Bensway Lawn & Tree Care Reviews (9)

Review: We had a service person show up at both our rental house and our personal residence without a phone call or any other contact. They claimed that they did a blow out on our sprinkler system. We were home and they never knocked on the door. They hung a bill on our door knob. When I called them they said they sent us a notice that they were going to do this in January. We never saw any notice. They now request that we pay the bills ($90.00) when we did not want the service. Doing the complete service as presented on thier bill would require them access to our garage, it did not happen. I do not feel that this is either ethical or legal or professional.Desired Settlement: Send me a statement that says I do not owe for a service that was not requested.

Response:

[redacted], In regards to the attached complaint above………………….. For both of the customers locations, they were sent monthly mailings alerting them to the schedule services per existing agreement which is based on past service history. Customer never contacted our company to discuss changing or cancelling services. Services provided were done so according to professional standards and by certified technicians. I would always welcome the opportunity to have a discussion with the customer regarding the services and amounts owing. However, I do request that the customer treats our staff members fairly and does not act belligerent or rude as they have already exemplified earlier today. Both accounts are permanently closed with amounts owing. None of the required reports to be submitted to water company will be sent by our company until paid in full. Thanks!

Review: We did not authorize our lawn to be sprayed for crab grass, and Bestway Lawn and Tree sprayed it anyway and sent us the bill. This is the second time I have caught them providing a service we did not authorize. Bestway Lawn and Tree claims they sent out a letter in January, which WE NEVER SAW, that contained our contract for 2013. I am sure I threw the letter away thinking it was junk mail. Even though they say it was in their usually billing envelope, who expects a lawn bill in January? So thinking it was an advertisement, I tossed it. Now they are showing up at my door saying "it is in the contract". Apparently by not responding, I gave them my permission to do whatever they choose and we are supposed to pay for it! WHO DOES BUSINESS LIKE THIS??? I would like to see any other contractor get away with this. The only thing I have EVER approved Bestway Lawn and Tree to provide is 2 sprayings for Necrotic ring per year. To date, they have sprayed for crabgrass and aerated last year and tried to aerate this year--WITHOUT AUTHORIZATION. To their credit, when we protested the aeration last year, they reversed the charge, but THIS COMPANY IS DRIVING US CRAZY. If they do not reverse this charge, we are planning on taking it to the Small Claims Court. This underhanded way of expanding their business volume just is not right.Desired Settlement: I want the bill for the crabgrass spraying to be reversed.

Response:

Hi [redacted], In response to the above complaint…………….. The service provided for the [redacted]s yesterday was the first of two annual applications for Necrotic Ring. As stated in their letter, they are willing to receive and pay for this service along with the second NRS application. Earlier in the year we did have a scheduling mistake and provided the [redacted]s a pre emergent lawn application. We did not charge for this application per the [redacted]s notification of our error. It appears we are currently operating within the [redacted]s requests of receiving the two annual applications for Necrotic Ring. This will also be the only amounts they will owe for this year. Let me know if I can be of further assistance. Thanks!

I have reviewed the response made by the business in reference to complaint ID 9577666, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Bestway Lawn and Tree says I

was not charged. However, I have attached

the second bill I received from them for

an application I did not request or authorize. I wrote right on the first bill that I would not pay

it and sent it back to them without making a copy. You will

notice the date on this invoice is 5/7/13 and that the bill is 31-60 days

overdue. This bill obviously is not for the authorized service they rendered on

June 10th, so you see, I am

being billed for a service I did not authorize.

Another complaint I have

of this company is that they do not put the service they

performed on the service notification

they put on my doorstep. Neither do

they put it on the

invoice, so unless you call and ask,

there is no way to know what

they did. I think they do this counting on

the fact that most people

won't check on them. They will just

pay the bill.

I want this

company to tell me they

have reversed the charge of $97.82 from

my account, since their

statement: "Earlier

in the year we did

have a scheduling

mistake and

provided the Reeds

a pre emergent

lawn application.

