I hate even to come here to file a complaint, but here I am. I decided to cancel my service with Berwick Gas and go to a different company for our propane, due to various reasons. I called Berwick Gas, told them of my change in service, and that they could come to pick up their tanks. Berwick Gas informed me that someone would come to get them the next time they were in the area, okay, great.
Around a month goes by with these tanks sitting in my front yard, I figured I would give them a few more weeks before I called again to remind them of these tanks. However, I come home, around the middle of February 2020, to find the tanks are gone. YAY, tanks are finally out of my yard! Wrong! I get a bill in the mail for nearly $1,350, saying I owe them for tanks and parts.
Of course, I called, not understanding what the heck this bill was for! I get a woman who was less than desirable to speak with, but then again I did say I am not paying this bill, I do not have your tanks, and I will not pay for something I do not have. This woman proceeded to “threaten” either sending the unpaid bill to collections, or to the magistrate; she would need to discuss this with her manager. Okay, wow! Either way, I am not paying for tanks I do not have on this property anymore.
I asked her what she thinks I did with the tanks; these tanks are big and bulky; I did not move them or place them in my home for decoration. Furthermore, I have new tanks and a new company! I do not know where these tanks that belong to Berwick Gas are IF they do not have them! Then, she suggests I call my new propane provider to see if they took them! I know they did not, the man unhooked Berwick Gas tanks and left them in my yard! I can only speculate that their employees took them, who else could get these large tanks? But are now trying to charge me an outrageous amount of money, either by accident from misplacing their containers or on purpose, I am not sure! But, I do know one thing, I am NOT paying for tanks I do not have! How can Berwick Gas take their tanks, which I suspect, and then turn around and try to get one last significant amount of money from me?
Now, Berwick Gas can respond to this any way they see fit, but one fact remains, their huge propane tanks are not on my property anymore, they are more than welcome to come “search” my property! Further, I never touched them, nor could I move them! Where are the mystery tanks? I cannot say with certainty, but this matter needs to be addressed asap!

Berwick Gas Sales Response • Mar 23, 2020

First, and foremost, Berwick Gas Sales, Inc. did not remove out tanks from this customer's property as of yet. There was a very limited time between the day the work order requesting the tanks to be picked up was originated (2-26-2020) and the day we went out to actually pick up the tanks (2-27-2020).

Second, this customer only recently moved in to the property where our tanks were located (June 2019). Since that time, they have ordered only one delivery (Nov. 2019). This leaves a considerable gap in the timeline that the customer sets forth. According to the account history, we've routinely made monthly deliveries to this property for many years in the past. Whether or not that factors in here I'm not sure. Everyone does use their heat differently. But there's a lengthy gap in service that doesn't fit this situation. Our tanks could've been gone well before this person decided to call us to have our tanks "removed".

Seeing how our tanks were on the customer's property one day, and that's according to the customer, only to have have missing very shortly thereafter, is very odd. In fact, I find the entire complaint very odd. There is little-to-no detail. There is no reason given as to why or who the customer switched propane company's. There is no mention of any dates at all. In fact, the only thing that is mentioned by the customer is what they won't do.

It is at this point I would refer the customer to the local police department. If a theft has occurred on their property, perhaps it is best to start there. It would also be a good idea to check with the home owner's insurance company and policy. If we haven't picked up our tanks and the customer claims they have no idea how or when the tanks were removed from their property, then as the customer states, we do have a mystery.

Thank you,

If there are so many witnesses to everything the customer states, maybe there could be a witness to the tank removal. The customer (and their many witnesses) seems very aware of the tank's movements but only up until the point they disappeared. Now that is weird. For what it's worth, each tank has a unique serial number on it.

Complaint: ***

I am rejecting this response because:

UGH! There is obviously no talking to Berwick Gas! These tanks were removed by YOU or someone else, I have no idea which is true. And of course, I know where the tanks were till they were gone! Berwick Gas seems to think I am hiding their tanks for some stupid reason. Whatever, it has been noted that I do not have these tanks and will not pay for them! I would rather pay 5K for a lawyer to fight you rather than pay an unjust bill at this point! Furthermore, YES, I do have several witnesses up to the day you took the tanks, which is what I suspect. In any event, you will not get money from me, whether you kill my credit, which I don't care, or if we fight it out in court, whichever! I am done with Berwick Gas! I will continue to reject any response, unless it is a reasonable response of getting rid of this outrageous bill. In any event, am not going to argue over old, rusted, leaking, tanks any further!
Regards

February of 2017, I made a contract deal for propane with Berwick Gas sales for $1.39 per gallon. I property maintain for a multitude of places. Approximately 10 different units all requiring propane. Over a short period of time, they had changed the amount and very quickly fixed their mistake. On 3/8/2018 they delivered propane and increased the price too $1.78 per gallon without notification, however, I wrote a check for payment for approximately $338.12 (@ $1.61.8 per gallon)With notation that the bill is paid in full. They accepted said payment. This amount was higher than our locked in rate and lower than what they changed it too

To whom it may concern,

I'd like to start by saying we had no such lock-in price agreement or contract with *** at the time of the delivery in question. Even if we had, any and all of our contract prices expire during July of the summer following the heating season. In this case it would have been the 2016/17 heating season. The delivery in question was well after July, 2017. In fact, *** received and paid for subsequent deliveries at a different, higher rate than the one he is complaining about here. For example, *** received and paid for 2 deliveries at $1.89 per gallon on November 24th and December 22nd of 2017.

The price of propane fluctuates daily. That is why any residential contracted price or lock-in rate only lasts for months, not years. ***'s complaint in unfounded.

Berwick Gas was giving me delivery issues so I changed companies. There was still 50% in tank of propane when they came to pick it up. They are charging me for the full amount which I did not use. They told me it was my choice to return the gas and I still owed for it. They also threatened me they would ruin my partner's credit as the bill is in his name. They are crooks and need to be dealt with. I told them I was reporting them to you folks and he said, " Go right ahead." I do have a picture I took of the gauge at 50%.

Berwick Gas Sales Response • May 17, 2019

I would like to start by saying that *** is not a customer or client of Berwick Gas Sales, as we have no record of an account in her name. However, I will address her concerns. *** clearly states that it was her decision to change propane providers. Upon doing so, we were asked to remove our tank at the request of a customer. And that is exactly what we did. It was not our choice to stop doing business with this customer. It was not our choice to pick up our tank at this specific time. That decision was made by the customer, and only the customer. They were more than welcome to use whatever gas happened to be in the tank. But they chose not to before demanding we take it back. They were the ones who decided to return the tank before using the gas up. And for what it is worth, there wasn't even anything wrong with the gas.

Ran out of propane in this cold weather and the company I have been using for 2 yrs refused propane because of *** not paying the bill yet

Customer Response • Jan 30, 2018

the issue has been resolved by myself and the company

Berwick Gas Sales Response • Jan 30, 2018

This complaint surprises me. The customer specifically requests that we do not deliver propane until she calls us and requests a delivery. She, as well as all of our customers, are informed that we require a minimum of 24-48 hour notice to fulfill delivery requests. Furthermore, the customer has 2-120 gallon propane tanks of our's to use. However, this customer will not allow us to fill both tanks. Instead she orders the minimum delivery, which is 100 gallons at a time. In the end there is 1 person, and only 1 person, who is responsible for allowing *** to go without propane - *** The customer will often carry a balance for months at a time without making a single payment. *** delivery payments do not figure in to this matter as 90% of the funds were already received and used up prior to this latest delivery request. There is no basis for this complaint. Delivery was made in a timely fashion on 1-29-2018.
