On the purchase order, *** Irrigation offers a 2-year warranty on material and workmanship defects. It was discovered that the irrigation system they installed had been leaking 24 hours a day since they installed system, thus resulting in higher water/sewer bill.
When I contacted them asking for a refund due to defect in workmanship and materials, they said the warranty was null and void since they didn't turn off and turn on the irrigation. No where on the Purchase Order does it state this requirement with regards to their 2-year warranty.
Find this to be a highly unethical practice.
Mr. decided after we installed his Irrigation System to have someone else maintain and service his system. As that makes our Purchase Order null and void. If his system has been leaking since the installation, and as stated in a email gushing water for 24 hours since the installation, there would have been a very visible wet spot, especially when mowing the lawn. Also, his water bill for 2017 would of been high also, and we were never contacted until October 31, 2018.

You had another vendor maintain and service your system, which makes your contract null and void. How do I know that the Vendor you used did not do something to the system or not. If we were maintaining the system, then we would of noticed the leak in your pipe, especially during your first turn off in the year of 2017, as the air from the compressor would of showed that there was a leak in line, as it would of had water shooting up and a hissing sound as the air was going through.

Again, *** Irrigation should have stated this so-called null and void addendum to the warranty listed on the purchase order rather changing it at will. The front and side irrigation was already in place by the new construction builders. The leak is at the connection between that system and the one *** Irrigation put in.
*** Irrigation was the last vendor to touch that location and actual system.
Own up to the defect, issue a refund and let's move on.