We did not charge

for this

application per

the Reeds

notification of

our error." is

obviously not

true.

Thank

you for help

in resolving

this.

Regards,

Business

Response:

Hi [redacted], The statement which the customer presented is an old statement not showing the credit for the disputed April service which was our scheduling error. Only amount now owing is for the first of two NRS treatments which the customer has agreed to receive and reimburse us for. Yes, all of our receipt tickets left at the door specify customer information, date, time, wind, direction, and service information, plus special offers. Thanks again for your assistance in this matter.

I have reviewed the response made by the business in reference to complaint ID 9577666, and find that this resolution is satisfactory to me. I am satisfied that I will no longer be held responsible for this charge, but I still feel the company is fudging the facts regarding their MO of providing unauthorized services and then billing and re-billing the customer even though the customer disputes the charge.

Regards,

Review: 1. we were billed $347 including 5 sprays and 1 aereaton in January of 2013.

2.1 called them to correct and delete the unwanted aereation . The new price was to be 295 with the aereation deleted.

3. On 1-15-13 our visa card was billed $295.

4. A first spray was done in march and they billed us for the spray even though we had prepaid for the whole year. We called and they removed the billing.

5. Then in May an aeration was done. On May 5 the company called and left a message on our answering machine that a aeration would be done on the next day. We were gone until 9:00 that nite and didn’t get the message until then. Early the next morning (7:30) I looked out and saw that our yard was being aereated . I went out and told the operator that we had not purchased an aereation. He disagreed and said that we had purchased 5 aereations for the year. I said that I didn’t think so but he continued.

6. Following this I got a bill on our visa for a spray and an aereation. Having prepaid for all but the aereation we went to their office and explained they were NOT to use our visa after the initial billing in January. Also we had prepaid the bill in January and the aereation should not have been billed. The man we spoke with agreed and said he would remove the visa charges.

7. Instead of doing that we received a refund check for $295. (the entire prepayment). When I called and asked why they said that they could not refund a visa payment??

I then said that the spray charge could remain on the visa but the billed amount of 76.09 for aeration must be removed, as I had declined the aeration. Then I was informed that I owed for 1 more spray. I did receive one more spray but said I wouldn’t pay till the aeration charge was removed. Chris the bookkeeper said I would have to pay the aeration bill as I was called the day before and could have stopped it. I explained why not and that it was impossible to reach them at 9:00 PM. Also the aeration operator was adamant. I then told Chris that I would not pay more until they adjusted the bill for the second spray and deleted the aeration charge. She explained she would not, called me some names and told me not to call again.

My complaint is that they hold fast and are trying to bill me for a service I didn’t order or want. They continue to bill me adding interest with each billing. While I owe for one spray of 54.35, they owe me for the charge for the unwanted aeration of 76.09. Desired Settlement: The resolution is as stated above - delete the aeration charge, charge for one more spray and send me the difference in a refund

We had a spider problem a few years ago, and hired Bestway to do an external foundation spray. The spray worked, and the work was satisfactory, but the next spring we received a prepay offer indicating that we were now scheduled for 7 spider sprays, based on our service the previous year. We called, and told them that we never had 7 sprays, and in fact that we didn't want ANY sprays for the coming year. Despite that, we had to stop a technician who came out and was about to spray! Even more amazing, this spring we received ANOTHER prepay offer with the same 7 spider sprays listed! So far, I've not been charged for work we didn't want, but if I wasn't really paying attention to the mailings, I know I would have had a problem. Be very careful with this company.

Review: We purchased Bestway lawn care service on our credit card for the 2013 season. At the beginning of 2014 we started recieving advertisements for the same services for the 2014 season. We decided not to purchase the lawn care service for the 2014 season. However, Bestway came and weed sprayed our yard without notifying us or getting our authorization and billed us for $54.35. I called to inform them that we did not want their service and they informed me they automatically continued their service for our convenience and that they stated this on the 2014 bill they sent me. This continuing service was never mentioned in 2013 and is not stated on any of their advertisements. Now we have received a second billing with a $3.00 service charge. We have no intention of paying for a service we never ordered.Desired Settlement: Cancel the non ordered service and unwarranted charges.

