In August of 2013, Berkshire Fence made a gate for my driveway. Less than one month after it was installed, we started having problems opening and closing it. I requested that Berkshire Fence fix the gate; they came out about once a month and adjusted it. When winter set in, the gate would freeze and not open at all. For the past 14 months, I have tried to get this company to make the gate useable, but, even though it was under warranty, Berkshire Fence has never fixed it. Today, I received an email telling me to never contact them again and that they will not do any more work for me. Berkshire Fence went to [redacted]'s residence several times to adjust the rollers on the gate. The operators of the gate are opening and closing the gate with to much force and the result is knocking the rollers out of position. SO the gate does not roll easy after the fact. The customers calls Berkshire Fence to come out and "fix" the gate each time it happens. Customer were briefed that you have to walk with the gate when you open and close it. Customer had a dirt driveway when the gate was installed. Customer then had the driveway paved and Berkshire Fence again went back to customers resident to raise/adjust the gate and cut the bottom of the pickets at no charge. The last time we went out to adjust the rollers again in September 2014, customer told Berkshire Fence employees "I know where he live'S" in a threatening manner. That is when we told the customer we would no longer be doing business with them. Customer had a dirt driveway when the gate was installed."I am astonished at what Berkshire Fence has written above. We cannot close the gate with too much force as we can barely open and close it as it is. We have to walk with the gate, and use both arms and hands to get it to move. It's interesting to me that now BF is claiming we don't open it right; BF has never mentioned that before, nor has it ever told us how to open it.[redacted], last year after the gate was finished, said to me, "Wait till you try to open it in the winter. It's going to freeze." Most businesses would not say something like this to a customer; when I asked him what he meant, he said "You'll see." He seemed to think that was funny. He was right; the gate freezes, and I have often had to climb over the fence in the winter in order to get in my house. BF didn't care about that either. The date BF has given you was when they came out to give an estimate; we gave them the deposit on May 9, 2013, but they didn't complete the fence until July 23, 2013 which is when we paid the balance remaining. I had to keep emailing him to see what the delay was.As for the "threat," he lives down the street from me, and I said it as a joke to the last men who came out to try and fix it. They laughed because they knew it was a joke. I have kept every email concerning this situation. I have tried, since last September, to get BF to make this gate right; it was under warranty every time I asked BF to fix it. I guess Mr. [redacted] thinks BF doesn't have to follow through. I have even written to the owner and manager, all to no avail.As for the paving; BF knew it was going to be paved, as they were the ones who told us to pave it so they could make the gate.They measured the gate incorrectly which is why they had to come out and cut the pickets. The bottom of the gate is very uneven now because of that. It also looks terrible. I have asked many times why they didn't just tell me that they couldn't make a gate that size that would work. If we had been told the gate wouldn't work, we would not have spent all that money on it.This gate was under warranty when it first became a problem. I have asked over and over for BF to fix the gate. BF has sent out many people, all of whom have said the gate was too big, they can't really fix it, they would tell BF that it needed to be fixed. His workers have tried, but the real problem is that the gate wasn't made correctly. If it had been, it would work and I would not be filing this complaint.It seems to me that Berkshire Fence should live up to their warranty.Final Business Response The gate is operational, the one year warranty has expired, there was a threat delivered by the customer. Therefor we will not be doing business with them in the future.
