The person in this case has a complaint against another homeowner regarding a fence that was built which was not approved The restrictions were created back in We were contacted by a group in the subdivision after the fence was installed The person who installed the fence is the 3rd owner of the home and refused to acknowledge the restrictions We provided copies of the restrictions and asked that we get a written complaint before we move forward After finally receiving a written complaint we hired an attorney for council and drafted letters to the homeowner who refused to remove the fence We also kept the existing homeowners in the loop on that process We also researched what involvement the Town would have in this and they do not have any jurisdiction over the matter We have not charged the homeowners of the development anything for the legals costs The homeowners group do not pay any association fees so there is no money available to take legal action against the homeowner The homeowners were advised that they can take up the case on their own against the homeowner with the fence at their own expense Our attorney advised us that this is a no win situation The developer, [redacted] is not going to pursue action on it as there is no property left to sell in the community and it is a no win situation Email communications were sent to representatives from the development on 9/27/at 11:am, 9/27/at 3:pm, 10/2/at 4/pm, 10/3/at 4:pm, 10/9/at 8:am, 10/30/at 4:pm We received no communications over the holidays from any party The latest communication was delayed to the homeowners at I was at a conference in Florida for the the last week An email came in on Friday the 12th and I responded to the email on Tuesday the 16th at 8:am when I was back in the office I also had an out of office message on my answering machine Proof of communication is attached I responded to the email on the 16th at 8:am when I was back that it is the developer's decision not to pursue action at this time and again the homeowners in the development can take action against the person who put the fence up At this point no further action will be taken on behalf of the developer and it is in the hands of the homeowners We respectfully ask that is complaint be closed
