafGuard makes every effort to resolve any issues that customers might have, when
it is given a chance to do so. In this matter, the Customers have not allowed LeafGuard an opportunity to correct any of the issues that they have raised. Additionally, LeafGuard has not had an opportunity to reasonably discuss this matter with the Customers. Generally, the Customers have refused to take LeafGuard’s General Manager’s phone calls, stating in emails not to call. Also, generally, the communications have been limited to the Customer just making their demands, as discussed below, via email
The Customers complain that the job was not completed on the scheduled day of install. In his complaint, the Customer states that the job agreed to be finished on Friday, November 4th. This is not accurate. While most jobs can be completed and LeafGuard strives to be complete on a particular day, it does not always happen. More importantly, the contract does not state/require that the job will be completed on November 4thUnfortunately, the installers did not have all the required pieces to complete the job on November 4th. But, this is an easy fix. Moreover, on Friday, this issue was discussed with the wife. The Lead Installer advised her that we would be back on Monday to correct the issue. The wife expressed that she was fine with LeafGuard coming back out on Monday. Yet, when the husband called the Production Manager on Sunday, the day before LeafGuard was go back out to the property, the husband advised that he did not want LeafGuard back on his property, i.enot allowing LeafGuard to finish the job on Monday, as was agreed to on Friday with the wife
The Customers complaints regarding the extra downspout and/or noise cannot be addressed without LeafGuard being allowed on the property. Regarding the extra downspout, there are times when a sales representative might not be able to determine specific number of downspouts that are needed. While it happens infrequently, it is only when the installation team arrives and starts doing the work that it can be determined that an additional downspout is needed. In this case, a particular area of the roof has negative pitch effecting how the water will flow. Specifically, negative pitch usually occurs when a house settles; thus, water than has to flow “uphill”. Thus, an additional downspout was needed to make sure that the LeafGuard gutter system worked as advertised; water in the gutter system will remain free-flowing. As to the noise, LeafGuard would have to be able to inspect the situation to come up with a possible solution to the Customers’ concerns. Again, LeafGuard cannot do so unless it has access to fully inspect the situation.
While this job did not go as smoothly as most do and as LeafGuard strives for, LeafGuard has no legal obligation to cancel the contract. LeafGuard has a legal right to fully inspect the issues raised by the Customers and given an opportunity to correct any true deficiencies. Yet, the Customers initial response was to deny us access to the property. Then, they made a demand, via an email, for a deep discount of the price that they are contractually obligated to pay. Now, the Customers’ demand is to have LeafGuard remove the LeafGuard gutter system and make them “whole” by putting up their old gutter system, which they must know is an impossibility. LeafGuard, and no gutter company, would leave an old gutter system in the form that it is when it is removed from a home. The aluminum is compressed; so, it can be stored until discarded It is impossible for LeafGuard to reinstall the gutter system that was removed from the Customers’ home. Also, LeafGuard was contractually required to take down the old gutter systemAn obvious necessity before a new gutter system can be installed.LeafGuard does many things in the interest of customer service even when it has no legal obligation to do so. In this case, there is no legal reason for LeafGuard not to get properly paid for the work it did, considering that LeafGuard will honor all actual contractual obligations. Nevertheless, LeafGuard does think that it is in everyone’s best interest that the parties just go their own ways. So, LeafGuard is willing to take down the LeafGuard gutter system, and the Customers would have no further obligation to pay under the contract. LeafGuard has already made this offer in writing to the Customers who have rejected it, claiming that they need to be made “whole” At this time, the Customers have not paid anything, not even a down payment, because the job was to be financed. LeafGuard is not going to pay to have another gutter system installed on the home. If the Customers really do not want the LeafGuard gutter system on their home, they can use the money that they intended to use to pay for the LeafGuard gutter system to pay for another system. LeafGuard is not legally required to give the Customers a free gutter system. Again, LeafGuard reiterates its offer to remove the LeafGuard gutter system, cancelling any obligation for the Customers to pay LeafGuard. But, LeafGuard is not agreeing to the Customers’ demand to give them a free gutter system. If the Customers continue to insist in their current demands, LeafGuard will be required to take whatever legal actions available and necessary to it to resolve this matter

