We are going to issue Mr. [redacted] a refund for his troubles. Mr. [redacted] can pick up his check from Outdoors on Monday April 7 after 1:00 pm. at which time we ask that Mr. [redacted] sign a release form.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this...

resolution only to be satisfactory if the promised check is of the correct amount and is rendered as promised. Anything short of the company's promised refund will result in a new complaint to be filed following the previous outlined process.
Pending the promised refund check we will suspend any process of liens. With the refund check cashed and cleared by bank we will terminate any lien process'

Review: As is indicated in the attached documents, we submitted a trailer to Berglund Outdoors on 03/19/14 for brake repair. Upon suggestion by [redacted] the service manager, we also requested a state inspection.

The trailer was returned to us on 3/20/14 with a new inspection sticker. The brakes were found to still not be working.

State Police were notified and their report is attached. As is cited in the report, we refer you to this code:

[redacted]. Brakes: trailer (GVWR less than 10,000 lbs).

Under the above referenced code it specifically states that only one wheel must be removed per axle. The state police report, based on the testimony of [redacted], clearly states that the inspector did only the minimum required removal of wheels.

Therefore we can now ascertain the following which is self evidenced by the multiple visits required to complete repairs and the very testimony of the mechanics and the service manager [redacted] as outlined in detailing of events in [redacted]’s attached Word documents.

Upon receiving the trailer on 3/19/14 Burglund Outdoors tested and inspected only the right side of the trailer. The left side wheels were never opened or inspected. **If Berglund Outdoors had opened the wheels on the left side of the trailer the mechanics would have found the heat washer that is required behind the castle nut to be missing**. Furthermore, on 3/24/14 both the conduct of again initially testing only the right side, and testimony from the mechanics, bears out that the wheels on the left side were never inspected on 3/19/14.

On 3/24/14 the mechanics still did not report the missing heat washers from the left side wheels that were in place on the right side wheels of the trailer.

These facts then reveal that the service manager lied to the customer when [redacted] phoned [redacted] claiming that “all the bearings” needed repacking. Following the 3/20/14 visit and the 3/24/14 visit the wheels were independently opened and it was found that in both inspections, in fact, the bearings had not been repacked with grease.

The state police report establishes that the wheels on the left side were opened as the mechanic testifies of replacing the magnet on the back right wheel. **This was not reported to the customer and is no where to be found on the receipt or invoice paid. The customer would only learn of this through questioning [redacted] the service manager on an unrelated issue on 3/24/14. It would be this discussion that would reveal the issue that caused the continued brake failure**

Point of order: One magnet on a 4 magnet system can not be independently replaced as it will damage or demagnetized the other magnets. This was attested to in [redacted]’s presence when [redacted] asked the mechanic if just one magnet could be replaced and the mechanic replied “no, you can not replace only one magnet”. The mechanic [redacted] had this conversation with on 3/24/14 WAS NOT the mechanic who had done the work on 3/19/14 as [redacted] had already informed [redacted] that the mechanic who had done the work on 3/19/14 was late and had not arrived as of yet.

On 3/19/14 upon Berglund Outdoor replacing the magnet on the back right wheel; 2 things happened that when undiscovered:

1. The magnet called for is a 10” magnet (as was installed on 3/24/14 by Berglund Outdoor during the second visit; but the magnet installed on 3/19/14 on the right rear wheel (and still in place now) was a 8” magnet.

2. The 8” magnet then initially allowed the other 3 magnets to show brake application upon adjustment. But, then, upon the relocation of the trailer and the subsequent electrifying of the trailer by the tow vehicle, the new magnet overpowered the 3 weak magnets and caused all 3 original magnets to fail. This was discovered and repaired by Berglund on 3/24/14 when the customer returned the trailer for repair visit #2.

Due to Berglund Outdoor’s actions and incompetence, the trailer must now be again repaired so that all magnets are of equal value and the missing heat washers on the left hand wheels can be added to the assembly so as to match the right hand wheels.

This will require the owner/customer to again pay repair costs equal to, or more, of the cost already paid to Berglund for the incomplete work done.

Customer therefore requests a full refund of the initial repair costs made upon visit 3/19-20/14 which totaled $250.06.

Until this matter is resolved, customer will pursue lien options on the following properties:
