NOVEMBER 8, [redacted] Dispute Resolution Specialist Jefferson St NE Suite A, Albuquerque NM Ms [redacted] , This is in response to customer complaint ID [redacted] [redacted] did have a transmission service performed on his Jeep Patriot at Bender Chrysler Dodge Jeep Ram on 7/15/On this visit, he also had the cooling system flushed and a front suspension noise addressedAt that time, the vehicle had miles on the odometerAfter that visit, Mr [redacted] had this vehicle serviced at our facility three more times: • On 9/09/2016, an oil change service and a visual inspection was performedNo problems were found by the technician and Mr [redacted] had no transmission related complaints• On 12/20/2016, an airbag lamp concern was repaired and a visual inspection was performedNo problems were found and Mr [redacted] had no transmission related complaints• On 01/02/Mr [redacted] had his rear brake shoes and drums replacedHe provided the partsA visual inspection was also performedNo problem was found and Mr [redacted] had no transmission related complaintsOur parts department measures out the proper amount of fluid, per factory specification, before giving it to our technician, when doing this type of serviceThe technician then checks that the proper amount is in the transmission before test driving the vehicleThen as a third precaution, our technician then checks the fluid level again, after the test drive, to make sure that level is still correctI find it very unlikely that Mr***'s transmission was overfilled when it was returned to himIt is more plausible that when the transmission started to make noise, that Mr***'s daughter or someone else, added fluid to the transmission in the hope that the noise would go awayOf course, there is no way to be sure of thisMr***'s Patriot is ten years old and has over 100k milesThe fact is that vehicles, over time and use, become less reliable and mechanical failures are going to happenWhile performing a transmission service is good preventative maintenance, it in no way guarantees against future failuresWhile we sympathize with Mr***'s situation, we do not feel responsible for his transmission failureIf there had been an error on our behalf, we think it would have been evident during the following six months while Mr [redacted] still had possession of the vehicle, and he would have brought it to our attention during that time.Warm Regards,Darryle B***BENDER DEALER GROUP

7/15/2016. On this visit, he also had the cooling system flushed and a front suspension noise addressed. At that time, the vehicle had 105467 miles on the odometer. After that visit, Mr. [redacted] had this vehicle serviced at our facility three more times: • On 9/09/2016, an oil change service and a visual inspection was performed. No problems were found by the technician and Mr. [redacted] had no transmission related complaints. • On 12/20/2016, an airbag lamp concern was repaired and a visual inspection was performed. No problems were found and Mr. [redacted] had no transmission related complaints. • On 01/02/2017 Mr. [redacted] had his rear brake shoes and drums replaced. He provided the parts. A visual inspection was also performed. No problem was found and Mr. [redacted] had no transmission related complaints. Our parts department measures out the proper amount of fluid, per factory specification, before giving it to our technician, when doing this type of service.