Based on LeafGuard Northwest, Inc.’s (“LeafGuard”) understanding of the Customer’s latest filing, LeafGuard believes that there might be some confusion regarding “the release of contract” that the Customer referenced in her latest filing. This confusion is potentially due to lack of LeafGuard being able to talk directly to the Customer regarding this matter. As the Customer cited to in her latest filing, LeafGuard’s General Manager did send the Customer an email offering to rescind the contract, even though it had accomplished most of the work, had a verbal agreement to complete the work in few days, and despite the verbal agreement, the Customer prevent LeafGuard for completing the work. As LeafGuard explained in its original response, LeafGuard made the offer, even though it has no legal obligation to do so, in the interest of customer service and an attempt to resolve the matter amicably. The “release of contract” that the Customer referenced is generally a standard release, commonly used in the industry. Specifically, for the consideration of LeafGuard not seeking payment, because no money has changed hands at this time, and LeafGuard removing the new LeafGuard gutter system at no cost to the Customers, the Customers would release any potential claims against LeafGuard. LeafGuard’s offer still stands. However, also as explained in LeafGuard’s original response, LeafGuard cannot put back up the old gutter system, which LeafGuard was contracted to remove, nor is LeafGuard legally required to buy the Customer a new gutter system. So, if the Customer continues to insist on having LeafGuard paying for new gutters, we do not know how we are going to be able to amicably resolve this matter

I am rejecting this response because: They have come out and replaced the area of gutter that was leaking and have come out twice since to reseal it because the new gutter is leaking as well, at this time it is still having water come down through the seams of the gutter, but will wait to see when it rains next if it continues.  The comment that I had my roof replaced is incorrect.  My roof has not been replaced in the area that the gutter is leaking it is still the original roof when installation of the gutters were done in this location.

LeafGuard Northwest, Inc. (“LeafGuard”) has complied with all of its contractual obligations owed to the Customer, who purchased a LeafGuard gutter system in 2000.  When the Customer purchased her LeafGuard gutter system in 2000, she received a limited “no clog” warranty.  Specifically,...