Response:

HI [redacted]

Thanks for the heads up regarding the [redacted] residence and their service. Upon the [redacted]’s first call to our off on 6/2/14, we did close their account per their request. Credit adjustments to take a couple days to post and such adjustments have been completed leaving the [redacted]’s account with a zero balance owing and account closed. We welcome them as customers again in the future.

I do take issue with the incorrect statements regarding our advertising and the way in which we conduct our business. We make every effort to inform each of our customers and their services. At anytime, we welcome their inquires.

I really wish the Revdex.com would support local businesses by pushing back on incorrect statements. I invite the Revdex.com at anytime to visit our office and meet with me in person to review our procedures, etc.

Have a great day!

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me.

Regards,

I would like to thank Bestway for their crediting my account. For years Bestway has done a wonderful job servicing our yard and if we could afford their

service (yearly package deals only) we would still be using them. I would still recommend they contact their customers to confirm they want Bestway's

service rather than use their billing motto "For your convience, sevice continues from season to season". I would ask Revdex.com not to use this as a negative

rating against Bestway.

Thank you.

Review: While we were away from home, Bestway completed a lawn spraying we did not order. When I contacted them they told me they sent me a list of services they have provided me over the years (although last year I had them do one and only one spraying) I was told I must cancel their services or everything they have ever done for me will continue FOREVER. That was not my understanding..I did not sign a lifetime contract....just because I have had them do a service in the past, doesn't mean I was married to them for the rest of my life and in fact I did not sign a contract. This is an awful deceptive way of doing business. I have asked them to take me off their database. I refuse to pay for the service not ordered and I challenge Bestway to provide a signed contract for this service in 2013.In addition this letter is to warn others of Bestway's deceptive practices and to have a record of my request for a permanent removal from their database.Desired Settlement: I refuse to pay for the spraying on 5/02/13. I did not order this service and I did not sign a contract to have this service provided.

Response:

[redacted], In response the above reference complaint……………. I am very sorry Mrs. [redacted] feels the way in which she does. It is not our practice to be deceptive in any manner and all customers are provided with complete information at each service visit, through regular mailings, and again at annual prepayment time. Without digging into our old paper records, Mrs. [redacted] has been receiving the same services for well over a decade if not closer to two. The same service has been provided annually almost to the very day and definitely the same week. Only in recent years have we had to establish contracts. Long term customers, like Mrs. [redacted], have always operated on a ‘gentlemen’s agreement’; when either party needed to change something they simply informed the other party of such. We never were informed of her request this year. Mrs. [redacted] information is required to be kept on file per state law since we made a pesticide application to her residence. We have closed here account per her request. I would be happy to discuss this matter with Mrs. [redacted] directly and maybe we can reach a common ground. Thanks again for your time in handling this complaint.

I have reviewed the response made by the business in reference to complaint ID 9559954, and have determined that this does not resolve my complaint.

Review: Last fall we asked Bestway to do fall lawn and tree/shrub spray as they had a package deal..3 treatments for ~$200. That went great. (no contract was signed)Upon returning from vacation in March 2013 there was a bill for lawn and tree/shrub treatment done while we were away. The bill was for $74.54..there was a notation that ~$76 had already been paid. I assumed this was from leftover payment in the fall. What I found out later was they had billed my credit card for $76 and sent me a bill for an additional ~$75 (total $150). 1st..I did not authorize these services and when I called them, the office staff told me we were on a continuing contract since we had received services in the fall. That they had sent out a contract in January telling us what they had planned to do this year, and that by not contacting them, we had agreed to their services. I had NOT received such contract, and have asked that they send me a copy (still have not received that) In fact, the office staff accused me of "losing my mail" since I had been on a recent vacation and that's why I didn't get the contract..2nd..they billed my credit card without authorization..obviously they kept my number from last fall. So now I have to cancel my card so they can't use it any more.3rd...since they did the service, before I realized they had also billed my credit card I sent them a check for the remaining $75, which they cashed on 4/9/2013. Then, on 4/12 they sent me another bill saying I still owe $74.54.At no time, have they called to discuss this with me despite my calls on at least 3 occasions.Desired Settlement: I want my money back. But, mostly, I want others to know of their underhanded business practices and to not use them.

