I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
It is not acceptable for a business to accept money in advance for a service they are unable to provide. This company essentially stole $70 from the customer and offered no restitution, even though it was in their ability and ethical responsibility to do so. Money was paid for a specific service, not a less comparable one, and that service was not rendered due to no fault of the consumer. The company should be held responsible for its inability to follow through with such contracts or cease selling gift certificates. Additionally, on May 22, 2009, the Credit Card Accountability Responsibility and Disclosure Act of 2009 (Credit CARD Act) was signed into law. While the law’s title suggests that it only applies to credit cards, the law also created new consumer protections for gift certificates, store gift cards, and general-use prepaid cards through amendments to the Electronic Fund Transfer Act (EFTA). Specifically, section 401 of the Credit CARD Act requires disclosures for gift certificates, store gift cards, or general-use prepaid cards fees and expiration dates; limits dormancy, inactivity, and service fees for these cards and certificates; and establishes a MINIMUM period of five years before the underlying funds for these cards and certificates can expire. Do these laws not apply? I wonder how many other customers have been conned out of their hard-earned cash and am glad to have this opportunity to be a voice for those who may not know how or may not be able to lodge a complaint.

all gift certificates which explicitly stated they will expire in 6 months from the purchase date. And NO Refunds-or-Cash Back. We are very sorry for the inconvenience. The massage therapist was ill that morning. Bella Vita offered any service or product if she would like to use the gift certificate that day.. The stylist did give her a complimentary deep conditioning treatment.. We also offered to schedule another massage with a different massage therapist.