Coverage Under This Warranty
This Warranty is extended to you the Property Owner(s) identified in this Warranty Certificate. Subject to the terms andconditions set forth in this Certificate, Englert warrants that the seamless aluminum LeafGuard® with Scratchguard® gutterand rain carrying accessories identified in this Certificate and installed on the Property identified in this Certificate willnot blister, flake, chip, crack, peel, split, rot, red rust, or structurally deteriorate as a direct result of manufacturing defects,under ordinary wear conditions, if installed to Englert specifications and provided that the cleaning methods as describedon the other side of the Warranty have been fully followed. This Lifetime Limited Warranty lasts for the life oftheproperty on which the gutter/rain carrying accessories were originally[redacted], for as long as you own the property.This warranty is transferable by the original property owner to subsequent purchasers of the property provided Englertreceives notice of transfer of title of the above property within 30 days after the date of the sale. However, upon thetransfer, the warranty period will be no more than 50 years from the date of original installation of the gutter/raincarrying accessories on the Property, prorated in accordance with the Warranty Coverage Schedule. Owner(s) Responsibilities in the Event of a Defect or Complaint
If you believe or find that your seamless aluminum LeafGuard® with Scratchguard® gutters or gutter accessories exhibit amanufacturing defect covered by this Warranty, simply write to Warranty Department, Englert Inc., 1200 Amboy Avenue,Perth Amboy, NJ 08861. Describe the defect and provide your name, property address, date of installation, and copy ofthis Certificate. In order to qualify for warranty coverage, you must submit in writing within forty-five (45) days from thedate the defect is first discovered, noticed, or reasonably could have been discovered.
Englert will respond to you within a reasonable period of time after we receive your claim, and reserve the right to requireyou to furnish proof of purchase. Furthermore, Englert reserves the right to inspect the gutters or gutter accessoriesclaimed to be defective, within a reasonable period oftime after receipt of your claim.
Remedies Under This Warranty
Englert will, at its option, either repaint, repair, or otherwise replace the defective seamless aluminum LeafGuard® withScratchguard® gutters or gutter accessories. If it is determined that the claimed defect is covered by this Warranty Duringthe original purchaser's Ownership of the Property, Englert will pay 100% of the cost of repainting, repairing, orotherwise replacing the defective aluminum LeafGuard® with Scratchguard® gutters or gutter accessories. Englert'sobligations under this warranty will not exceed the purchase price of the originally installed Products found to bewaiTantable and the cost of the labor involved in the original installation of such defective Products. Any additional costsare the responsibility of the owner.
Subsequent owners and others are covered by a 50-year prorated warranty for LeafGuard with Scratchguard RainRemoval Systems as follows: If the defect is reported to Englert during the first year following the date of originalinstallation of the defective aluminum gutters or gutter accessories, Englert will pay 100% of the cost of repainting,repairing, or otherwise replacing the defective aluminum gutters or gutter accessories. For each succeeding year thereafter,through the fifth (5th) year, Englert's portion of such costs will be reduced by ten percent (1 0%) per year. During the sixth(6th) year, and each succeeding year thereafter, through the fourteenth (14th) year, Englert's portion of such costs will bereduced by five percent (5%) per year. From the fifteenth (15th) year through the fiftieth (50th) year, Englert's portion ofsuch cost will be ten percent (10%) of the original cost of installation, including material costs. Nonuniformfading and color change resulting from the use of touch-up paint or the unequal exposure of your seamlessaluminum gutters or gutter accessories to the sun and elements are not covered by this Warranty.All Englert's seamless aluminum gutters or gutter accessories installed, within one-half ( 112) mile radius fromthe seacoast, are excluded from Englert's Warranty.Normal ConditionsThe Scratch guard® Finish on your seamless LeafGuard® gutter and rainware products is one like any other colored orpainted surface, subject to chalking and some degree of color change, due to normal atmospheric weather conditions anddirt accumulation, depending on the atmosphere to which your rainware is exposed. Under normal conditions,objectionable superficial surface dirt can be removed by washing down the gutters with a garden hose and a soft bristlebrush. While weathering occurs through exposure to the sunlight or extreme weather conditions, the Scratchguard®Finish resists the associated problems of peeling, chipping and blistering. In addition to resistance to chipping, peeling andblistering, the Scratchguard® Coatings are formulated to resist fading (color change) due to normal weathering for areasonable period of time, depending on the atmospheric conditions to which your home is exposed. The Scratchguard®Finish has built-in color retention ability. It resists dirt and stands up to the environment better. The resistance to dirtadhesion provides a self-cleaning feature, which helps to greatly minimize loose surface dirt, caused by normal rainfall.Unusual ConditionsIn industrial areas, where a more thorough cleaning is necessary for stains resulting from tree sap, insecticides, chimneyfumes, etc., the finish should be washed with a sponge or soft bristle brush and a solution of detergent and water (113 cupof detergent such as Tide, per gallon of water, for example). Complaint: [redacted]  I am emailing you the entire response.  This is the second time it is limited.I am rejecting this response because: [redacted] emailed us 11/10/16 see email below that we have been released from the $8433 contract.  Is Revdex.com able to secure a copy of that release from the contract for $8433?  No financing was signed.  The release is necessary due to the breach of contract.  The breach of contract is why we did not allow Leafguard NW back on our property!  Also we fear more damage from Leafguard installers such as removal of flashing and damage to our roof!
We agreed to answer any questions [redacted] had.  He chose not to email us any questions.  We feel words in a conversation may be misinterpreted that is why the request for questions was in writing.  
Furman Insurance has opened a claim.  As soon as repairs are complete we will release the issue with Revdex.com.  Issues are remove the Leafguard system & replacement of working gutters as we had that do not make noise along with the water damage inside the home!  We have not heard from the adjuster yet as [redacted] from Furman Ins in FL advised on Friday we would hear from the adjuster within 48 hours.
We had a contract with Leafguard NW which at point of sale we were sold a slope to the gutter system.  What we have is crimped on the ends.  “If” the corners were up on the install we probably would not know that the water was standing in the corners where the water goes backwards and there is no slope only a crimp at the end!  This is not what we contracted with Leafguard.
We must be made whole with new gutters due to the breach and we did not give permission to rip off our working gutters for this mess!  Also no noise was disclosed at point of sale!
Leafguaard says we paid nothing.  True and we did not give permission to rip off working gutters for the mess they left us with now with water in our home.
Our Contract is with Englert Leaf Guard by Beldon Home Solutions License [redacted] when the contractor license number is for Leafguard NW for the State of WA.  Why does Leafguard NW not use its correct name but several different names on the contracts?  That is very confusing is it legal?

 At Beldon Home Solutions, we want to make sure we do everything within reason to satisfy your needs.  Not allowing us to have a conversation to help rectify the situation does make it more difficult.  After further review by our corporate office, we have decided to remove the LeafGuard gutter system and cancel your contract at no cost to you.
 
Please verify that you have received this e-mail and you are in agreement with us cancelling the contract.  Once we have received your e-mail confirmation, we will draft up a legal release that will need to be authorized by you both.  Then will will schedule a time and date (at your convenience) to come out and remove the system.

