In regards to the response to the initial complaint made by [redacted] She states she did not speak the way she did to the office staff at Bert Adams on the phoneShe also stated she taped all of her phone conversations, so if she wants to provide that to the Revdex.com to clear things up, if some kind of mistake was made we, will deal with it in our officeUnfortunately we do not believe a mistake was madeIn regards to the billing, when looking at [redacted] account history, the account has never had a zero balance since she started service in 2013, meaning even when she got bills, or collection letters, or when we spoke on the phone she only paid the minimum to get pickup for a short time, then her account would be suspended due to non-payment once againThere are instances during that time frame in which she told the office she had sent a payment through the mail and the payment never arrived [redacted] was issued a final collection letter because her account is past due and her account history shows payments are not made until she either has a service suspension or a collection letterShe stated in the final phone call we had she was not going to pay the bill, she wanted to see what the Revdex.com was going to do for herBert Adams has compromised on billing in the pastA credit due to her dissatisfaction was issued on 1/8/for week of service in the amount of $simply because we were trying to make her happy, not because it was owedEven this adjustment in her favor was not good enoughWe will not be compromising on the balance due In reference to her complaints about the trash not being picked the last good half of the year, her account was suspended several times, once again due to non-paymentThe unpaid bill cannot be blamed on not getting a bill when she calls in and we let her know she is only paying a portion of a past due bill [redacted] states she wanted this response by Thursday which was 3/10/The Revdex.com letter postmark date is March 8, in Buffalo, NYWe did not receive the letter until 3/10/

In their reponse to my complaint, someone at the company wrote that I never called Bert Adams Disposal untill 11/11/16.This in fact is untrueI remember calling the company when I received my very first invoice from themBut at that time I was not made aware that I was being charged more for their service just because I was part ot the Waste Management buyout.This practice just isn't ethically or morally right! Why would anyone think to ask if they are being charged more than their neighbors for the same service ?All I have done is pay my Bert Adams bill on time and never asked any questions until now when I was told by Julie, Bert Adams Disposal employee , that they adjust their rates when a customer calls to complain.Also, I am still waiting for a call from MrBert Adams to discuss this furtherI made this request on 11/14/16.My next step is to contact the Attorney General 's office.I have contacted our local Chamber of Commerce The Chamber of Commerce is very interested in the outcome of my complaint.Thank you for your time and help with this issue

So when I called THEY WOULD TELL ME WHAT TO PAY. So that's on them.Also only taking out part of the garbage out of the can has nothing to do with my bills has to do with their poor employees not having the right truck to pick up the can and they have to dig inside themThird they are the ones that said they tape recorded the conversation and I said maybe maybe I did tooSo if they are that concerned then why don't they provide the recording.Now it's past the 20th and they are going to ruin my credit and take me to courtSo now what because I am being an adult and admitting things I'm going to have to payHow is that fairI am being reasonable unlike them Half is what is right

customerAs stated by Mr*** he was putting money out to the curb with his trash to get it picked upIt is against
Bert Adams company policy to conduct business in this way, therefore Mr
***'s trash was left at the curb along with a service agreement so he could sign up for service as an active customer on recordNo
prior notice was given as no name or phone # were available
Unfortunately this is a very rural area and our trucks only provide services here one time per week, it was not possible to go back and pick up the trash another day as was demanded by Mr***Per
the inappropriate email that Mr*** had sent we had
assumed he was making other arrangements for disposal serviceHe did not return our service agreement and he had made no other communication to usLast we heard from this customer was through the complaint filed through the Revdex.comThank You, Bert Adams Disposal

In response to the 2"d letter from *** *** with regards to her complaint of being overcharged for services I can only again say that she was charged thesame amount that she had been charged from her previous hauler at the time ofthe acquisitionShe states she was being charged more than her neighbor for the same serviceShe did not say whether or not her neighbor had the same hauler as herselfIf her neighbor had a different hauler, they may not have had the sameserviceSome haulers offer trash carts as part of their service, some do not, somehave or can limits which are serviced at different ratesThere are many different services offered at different ratesIn the case of Ms***, the company she was acquired from did offer carts to their customers and thereforethe rate was different than what the rates at the time were for Bert Adams Disposal as we did notIf her neighbor had the same company as she did, *** ***, then their rate was comparable to hersMany different companiesthat offer the same types of service may have different plans and different rates,like a cell phone companyThere are many companies to choose from with manydifferent options and ratesIt is up to the consumer to choose the company andrate that is best for themMs *** chose *** *** which was inturn acquired by Bert Adams DisposalAs stated in the previous response; Per contractual agreement the rates for the customers acquired from *** *** could not be changedIn reference to the phone call with Julie, it is stated that Ms*** was told Bert Adams Disposal adjusts the rates when a customer calls to complain.When a customer calls to "Complain", or inquire about the rate they are paying,the customer's rate is evaluated on a case by case basisIn the case of a *** *** customer complaint they would have been told up until wewere unable to change the rateThe rate they have with Bert Adams Disposal isthe same rate they had with *** *** and we were unable to changeitIn Bert Adams Disposal started matching the price of our competitors such as do *** and *** ***If someone received a solicitation or found abetter offer through their own research and inquired about the rate they werepaying, we are now able to match itThis is what has happened in Ms***caseShe notified Bert Adams Disposal she would receive a lower rate with acompetitor and we matched it.Ms*** had made a request to speak with MrBert Adams when shehad called on 11/11/She did not receive a return call from MrAdams because he employs staff to handle the day to day affairs of the business in his placeA supervisor would take the place of MrBert Adams in a case such as thisIf Ms.*** would like to speak to a supervisor that can be arranged, however thesame explanations will be given over the phone as in this written response.Bert Adams Disposal has explained the circumstances with regards tocontractual obligations regarding the acquisition of *** *** and therate freeze that was in effect for a certain period of time thereafterAs previouslystated in the last response Ms*** account was credited at the newlymatched rate as a courtesy for the current quarter which had already been billed at her regular rate, and she was also credited for the previous quarter at the newrate which had already been billed and paid.At this time Bert Adams Disposal feels we have done all we can do to offeran explanation and give Ms*** the best rate we can for the service provided to herBert Adams Disposal

