Mrs *** is upset, but the point of a holding a deposit
is to make a payment to show that you are serious about the propertyWe gave
her a receipt for her certified check which she signed her nameWe took the
property off the market, and couldn't accept any other offers, which could be
at risk to the seller of losing moneySo of course the holding fee is
nonrefundable (which clearly is stated on the application on the *** Why
would we take money for holding a property from a potential buyer to turn right
around and give it backIf that was the case Mrs *** could of just told me
she was interested and waited till the 1st to make full payment
She paid the deposit because she didn't want anyone else to come
take the housePlus we gave her a deal at the time and we were opened to
taking higher offersBut she wanted the house, so she put a deposit down
And we could no longer market the property
We were opened to working
things out with her, which we came to an agreement with her attorney, but she
has done too much to hurt us from moving the house she has broken windows and
forced entry into propertyShe has continue to harass me, realtor, and
potential clientsA Police report has been filed and we are taking legal
action

I drove to [redacted] the first week of October, 2015  to put signs up around the area to market the house for Rent to Own. As I was pulling away from the property to return to [redacted] came by to get information about the property. After giving her the asking price...

and explain the rent-to-own program, she seemed really interested in the property. She seemed like a really nice neighbor. She invited me and my partner over to see her home after a viewing of the house. Because [redacted] was such a nice woman that seemed really interested in the property on [redacted] we decided to lower the  option fee to $4900 from $7000.  We informed her on the whole process and where to fill out the application.  [redacted] filled the application out and paid the application fee the same day. (The application was in her name)On the way back to [redacted] texted and called us back all day trying to find out how to get into this home. She did explain this would be a good home for her brother, but she also wanted to put it in her name so, if anything was to happen to him she would remain ownership of the house and rent it out.  After going back in forth and negotiating with [redacted], our finally offer to her was: Pay the Deposit within 3 months plus her rent. (Below is the exact agreement)$1000 (Oct 7th) Holding fee to take the property off the market, Because she didn't plan to move in til Nov 1st. We needed to secure the property to know she was serious, before removing the property off market which I explained to her$2350( Nov 1) (Rent+ $1000 deposit)$2800 (Dec 1) (Rent+ $1450 deposit)$2800 ( Jan 1) (Rent + $1450 deposit)[redacted] agreed to those terms. [redacted] was also aware of the non refundable deposit. Why would we have her put a deposit down to turn right around and give it back to her. The whole reason she paid the $1000 deposit on Oct 5,2015 is because she wanted us to take the house off market, and to assure she will get the house Nov 1st. If the deposit was refundable we would of just waited till November 1st, to get her started. [redacted] understood that The $1000 deposit was to stop marketing efforts on the property and not be able to take any applicants even if we had someone that wanted the house for our original asking price. [redacted] was so urgent to get the property secured she called us on the 5th of Oct and told us she was ready with the cashier check. So we went to [redacted] 2 days earlier to pick up cashier check. Aliitle over a week later I received a message from [redacted] stating her brother is ill and she would not be able to get the house. She also asked for the deposit back. I called [redacted] that evening and re-informed her the deposit is non refundable, which I explained to her before we picked up payment and it also state that on the application on the [redacted]  But because of the situation and [redacted] being a neighbor I was willing to work something out with her. I was receiving a lot of calls for redwood.  I told her if I got someone in the home by Nov 1st I was willing to give her some of her deposit back. Of course [redacted] didn't like that idea. She told me if she didn't get it all of the deposit she didn't want any of it. I was still willing to give her something  back if I got a buyer by the 1st because I understood she was upset. A couple days later I got a call from the police stating someone had broke into the house and broke window etc. I had my suspicion about who did it but I left it along and took care of the problem. Then Oct 30, my realtor was at the house with 3 potential clients and told me [redacted] came to the house harassing her and the potential buyers. [redacted] was asking the ladies "Are you trying to buy this home", "You shouldn't buy this home" "The company ripped me off and wouldn't let me move in the home" The realtor said she was very rude and trying to scare my potential buyers away from doing business me. I have decide because [redacted] was fully aware of the non refundable deposit ( verbally and [redacted] and she was trying to hurt my efforts of getting the property moved. I am not longer opened to refunding any of the deposit.
