I am rejecting this response because:
This complaint should not have taken Bellmare tree service by surprise If the owner had answered my phone calls after he told my neighbor to go *** herself, we probably wouldn't be in this situation
In their response, they say that I was notified that they would need to use my neighbors driveway ahead of time That's not true at all The foreman, ***, told me they needed to use it when he arrived at my house to take the tree down I called my neighbor who told me the keys were in his car and I was able to move it
They also say that I called them a week later requesting the logs to be removed This isn't true either When I spoke with the owner on the phone about taking the tree down, my request was that they cut the tree and remove the logs and debris
Regarding the time we were supposed to meet to discuss this issue *** *** asked me when I would be able to attend a meeting with her and Bellmare I told her to set it up for whenever was convenient for her She set the meeting up for 6:30, when she would be out of work I work nights, so I took time off from work to attend the meeting *** *** called *** at 7:the day of the meeting and told her that he had trouble with one of his bucket trucks and apologized for missing the meeting This is where Bellemare's response is different from what actually happened *** didn't say "That's *** right I want to know when the *** *omeone is going to be on my *** *** property." *** told *** that she was mad that he blew us off and that I had to take time off from work for no reason*** also told him that she wanted to meet the person that he was going to send out to fix the driveway because she didn't want anybody working on her property that she hadn't met That's when he told her to go *** herself and hung up on her I called him several times shortly after to try salvage the situation I tried to contact *** several times over the next few days to try and resolve the situation He didn't return any of my calls
At the end of Bellemares response, they emphasize that they had permission to use the driveway I believe that permission is irrelevant Permission given to use the driveway doesn't absolve them of the liability to fix the damage they caused.
I can also appreciate their explanation of where a sinkhole comes from, however, we're not talking about a sinkhole We're talking about an area of my neighbors driveway that was damaged as a result of Bellemare's employee repeatedly driving over it with a large truck full of wood chips and a wood chipper attached
As far as the *** waiting a week to contact Bellemare about the damage They noticed the damage to the driveway several days later when we were looking at the amount of damage done to my yard from the truck and equipment the crew used The deep ruts in my yard led right up to the area of the driveway that was damaged

I am rejecting this response because:
Bellemare is correct in saying that no further contact was made with me, but only because *** refused to return my multiple phone calls I was there with *** *** when *** told her to go *** herself There was nothing interpreted in that conversation I heard everything that was said because I was standing right next to her The damage to my lawn was addressed with the job foreman, *** We spoke about the deep ruts in my yard and I told him not to worry about it, but it was discussed The damage isn't just the area where the driveway buckled under the weight of the truck, but there's also cracks up the side of the driveway where the guys were driving between my yard and the *** driveway Bellemare seems to be under the impression that consent to use the driveway absolves them of any liability of damage caused Regardless of whether consent was given or not, the driveway wasn't damaged before Bellemare drove on it They used the driveway to gain access to my yard, and the driveway was damaged I don't want them to send someone to assess the driveway I want Bellemare to pay for the repairs

The detailed telephone
conversations were always between [redacted] Bellemare and [redacted].  [redacted] may have interpreted the
conversations but he never heard them.  No
further contact was made with [redacted] after services were rendered, satisfaction
was expressed, and payment was made.  Lawn
damage was never addressed as an issue. 
Regarding the driveway and the neighbors, the appointment was never
rescheduled.  We can send a licensed and
insured asphalt paver to assess the driveway; however, we cannot be responsible
for structural defects as we were given permission.  We guess it is unclear when permission was
granted but it was granted!  The homeowner
did not offer their keys or direct us without giving us consent.   We drive over driveways every day.  Whether small or big, if it is a sinkhole
then that would be considered a structural defect.

is both shocked and disheartened to receive notice of this claim.  As our customer, [redacted], stated he
contracted us to preform tree services at his home located at [redacted]. ...

It was agreed that
work would begin on May 20th and that we would need to access the
tree from the neighbor’s driveway ([redacted]).  [redacted] stated that this should not be
a problem and that he would talk to his neighbor. 
 
When we arrived on May 20th,
there was a jeep parked in the neighbor’s driveway.  Our lead foreman, [redacted] Sylvester, asked Greg
to please call his neighbor so we could begin work.  Mr. Leovisolo complied and then told [redacted]
that the keys were in the vehicle and the neighbor gave permission for him to
move it allowing us access to the tree.   
 
About a week later our
customer requested that we remove the logs from his property and we notified
him that again we would have to gain access to 335 Quinn Street.  When we arrived the neighbor was present and
she told [redacted] “do what you have to do” and actually directed our driver down
the driveway.  
 
The job was complete, our
customer was satisfied and we were paid for our services.  Greg was very complementary and we were
pleased to add him to our list of happy customers. 
 
Sometime later, [redacted] Krooss,
the owner of 335, called our office and stated that there was a sink hole and
cracks in her driveway.  [redacted] Bellemare agreed
to meet her at her home to discuss.
 
Unfortunately our job ran
over and he was not able to make the agreed time.   He contacted Mrs. Krooss demonstrating
concern about the time and acknowledged that even without fault his hopes were for
a mutually agreeable resolution.  He
explained it is the utmost importance to not have any negativity associated
with our business name.  Feeling as if
she may have “won,” [redacted] stated, That's f[redacted] right.  I want to know when the f[redacted] someone is going to be on my [redacted] d[redacted] property" then continued ranting.  We withdrew our offer of
meeting with her as we could not have caused a sink hole and at this point we
knew she would never be satisfied.   
 
Though our hearts go out to
Greg who is trying to maintain a good neighborly like relationship, we cannot
place ourselves in a hostile environment. 
Furthermore, sinkholes are from the ground caused by debris/water/etc.
underneath construction sites/pavement, cracks are almost always present
associated with the sunken area. 
 
In closing we would like to
stress the following: Verbal consent was granted to allow us access and
a jeep was even moved out of the driveway on one occasion while we were
directed on another.  Upon completion of
the job, Greg contacted us to express total satisfaction.  We find it peculiar that the Kroosses waited approximately
a week after job was completed to express any concerns about the
driveway as [redacted] were aware and/or present each time we entered
the property.
