Have a hard time believing this is a legitimate business
This is a company that blatantly violates the Telephone Consumer Protection Act through ROBO Calls spamming emails with threats of lawsuits via voicemail. They provide their clients their "Contract", which is actually only a statement of understanding or a Account release form, which is both ambiguous and does not specifically state the account they are trying to collect from. It's a blanket form used to trap clients to paying them a fee if "They" feel they have fulfilled their services. The client rates on their Account release form only covers accounts that are past due for up to a year. Here is a list of conduct that they practice which are violations of the Fair Debt Collection Practices Act: Frequent and repeated phone calls during the same day, Collection calls to family or employers, Improper threats of wage garnishment or lawsuits, False statements about a debt. If you don't want your business to be associated with debt, Mobster-like threatening phone calls with everything short of threatening to break your legs, do not use this company. There are several collection companies out there that are not clouded with emotion and anger and manage their documentation in a more efficient manor and can even purchase your debt prior to attempting to collect the debt from the consumer. I'm currently waiting on them to file a lawsuit on me for services they did not provide. I'm asking that they please stop all communication on our business line and address regarding this false debt and record that I dispute having any obligation for this debt. If they feel they need to respond to this review, please provide a verification letter of the debt, Debt Collection Agency License from the CSA and the index numbers from the courts for any action taken on our business, any of my clients.

Terrible experience-we placed 10-15 accounts with Benjamin & Williams and they failed to collect a single penny in a year. It's worth noting that their fee percentage increases the older the account gets, so it's in their best interest to wait until the account ages a year or two to increase their cut. Also, their are WAY too lax with debtors. They may tell you they have a promise to pay by a debtor but fail to provide a time frame, amounts, payment schedule, etc. By far the worst collection agency I've ever done business with.

Review: 5:30 pm on 10-**-13, after my business was closed down, I received a phone call on my answering machine stating that Benjamin and Williams Debt Collection was calling and wanted me to call them at ###-###-####. I've been in business for 16 years and have paid every bill promptly, so I was quite upset that they were contacting me about a debt that I owed. It made sleep last night difficult, wondering what may be coming my way when I called this debt collector. When calling them this morning, all they wanted was to solicit my business. This is highly unethical, as they should have left a message stating that this was not about a debt, but only to solicit business. They need to stop this behavior because of the stress this puts one through, plus using the term "debt collector" forced me call them the next day, only to get a sales pitch. I need the Revdex.com to ask them to halt this unethical behavior immediately.Desired Settlement: I need the Revdex.com to require Benjamin and Williams to halt their unethical telephone sales solicitation behavior immediately and also want an apology from them for the unnecessary stress that they put me through.

Response:

In reference to the file below [redacted]: Every message we leave on a sales call states that it is in reference to collecting their past due accounts and specifically states that we are calling to do business with that company.

We are very sorry if there was any misunderstanding

Thank you for your consideration

Benjamin and Williams

Thank you,

Consumer

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Benjamin and Williams is lying in their response to my complaint, as they never mentioned that the call was a business solicitation. Here is the exact transcribed message left on my business phone line, which I have archived and can play back for anyone interested in hearing it:

"Hi I'm trying to reach [redacted] or [redacted] at the company - I'm with Benjamin and Williams debt collectors - please call me back - my number is ###-###-#### - that's ###-###-####."

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Sincerely,

Business

Response:

This was a sales call to the [redacted] or owner seeking business. We will make sure we are more specific when making sales calls.