Unfortunately we do not believe a mistake was made. In regards to the billing, when looking at [redacted] account history, the account has never had a zero balance since she started service in 2013, meaning even when she got bills, or collection letters, or when we spoke on the phone she only paid the minimum to get pickup for a short time, then her account would be suspended due to non-payment once again. There are 3 instances during that time frame in which she told the office she had sent a payment through the mail and the payment never arrived.             [redacted] was issued a final collection letter because her account is past due and her account history shows payments are not made until she either has a service suspension or a collection letter. She stated in the final phone call we had she was not going to pay the bill, she wanted to see what the Revdex.com was going to do for her. Bert Adams has compromised on billing in the past. A credit due to her dissatisfaction was issued on 1/8/16 for 1 week of service in the amount of $6.73 simply because we were trying to make her happy, not because it was owed. Even this adjustment in her favor was not good enough. We will not be compromising on the balance due.             In reference to her complaints about the trash not being picked the last good half of the year, her account was suspended several times, once again due to non-payment. The unpaid bill cannot be blamed on not getting a bill when she calls in and we let her know she is only paying a portion of a past due bill.  [redacted] states she wanted this response by Thursday which was 3/10/16. The Revdex.com letter postmark date is March 8, 2016 in Buffalo, NY. We did not receive the letter until 3/10/16.

In response to the complaint that was received by J[redacted] at [redacted]; we have at least 7 service interruptions clue to non-payment ofservices between July 2013 and February 26, 2016. If trash is not picked up due tonon-payment she becomes very demanding, is quite rude,...

screaming and yellingat whoever answers her phone call. Our office has explained several times if thereis an interruption to services due to non-payment, service will resume on the nextscheduled service date after the payment to bring the account current has beenmade. This policy is always a problem with [redacted] and she requests credit on heraccount which she is not entitled to.The phone call with [redacted] on 2/26/16 started with her screaming andyelling at the person who took the call because her trash had not been picked updue to non-payment of her account. She was told her service would be resumedif the past due amount was paid and her account was brought current. She saidshe would pay what she felt was fit and we told her that would not get her servicereinstated. During this phone call she did call the person she was speaking with a -—ing whore. At that point the phone call was ended. [redacted] called our officeback at which time she spoke with a different person who told her we would nottolerate the way she spoke to our office staff and it might be time to pick up thetrash receptacle and end our relationship with her as it seemed we were unableto make her happy.There were items put out for pick up that are not included in the weeklyservice rate such as the rug that was mentioned in the complaint. A customer thatputs out an item such as this must call before the pick-up day to giveauthorization to the extra charges that will be added to their account for this. Nosuch authorization was received so the item was not taken.Bert Adams Disposal made numerous attempts to work with [redacted] andachieve some level of satisfaction for her even when the fault in interruption ofservices was her own.

The response of Bert Adams Disposal is false. They never gave, sent or attached to my garbage any pamphlet or notice or "service agreement" to explain why they suddenly and without warning stopped picking up my garbage.  I guess there is no way to resolve this issue, I have made other arrangements, but I would just like the record to state that this letter I was sent from Bert Adams was factually inaccurate.

With regards to the complaint from [redacted] that Bert Adams Disposal overcharged for trash disposal in the amount of $50.00 per quarter since 2014 we offer the following explanation.Bert Adams Disposal purchased the customer base of the local division of Waste Management in 2013. It was part...

of the agreement that the accounts purchased would have no rate changes made for a set period of time per the terms of the legally binding contract. Customer rates remained the same as they had been while being serviced by Waste Management. Bert Adams Disposal has acquired other companies along with Waste Management and the agreement is the same with each; customer rates remain the same as they were with the original service provider before the buyout. Therefore Bert Adams Disposal does not have one set rate as was implied in the complaint and the customer was not overcharged. She was paying the rate she agreed to pay for trash service provided by Waste Management, which was transferred to Bert Adams Disposal.At any time a customer has the freedom to contact a service provider and inquire as to whether or not there might be a lower rate for services or a promotion available. At no time other than on 11/11/2016 was Bert Adams Disposal contacted by [redacted] with regards to the rate she was paying for services. Had she contacted Bert Adams Disposal with questions regarding her rate she would have been told we were not able to change it because of the terms of the acquisition of Waste management. There was a time period associated with the agreement and now that time has expired. No refund is due to the customer. We do price match and lowered her rate to match a competitors price, and did back date that to the beginning of the last quarter as a courtesy.Bert Adams Disposal looks forward to continuing to provide services for [redacted]
