Review: I am filing this complaint on behalf of myself, and my father, [redacted]. Bellerose Construction did work on my father's roof on August [redacted], 2013. On December [redacted], there was a leak in the roof which resulted in damage to all 3 floors of the house. [redacted], the [redacted] of Bellerose Construction( who was paid 14,400.00 for the roof), came to see the damage. He admitted fault and sent 2 workers the next day to fix the leak. One of the workers, who did the initial work in August, exclaimed it was "the worst leak he had ever seen". Although [redacted] repaired the poor job he did, and offered to do the work to the interior of the house, we no longer had faith in his ability to do an adequate job. We asked instead if he would reimburse us for what we had to pay. At first, he seemed open to this solution, and suggested that we pay for half of the repairs, or that he would pay up to 5,000.00. We felt this was unfair, as we were not at fault in any way. He then rescinded any offers to pay and stopped answering phone calls. We wound up paying approximately 6,500.00 to repair the house. This only covers what we paid a contractor to do the basic repairs, but not for property destroyed by the leak. We did not have the floors redone, as my parents are both elderly( 89 and 92) and in failing health and leaving the house is a hardship for them. We feel that he also took advantage of my parents because of their age, knowing that my father would never be able to get on the roof and check his work. This situation has added a great deal of stress both physically and emotionally on both of my parents. I have a signed contract by [redacted], as well as 3 estimates done by contractors. We chose the contractor with the middle price for their work to be fair. These documents can be mailed if desired (I don't have a scanner). This leak caused an unsafe environment for my parents, who have mobility issues.Desired Settlement: We feel that [redacted] at the very least should pay for the 6,500.00 that my father had to pay to have the basic repairs done to the home due to his negligence and shoddy work. My parents have suffered undue stress and hardship because of this problem, and I feel that this is the least [redacted] can do. This doesn't even include the belongings and furniture damaged by this leak.

I am representing Bellerose Construction & Development, Ltd. [redacted] in matters pertaining to Complaint ID #[redacted]. I have acted as attorney in discussions and negotiations with the complainants and their attorney. I have also corresponded with their insurance adjuster in an attempt to reach a satisfactory arrangement.

The work done by my client was properly done in August to repair damage done by Tropical Storm Sandy. The repair was properly done and was fairly priced. In December severe winter weather, including an ice storm, with winds in excess of 65 mph lifted the flat roof and lead to an ice [redacted] condition on the adjoining pitched roof causing an opening. The ice was not cleaned off the pitched roof and when the ice thawed it entered the newly caused opening. The immediate and only cause of the damage was the lifting of the roof caused by the December wind and ice storm.

My client responded to calls by the Claimant and offered to repair the new damage and paint the walls and ceiling as a client accommodation because his relationship with the Claimant was pleasant and respectful. He also suggested that the Claimant make a claim through his home insurer. The Claimant indicated that he sought compensation for a number of repairs that were not caused by the December incident and predates my client's work.

My conversation with the Claimant's insurance adjuster indicated they were not covered for the damage and/or the damage was not caused by the December incident. The adjuster’s position was not completely clear but it was clear they had reached a no pay position..

I had conversations and discussions with the Claimant's attorney and again repeated my client's offer to repair the roof again and paint to ceiling and walls. She indicated that was unacceptable and that they wished nothing but money from my client. I indicated our feeling was that the work – being done solely as an accommodation - could be accomplished for a cost of $1,000. I requested estimates of what they thought needed to be done but conveyed our belief that the damage was newly caused by the December wind and ice storm and not related to the earlier repair. We also indicated that we did not accept that the bulk of the damage was caused by December incident. I was promised estimates but they were never provided. I heard nothing further from such attorney.

My client has an unblemished and pristine record for more than 20 years and has sought to satisfy this customer as a goodwill gesture. His overtures have been consistently rejected.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Dear [redacted]:

As per our phone conversation today, I am rejecting the response of Bellerose Construction and Development Ltd., ID # [redacted]. I apologize for my tardy response(family responsibilities prevented my full attention in the past month), but I firmly reject what this company has said in response to my complaint.

The work done by Bellerose Construction and Development was not done properly, and only the fact the that the weather between August [redacted], 2013 and December [redacted], 2013 had been mild with almost no precipitation prevented this leak from occurring earlier. [redacted] knew that one part of the roof was flat, and accepted the job and the $14,400 anyway, so the fact that he blames the weather speaks to his confidence in his own workmanship. Surely a flat roof which was properly installed shouldn't leak 6 months after it was done.[redacted]'s lawyer suggests that this occurred because the ice was not cleaned off the roof. My parents are both in their 90's, and are unable to do such a thing, nor should they have to if he had done the job sufficiently. I see many of our neighbors who are in the same age range and none of them have to go on their roofs to clean off the ice after a storm. The roof and the house has been fine for 100 years, and only after [redacted] did his job was the roof compromised. His own worker commented that it was "the worst leak he had ever seen" and that he tried to tell his employer that they needed to add more to make the job secure.

