I believe [redacted] is the [redacted] of [redacted] restaurant chain, I also believe he was acting on behalf of the [redacted] or [redacted] of that chain, [redacted]   Chain of events.   Somewhere around the 12/*/2011 [redacted] executed an agreement...

with [redacted]y, a [redacted] owned company and the 2nd largest merchant processing company in the United States.   Benchmark was the sales agent on the agreement.   The merchant stated they canceled the merchant agreement within the time period required by the executed merchant agreement.   The merchant bank stated the merchant did not follow the agreed covenants of the executed contract and the merchant did not cancel the agreement within the correct time period required and thus assessed an early termination fee.   Benchmark did not issue the early termination fee and were are a third party to the transaction.   The merchant is not clear on our role in the transaction, we have worked tirelessly to explain, but the merchant had zero interest in our position.   The merchant threaten legal action and to avoid a lengthy no win legal battle. we agreed to give the merchant a 50% settlement on the funds he was assessed by the merchant bank.   In our eight years of operation we have had one complaint, We manage 2500 merchants through our relationships with our sponsor banks.. no issues and business has prospered on every level of operations.   Attached is the agreement the merchant executed, please note [redacted] is not the signer.   I hope this addresses the issue at hand   Regards  [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.

Review: My company did business with benchmark payment networks for 2 years and 10 months. After about 1 year, I started seeing random charges on my bill, not to mention they were charging me to be [redacted] compliant even though I already was through a third party managed firewall. I complained over and over again about the bogus charges and the [redacted] compliance fees. They did nothing about it. Finally, I decided to stop doing business with them. I switched to [redacted] which I am very happy with so far. My minimum charges per month per store per our contract was $20 per month, so even though I believe that benchmark payment networks is a shady company that makes their money by tacking on random fees hoping you won't notice, I would have accepted a $40 charge per bar totaling $440 (11 bars) to switch to a new provider as I had two months remaining on our contract. Benchmark Payment networks charged my company $395 per store ($4345)when we ended our relationship which does not match the $20 per month minimum charge. I have contacted benchmark payment networks multiple times over the last 6 months, and they continually promised they were working on a solution, but clearly, they have not done anything. I plan to contact my bank and possibly sue BPN soon, but I thought I would file with the Revdex.com first to see if BPN may finally resolve the issue.Desired Settlement: I am looking for a refund of at minimum $3905 due to the contract stating minimum charges of $20 per month, but I would prefer a refund of all cancel fees due to the failure of BPN to fix multiple issues with fees and [redacted] compliance during the time we did business.
