March 18, Dear *** ***,As an Accounting firm, we deal with over 1,customers each and every yearAs you can see from our past history, we have not had any complaints to date.The case of *** ***, was a little unusualWe prepared her return with her and her husband presentI
do not specifically remember the exact events of that day, however, we prepare taxes with clients present in an effort to eliminate mistakes and miscommunications.She phoned our office a few days ago under the guise that she was remortgaging and needed us to provide her with copies of the W-2's that we kept and used to prepare her tax returnMy secretary honored her request by sending her copies of everything we hadApparently, the W-that was missing from their tax return, was coincidently missing from our possession as well.Once supplied with that information, *** *** called the office and wanted to set up an appointment to discuss her mortgageAfter informing her that I could answer any questions over the phone, she finally admitted her real intent was to discuss the missing W-I found that odd and a bit disturbing.We discussed the issue, it became clear that *** *** was not happy with fact that we possibly never received the W-She went on to explain that the missing W-was an exact replica of another W-that we had enteredI was unaware that there was a duplicate W-that was not a duplicateIf this sounds Odd and confusing, I suppose it isIn any event, I offered to amend the return (something we do for no charge)This is common in any Accounting practice and our goal is always to correct a return, whether it is our fault or not.The fact is, she owed the taxI don't owe the taxI would offer to pay any penalty or interest if the error was clearly our faultWith us not having a copy of the W-2, there is no way to prove that we ever received the missing W-Her ploy to get my secretary to send her all the W-2's we had on file, only proved that it was never in our possession.In my years of practice, I have never encountered a client seeking to have me to pay for their tax billThis is unprecedented, irrational and totally illogical. We do everything within our efforts to satisfy our clientsWe care deeply about our clientsI try to counsel and treat them as though they were my own childrenI am sorry that *** *** owes the IRS $1,She would have owed them that money either wayI tried to explain that to herShe interpreted that as my not caringUltimately, a taxpayer is responsible for reviewing all the figures on their returnIf she knew that the income figure looked low, she should have questioned itNone of that took place.Thank you for taking the time to allow me to explain my side of thingsShould you have any questions, please feel free to contact me.Sincerely,David D., CPA

I am rejecting this response because: I feel that as a business this company should half own up to this mistake. David himself even stated to me on the phone that human error can occur wether it be on my end or his. No one can prove either way, so like I said as a business professional he should do what is right. Regardless if I would have owed this money before, that is not the point. If he would have put the missing W2 in than I wouldn't have gotten such a big return back. Should I also mention that since this has occured I have been to another accountant who is going to ammend this mess for me & make it right, has also discovered the David lied to us and said he put us down as having health insurance, when in actuality he put us down for NOT having it in which my husband and I both had health coverage. So now in this case we were charged a penalty & the IRS now owes us money. Clearly there have been a few mistakes made here & I am one unhappy client that wants compensation for all of this hardship I've had to go through.