[redacted] did return to fix his mistake, and there were no subsequent leaks, which leads me to believe that had he done the job correctly in the first place, this would have never happened.

When [redacted] suggested that my parents get the money through the insurance company, we did contact Allstate. They sent [redacted], an adjuster, to view the damage, and he witnessed the damage first hand. However, further correspondence with Allstate made clear their position that they paid for the roof to be fixed after Hurricane Sandy, and it was the responsibility of Bellerose Construction and Development company to pay for the damage. [redacted] says that his conversation with the insurance company was unclear, but that was not my feeling at all. They were adamant that they had fulfilled their responsibility.

[redacted] did offer to fix the damage using an unlicensed handyman, and we were opposed to having anyone do work on the house who did not have a license. We got three estimates from different contractors to see how much it would cost. The prices ranged from $10,000 to $4,500, and we went with the middle contractor, whose bill came to $6,500.00. There were certainly more bills and more work needed which we decided not to do at this time, as my parents' health conditions make it difficult for them to leave the house, which they would have to do to complete certain work, such as flooring.

[redacted] refers to conversations with my lawyer. Sadly, my luck with lawyers is as bad as it was with roofers. [redacted] has not responded to any of my phone calls, so I have no idea what transpired between [redacted] and [redacted]. I had been unsuccessful in my attempts to retain her services officially, so any correspondence between the two lawyers happened unbeknownst to me.

[redacted] suggests that the work could be done for 1,000. As I stated previously, the contractor was able to do the job for $6,500. The damage was extensive and affected all three floors of the house. I can provide you with estimates if that is required. I am in the process of obtaining an attorney.

[redacted] states that his client has an unblemished history. My research with the Department of Consumer Affairs Freedom of Information Act has indicated that there was a complaint against him in 2007, but that it was resolved out of court. There was very little goodwill on the part of [redacted], whose behavior was unprofessional, aggressive, and frightening to my parents. Right now we are waiting to find out the date of the hearing at DCA.

I can't stress enough how upsetting this situation has been for my elderly parents. This has affected them emotionally and physically, and we are only asking [redacted] to pay us for the cost of his mistake. My parents should not have to assume the fiscal responsibility of the damage. He accepted a large amount of money to do this job, and we are only asking him to act in good faith. This is his chance to show that he is the man of character that [redacted] speaks of.

I have also corresponded with their insurance adjuster in an attempt to reach a satisfactory arrangement. I have also worked with your office and conveyed [redacted]’s willingness to make a financial accommodation. All such discussions have been fruitless.

I will reiterate that the work done by my client was properly done in August to repair damage done by Tropical Storm Sandy the previous fall. The repair was properly done and was fairly priced. In December severe winter weather, including an ice storm, with winds in excess of 65 mph lifted the flat roof and lead to an ice damn condition on the adjoining pitched roof causing an opening. The ice was not cleaned off the pitched roof and when the ice thawed it entered the newly caused opening. The immediate and only cause of the damage was the lifting of the roof caused by the December wind and ice storm. It was a subsequent storm.

We are mindful of the homeowners’ ages and infirmities and do not wish this to be disturbing to them – which is why my client responded immediately after the subsequent storm. We find the complainant’s devotion to her parents admirable and I certainly meant no disrespect to any party involved. However, despite the age of the homeowners, separate subsequent storm damage is simply not something for which my client can afford to accept responsibility.

My client performed in a proper workman-like manner and has accommodated the homeowners by repairing the subsequently caused storm damage free of charge. He has also offered to have a colleague perform other work free of charge and has offered to partially offset the cost of the most recent storm damage. As a responsible business person there is nothing further that can be done in the face of family members who are determined to see the home as immune from any future storms or costs.

Although [redacted]'s counselor continues to insist that the original job was done properly, I respectfully disagree with that assertion. The fact that [redacted] did come back and repair the roof is part of his contract. As I stated before, had the work been done correctly the first time, this would have been prevented. We have had no problem since the repair was made, and there were many severe storms last year. As I stated before, the workman that [redacted] was offering to do the job was a "handyman" with no license. I don't wish to be repetitive. At first, [redacted] complained about the flat roof. Now, it seems that he is complaining about the pitched roof. At any rate, [redacted]'s original work was substandard and it caused great damage to our home. I know that [redacted]'s lawyer spoke to someone who was supposed to act as my attorney. That person does not represent me, and I have not been able to contact her, so I am unsure of what transpired between the two attorneys. I am in the process of obtaining a legal representative. The amount that [redacted]'s attorney offered to pay for the repairs was approximately $6,000 less than my parents were forced to pay. This is unfair and frankly, insulting. I am hoping there is a way to solve this that will satisfy both parties, but this is not it.
