EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">401(k) Plan.  Under the terms of that Plan, [redacted] was not eligible to receive a hardship distribution.  Subsequent to this finding, there was then a discussion between [redacted] and his employer, [redacted] regarding terminating his employement, to allow him access to his 401(k) account.  Both [redacted] and his employer mutually decided it was not in their best interest to terminate his employment.  At this point, [redacted] has decided not to pursue a hardship withdrawal from the Plan.
The above information is a summary of an e-mail [redacted], our employee, received from [redacted] on March 12, 2014.  A copy of the e-mail is below.
At this point, since [redacted] (and the plan sponsor) are not pursuing a withdrawal, we ask that this case be closed, with Benetrends being cleared of any wrong doing.
Please make me aware of this case's resolution.

Dan,
Brett Rogers and I talked today.  We decide to not
terminate his employment at this point, so they will not be pursuing the
hardship withdrawal. To terminate him as we deal with Washington State Labor
and Industries and his injury, it could cause issues for him and me.
