Hi, There have been some challenges with this property and we have been attempting to rectify in a timely fashion, but some problems have lingered longer than our typical turn around due to their complicated nature Attached are invoices from repairs completed As the stove invoice
indicates Top Properties was informed that it was in working condition as the malfunctioning part was replaced We do have the second control board on order from the supplier to repair as well and will be repaired as soon as delivered Also on order are the correct knobs for the range for the temperature control, the set originally ordered did not fit correctly and replacement set was ordered Microwave was brought to our attention more recently, owner of property has new microwave on order from *** As the appliances in this property of a nicer variety, it was decided to repair vs replace and repairs turned out more complicated than anticipated due to the specialty appliances Top Properties and the owners of the Property are dedicated to have these issues rectified and apologize for any delay in service Thanks, *** ***

The complaint in question is the third attempt from the tenants to break the lease because they were not let out of their other lease in the property they were currently occupying The original reason they did not want to take possession was due to their current landlord not letting them out
of the lease on their current property This was followed by a complaint that the property was not ready for them to occupy as of the start of the lease because our carpet cleaner was running one hour behind Both these situations are clearly outlined to the lease as how they are to be handled This third attempt to break for these reasons we believe to be an last recourse to not forfeit their security deposit We have ask the tenants to provide evidence that the property is not habitable and have granted them access to perform a mold test to justify their claim They have not provided any of the items we required and have advised them to refer to the lease as how the security deposit will be handled We have also informed them that as soon as the property is released we would be able to refund them for any days the property was occupied as to try to help avoid unnecessary charges and promptly relisted the property for rent We now have the property leased out, unfortunately for these tenants the property was leased out as of July and their Security Deposit will be used for the months rent that the property remained vacant We require tenants put down a security deposit to avoid these situations and to commit them to the property We believe this not to be an appropriate complaint rather a discrepancy in the agreement that all of the prospective tenants signed and agreed to a would ask that the complaint be thrown out as it is less a matter of a Revdex.com complaint and more a matter of legality of their lease claims and believe there are better venues to conduct such disputes We do understand that is a tough situation and do not wish to cause any harm, only to ensure that our client the Landlord is properly protected from such claims I am available for comment at any time

I am rejecting this response because: Top properties has responded with untrue statements as well as made no effort to commence a lease on June 1, Possession of the residence was never delivered due to inhabitable conditionsRusty and moldy bathroom fixtures, broken blinds, missing grout, and insect remains were primary issuesTop properties made no attempt to remedy these condition or provide possession of the residenceI gave a $deposit to ensure a habitable residence would be turned over to me June 1st, Top properties made no attempt to commence the lease as per written agreement.

I am rejecting this response because:I am not confident the repairs will be made in a timely and efficient manner. After waiting weeks for the Oven/Range top to be repaired (including wrong parts ordered) the oven completely malfunctioned shortly there after. The tech doing the Oven repair, told me that all the repairs he recommended were not honored, so he couldn't assure me there would be no more issues with the stove. Sure enough, it's not working again. It is extremely difficult to go an excessive period of time without a stove or microwave. I'm not able to leave the house for food anymore because I recently had surgery. Mobility is limited and I won't be able to drive for a long time.I appreciate that Top Properties is reacting to my concern but, am disheartened that the process has taken so long, and important deadlines have expired that brought hardship, and embarrassment to me.In addition, I asked to have a reduction of rent for the upcoming month, since we have not been able to successfully use key features of the home, and absorbed additional costs, and inconvenience by having to order food, and leave home to prepare meals for important events, and out-of- state guests. I have received no acknowledgement of that request.The former resident of this unit told me that Top Properties did not respond to their calls or concerns when she and her family lived here. I was very hopeful that my situation would be different. In addition, I requested to speak to *** (owner of TP directly), the only communication I've seen from him is in his response to Revdex.com. My Property Manager will text, not call and speak with me directly. Their actions aren't reassuring however, I am still hopeful that the repairs will be made, without further mishap. I just want to live comfortably in this place that I have committed to for months and treated respectfully when I present valid concerns that interrupt my day to day living

Top Properties is acting as an agent for the landlord in this transaction and property was delivered in a condition fit for habitation and was more than willing to perform any repairs needed to the property if presented in an appropriate fashion At this time Top Properties is not able to refund the Security Deposit funds as they will be used to pay for the vacancy time caused by the tenants not fulfilling their duties under the lease agreement

I am rejecting this response because:xThe lease clearly states that commencement of the lease is dependent on possession being turned over. The property was not habitable and therefore unable to be turned over. Top properties then by their own standard had 30 days to make home habitable. The landlord and managment company know where the mold is and that it exists. By the terms of the lease top properties did not attempt to turn over possession within those 30 days. By the terms of the lease I am entitled to my deposit. Top properties did not attempt to provide possession of premises within 30 days of agreed commencement date 0f June 1,2016 therefore by terms of lease I am entitled to my deposit of $ 1400.00. In the state of colorado the premises was not fit for human habitation. I am concerened as to the ethics and legality of this business' practices and fear many people have and will be exploited by this company.

Hi, I have been informed that all repairs have been completed at this time.  I do apologize for the inconveniences this has cause.  The appliances being in newer shape did not make them candidates for direct replacement vs repair and the owner of the property wanted to make sure they were not under warranty before moving forward with repairs.  Because of the specialty nature of the appliances our standard appliance company would not work on them.  When parts were ordered and then did not rectify the issues we addressed the issue and ordered the correct parts, but between shipping and install times I can understand that this is a frustrating process. Our first and foremost items we wanted to have completed were the repairs to the property and now that those are complete we will be discussing the possibility of the rent concession with the owner of the property.  The owner will have the final say to this matter and will be working diligently with him to find an acceptable resolution.  I personally will give you a call over the weekend to discuss in more detail.  Thanks, [redacted]