Response:

Hi [redacted],

In response to the complaint reference above……………. Mrs. [redacted] did request to stop her yard care services on 4/2/13 per our account records and her account is currently closed. We did receive her check on 4/9/13 for the balance due for her two applications. I apologize for any communication breakdown or misunderstanding now or at the time when the [redacted]’s started services in September 2012. Thanks!

Business

Response:

Hi [redacted], I response to the customer’s response…… I am more than happy to assist the customer directly, but the Revdex.com forum is not the place and is time consuming for all parties involved. I really wish she would have opted to speak with myself, thus most likely reaching a applicable solution quickly. Very difficult trying to work with consumers whom would rather put effort into trying to breakdown reputable companies and speak of untruths. I already stated there was most likely a misunderstanding in the communication process of which we take responsibility for what we have control over. I still also question why the customer paid her balance after closing her account (for services she mentioned she did not order). Thanks!

Regards,

Please understand, I DID try to resolve issue with the company. They have NOT returned 3 phone calls. I also paid what I thought was a fair price for the treatment, not knowing they had billed my credit card without my authoriazation. If this company had called me and settled this when I first callled them, they likely would have a new cutomer instead of having to deal with complaints. It's too bad, the actual work they did was fine.

Review: On 3/19/13 a service person fertilized my yard, applied shrub bed weed care, and spider / bug repellent. A bill for $218.46 was left on my front door. I did not request, nor want, Bestway to provide this service. I called the office to register a complaint and was told it is a "courtesy" to contact them and tell them NOT to apply the service. I did not live in the house for over a year, but moved back in last fall after a divorce settlement. I had no idea Bestway expected a "courtesy" call from me.Desired Settlement: I expect to have the charges removed from my statement and my account closed.

Response:

Hi [redacted] In response to the above referenced complaint……………………&hellip... Mr. [redacted] has been receiving the same services at his residence since March 2008. Having received services for now over 5 years, Mr. [redacted] is well accustom to our renewal policies and the services he received annually. We also provide each customer several informative mailings annually, in addition to information at time of performed services. Mrs. [redacted] called this past February requesting to keep services as before and remove her name from account since she was moving out. As a company, we feel we have done our part in making Mr. [redacted] aware of his scheduled services. Our operations have remained consistent and no changes on our end while servicing this customer for over 5 years. Our company cannot be held responsible for someone wishing to change services without contacting us first. Mr. [redacted]’s account has been closed and has a balance owing for services of $218.46. Balance is PAST DUE and will proceed to collections on May 10th unless we receive payment in full. Thanks again for your understanding. Your Yard is My Passion! [redacted], M.B.A.President[redacted]

I was not aware of the automatic renewal each year. My ex-wife managed our household finances and as such managed the relationship with this service provider. Was a contract signed agreeing to the automatic yearly renewal?

Hi [redacted] As a company, we cannot be held responsible for how a household handles its finances or obligations entered into. Again, Mr. [redacted] was well aware of receiving services for over 5 years. In good faith for Mr. [redacted], I would be willing to accept $165 towards his account to satisfy his obligations. This payment must be received by our office no later than May 3rd. Thanks again for your assistance with this matter. Your Yard is My Passion! [redacted], M.B.A.

Regards,

The question asked on my previous email was not answered. Please allow me to ask again. Was a contract signed agreeing to the automatic yearly renewal? I will also point out that my divorce was finalized (and filed) last August. My ex wife had not legal right to commit me to an agreemtent with Bestway this past February.
