Review: went to Bennies homes to buy a house I talk to a sales rep. my wife and I told him we wanted to buy a house with the square footage of 1500 or more we were not interested in a house smaller than that. The salesperson gave us the keys. We look at the houses. We found a house we like he showed us the floor plans 1560 square feet and he price it fore $114000. We talk the bank and they told us depending on what then appraise for would determine want we needed to put down. The banker told us to get The salesman to work up a contract. Once again we told him we did not want a small house and the house he show us in his pamphlet was a 1560 square foot house. Price at $114000 . He ask for money to be put down before he could do floor plan I gave him $500. He sent the contract to the banker. Then we find out he sent the wrong contract and he admitted he miss up and quoted the wrong house so He re quoted the house for $117000 than told us he had everything approve by the owner. We re did the contract he said he would send it to the bank everything came back good so we thought. while signing the contract with the bank we notice that the square footage of the house was wrong. So we ask the bank if they made a mistake and they show us the floor plans that they were sent. It was for a house with only 1300 square feet. I than ask the sale rep what was going on. he said he the bank was looking at the old contract and he get it straight . My wife and I Kept up with him and the bank. He came to the conclution the he made the mistake and he would fix it. A week later he said he got the problem fix but his boss said he had to raise to the price of the house to $122000 because it was a bigger house. I reminded him that we had already agreed on the price of the house it was $117000 for 1560 square feet. That when he told me I sign a contract for the other house I told him there was no square footage on the contract. he show me that floor plane number on the contract and that was the square footage the house. I told him that their is no way anyone who is not in the business would know that. He took advange of me because I did not the area formula to know that he was selling me a 1300 square foot house. SO I ask for my deposite back and he refuse and tried to argue with me he acted like I was .in the wrong. He tried to pass off a 1300square foot as if it was a 1560 square foot house and would have gotten away with it if not for the bank contract showing to total square footage of the house.Desired Settlement: I want my $500 deposit back as well as my $450 back I had to pay to the bank to appraise the blue prints of the wrong house they sent to the bank. I would also like to see their paper work change so the next guy that come in can see the actual square footage of the house and not the just the diminution so that they can't get trick like they tried to do me

He had

come in interested in a home, had a very complicated situation because he

needed a home demolished and still owed quite a bit of money on the site and

current house.. We talked about possibilities and his financing situation.

The salesperson gave us the keys. We look at the houses. We found

a house we like he showed us the floor plans 1560 square feet and he price it

fore $114000.

Bennies:

The

floorplan we showed him was in three different sizes. 25 x 52, 28 x 52, and 30

x 52. We had quoted him the first one (25 x 52) so that we can get it to fit in

his price range. He signed this contract for a (25 x 52) with that price.

We talk the bank and they told us depending on what then appraise

for would determine want we needed to put down. The banker told us to get The

salesman to work up a contract.

Bennies:

We talked

with the appraiser and he indicated the 25x52 house would not appraise for

enough to cover the existing loan and the new house. We then supplied the plans

and specs for a 28x52 and a contract for the 28x52 house and did not add any

additional cost to help our client get a new home. The appraisal came in for

enough money to get the loan for the new house including the $46,000 existing

loan payoff for his land and existing house.

Once again we told him we did not want a small house and the house

he show us in his pamphlet was a 1560 square foot house. Price at $114000 .

Bennies:

$114,000

is for the house and did not include the demolition of the existing house. We

supplied a quote for both the 25x52 and the 28x52 house at the same price

including demolition of $117,000. 28x52

= 1456 sqft.

We then

supply a quote for the 30x52 (1560 sqft) version of the house $122,000.

Including demolishing.

He ask for money to be put down before he could do floor plan I

gave him $500.

Bennies:

It is a

requirement that before we perform a site visits, get a factory quote,

communicate between the appraisers and lender, and that we receive $500 deposit

to cover hard cost as we start to work on the project. That deposit is applied

to the contract and covers the cost of work performed including the site visit.

Because of the complications of demolish, other existing building and setbacks

we performed 2 site visits to make sure everything would work for our client.

He sent the contract to the banker. Then we find out he sent the

wrong contract and he admitted he miss up and quoted the wrong house so He re

quoted the house for $117000 than told us he had everything approve by the

owner. We re did the contract he said he would send it to the bank everything

came back good so we thought.

agreed to upgrade the home to a 28 x 52 home at no charge. So the home came in

at around 1460 square feet. This concession was made to enable the appraisal to

work.

while signing the contract with the bank we notice that the square

1300 square feet. I than ask the sale rep what was going on. he said he the

requested, we did provide our client with a 30x52 version of the house at 1560 sqft

in hopes to give him an amazing deal, and have a satisfied customer. We did

expect that it might not fit his budget as planned.

While we

attempt to teach are client about many things related to construction of a new

house, we cannot teach them everything. We show them houses, we explain

options, we attempt to envision furniture placement, we help pick colors, we

explain how loans work, we attempt to help in every way we can.

In this

case, our client says he told us that he could only have a 1500 sqft house but

then says he doesn’t know what a 1500 sqft house is.

Our goal

was to help our client get a floorplan he liked, fit it in his budget and get

the loan to work for him. We sold him a 25x52 house. There was an issue with

appraisal so we gave him the bigger house at no additional charge. The client

was happy with the floorplan, and the lender was happy with the appraisal and

approved the client’s loan.

There is

nothing else we could have done differently for this client at this point. We

had sold him a house, clearly defining the dimensions of it. We had upgraded its

size to enable him to get the loan he needed. We evaluated his site with 2

visits.

Our client

was interested in a specific floorplan and would like to have it around 1500

square feet. We told him that we could fit it into his price range as a 25

width by 52 length. He liked the floorplan, signed the above contract and as he

continued into his loan process. We later increased the floorplan size 156 sqft

to make the appraisal work so he could pay off his existing mortgage with

minimum out of pocket cash at no additional cost.

He agreed

to the above signed contract and gave us a deposits for his site visit to be

performed. We had invested months of time, effort, and resources to make his

project work because no other builder had the ability to make it work as affordable

as we could.

Again, our

client says he told us that he could only have a 1500 sqft house but then says

he doesn’t know what a 1500 sqft house is.

We believe the real issue is that the client may have need to come up

with some cash for closing cost.

Our goal

is to help our clients in any way we can. Sometimes we can’t do enough.