Everything must be in writing if LEAFGUARD NW the company licensed not the company named on our contracts is confused with things in writing!  Talking would be more confusing for these people!  Again the time to talk was when they did not have corners and ripped off our gutters not now that their own insurer calls their acts a BREACH OF CONTRACT that by their own admission they do not understand! 
 
We got BREACH of Contract from Leafguard NW own insurance company.  Maybe Leafguard NW needs to talk with CNA to understand their breach and multiple property damage since Leafguard NW has no coverage!
 
Maybe we need a media event for people to understand that LEAFGUARD NW uses many names on their contract and has NO WARRANTY BOND OR INSURANCE!  Would that bring a clearer understanding?
 
What would Leafguard be seeking payment for?  Leafguard breached the contract and must make us whole with a working gutter system NOT LEAFGUARD.
 
LEAFGUARD LIED TO GET A CONTRACT.  THERE IS NOISE & NO SLOPE TO THE PRODUCT INSTALLED.  THE ORIGINAL QUESTION WAS ‘WERE WE LIED TO AT POINT OF SALE OR INSTALLATION’?  THE ANSWER IS BOTH!
 
The company has a legal responsibility to make us whole because they did not perform as agreed.
 
No cost means we have a working system that Leafguard NW, Beldon, [redacted], or [redacted] pays for because you breached the contract, do you understand yet?  If not it is because you do not wish to be responsible and have no insurance or bond to cover as your own insurance company & adjuster stated!
 
NO where did we agree for you to remove our gutters when your own National Franchise Marketing Manager for Leafguard Franchises,  [redacted]  [redacted] asked me “[redacted], why did they come to your home with no corners?”
 
We can only speculate!  Why would [redacted] ask the obvious?  And why would Leafguard proceed with no corners that we were told they could not match up if they had them!
 
LeafguardNW  was prevented from doing work after it breached the contract as CNA Insurance the parent insurance company of all Leafguard NW insurance that has no coverage.  Isn’t that who Leafguard NW response person needs to make contact with to understand their BREACH not talk with us!
 
We explained what occurred and the CNA claim was stated to us damage due to  “Breach of Contract” that is where we got the term.  “Breach of Contract with multiple property damage issues” stated in the claim filed that Leafguard NW  shut down CNA Claim #[redacted].
 
Leafguard’s insurance Furman Insurance in FL.  Adjuster [redacted] in Atlanta advised me that Leafguard NW “does not have a Warranty Bond or insurance to cover the damage caused” on the breach of contract.  Adjuster [redacted] called December 6th 2016 and has not sent an adjuster to see the damage probably because Leafguard NW has no insurance to cover!

 Since Leafguard NW is not able to put back our working gutter system and breached the contract Leafguard NW must pay a third party to do so and does not have insurance to cover their mistakes or a warranty bond as L&I for the State of WA requires!
 
We have nothing contracted for a 2hour install completed with a slope oh and noise was never disclosed!
 
 Again we pose the question how will this be attended to with no insurance or warranty bond since as your OWN parent insurance company stated you have ‘BREACHED the contract with MULTIPLE property damage issues’ and your own National Franchise Marketing Director [redacted] wants to know why you kept the appointment without bringing corners.  IS THIS CLEAR ENOUGH BECAUSE TALKING WILL NOT BE ANY CLEARER THAT WHAT IS STATED HERE.  And what we are stating is from your marketing director and insurance companies!
 
How is Leafguard NW going to handle our damage?  That is the question and very clearly stated!
 
Due to the breach Leafguard may not do any work on our property!
We were told this was a 2 hour installation.  It was not.  Installers arrived with no corners and could not as I was told get the corners to match up even if they had them.  Leafguard was not able to pitch the system.  Nothing sold at point of sale is on our home which is why Leafguard must correct after ripping our working gutter system off!  We never gave permission for ripping off the gutter when you had no corners and breached the contract.  Did you get it yet?  Talking will not be as clear as the written word!
 
When will you pay for a proper gutter system to replace what you  ripped off and as CNA said other multiple damages when you have no bond as require and no insurance as your own adjuster stated
 
Revdex.com there is no reason to talk if Leafguard NW is not able to comprehend what is in writing.
 
 
The work accomplished has flooded our home.  Leafguard NW or Beldon or the many names on the contract are not able to perform any work on our home due to the breach!
 
Also the financial contract states if we are not satisfied we do not need to sign.  A normal person would gather we are not satisfied therefore we are not signing the financing contract and must be released from it.  Is that clear enough to the confused respondent?
