Benge Landscape

Review: In April of this year, our household entered into an agreement with Benge Lanscaping to design and install landscaping in our back yard. This was done and, as the work was satisfactory, about two months later we contracted with him to design and install landscaping in our front yard. We were told at the time that all of the plantings carried a one-year guarantee to grow or they would be replaced by the contractor. After about a month, one of the sky pencil plants in the front garden turned brown and died. The other is fine. The other plantings in the front yard also appear to be growing. This sky pencil, however, did not. On August 11th of this year, I called the owner, [redacted], on his cell phone, [redacted], and spoke to him about replacing the sky pencil. He said that he would try to have it done that week as I was expecting guests later in the week. I also wanted him to come over and check about some of the plants in the back yard that appear to be not growing much at all. For this he indicated that he was busy at the time and would not be able to meet with me personally until about two weeks later. Well, three weeks or more passed and I never heard from him nor had the sky pencil been replaced. I have tried day after day since then to call his cell or the office number at [redacted] and have gotten no response except a recorded answering message. For two weeks I have called and gotten the same. I decided today September 16, 2014 to call him from another number to test if my calls from my cell phone were deliberately not being answered. This time [redacted] answered right away. However, when he heard my voice, he hung up right away. Now I know he was deliberately ignoring my calls. He has still to replace my sky pencil and has six more months of plant warrantee service left on my agreement. Some of my plants in the rear may not live the year I suspect and I will need them replaced.Desired Settlement: I need my sky pencil plant replaced and for the owner to honor to rest of his one-year guarantee and replace any plants that are not growing properly or are dying. I have spent thousands of dollars with this landscaper and I should not be treated this way or have my called blocked or ignored.
