By that rationale - Mr.*** (President) of Besse Construction, was not present himself Therefore I do not see how this is relevant to this claim If Mr. *** (President) of Besse Construction feels it necessary to involve other parties to verify what was said and to whom on what date - please let me know and it will be provided.
Additionally - this has no bearing on the actual complaint and subsequent false service charge of $Please refer to my previous response made on July 07, 2014.
On May 14, 2014, an employee of Besse Construction was dispatched to my address At that time the employee indicated to another occupant of the home that the breaker (which I had been referring to as the on/off button) outside near the AC unit should have been turned on after the installment of the unit, but it was notThe installment and completion of service would indicate that the AC was operationalThe breaker not being turned on would obviously make the operation of the unit null and void
I believe the misunderstanding to lay with Mr. *** (President) of Besse Construction and/or his employee
Also on July 23, - I received your email indicating that the complaint had been “closed as unresolved' due to lack of response from Mr. *** (President) of Besse Construction and/or a representative for Besse Construction. Was this made in error? If so - please provide clear and concise directives on how to close this issue permanently.

repair that was asked to be paid by customer in question. An employee of Besse Construction was sent to customer's
home to provide infomation on what would be...

needed to make any necessary repairs on the AC unit installed by
Besse Construction. The issue was not the AC unit in question but instead involved a thermostat which at no time
Besse Construction installed or serviced. The $75.00 charge that was invoiced to customer was strictly a service call
fee for the time and service provided by Besse Construction. AC unit was fully looked over by Besse Conshuction at
time of call and determined the thermostat was indeed the issue. After service call was completed [redacted] spoke
to customer and provided her the detail of a lock on the thermostat that needed a pass code and she could attempt to
bypass herself or Besse Construction could install a new thermostat. There is no On/Off switch on AC unit indicated
by customer in the complaint and there was no issue with installment of AC unit. This was again related to a
thermostat already installed previously at customer's home. Customer indicted in desired settlement of this complaint
that she wanted to be contacted for further information on the issue around AC unit and the estimate to fix. In
response to this we have attached the last text message sent to customer on May 15th at 9:26 am explaining the cost for
service call and additional cost if customer desired for new thermostat to be installed. There was no cost to the
customer for any repairs of any kind (only service charge for time of Besse Construction to look at the issue). There
was no response from customer to the last correspondence via text message or the two emails that followed.
Customer was sent late notice of $75.00 chargeand still owes Besse Construction for the service call on June 16th 2014
at 10:52 PM.
The bottom line is that the AC unit in question could have never been turned on with a locked Thermostat which was
indicated to customer at time of service call.
Besse Construction is committed to our customers and prides ourselves in no wrongdoing to the customer at any time.
We hope this matter to be resolved and customer has an understanding of what is being asked of service charge at this
time.

The correspondence I received "the bottom line is that the AC unit in question could have never been turned on with a locked thermostat which was indicated to customer at time of service call". By this rational the thermostat would not have allowed me to make adjustments on it.  THIS IS INCORRECT, I was able to make adjustments to the thermostat (from 75 to 70 degrees). I contacted Besse Construction on May 12, 2014 informing them of that fact, as well as a visual inspection on the AC at that time - indicating it was not running. 
On May 14, 2014, an employee of Besse Construction was dispatched to my address.  At that time the employee indicated to another occupant of the home that the breaker (which I had been referring to as the on/off button) outside near the AC unit should have been turned on after the installment of the unit, but it was not. The installment and completion of service would indicate that the AC was operational. The breaker not being turned on would obviously make the operation of the unit null and void.
In addition, Mr. [redacted]’s employee made an attempt to adjust the thermostat. Due to his unfamiliarity with the system, this caused the thermostat to be locked. I informed Mr. [redacted] that I had unlocked the thermostat through my own diligence, to which he responded “Well, aren’t you a smart cookie”. This is not the level of professionalism that is expected from a license contractor and/or business owner.
By admission of the Besse Construction employee, in order for the unit to be functional, it should have been turned on after the installment, it was not.  Therefore, this 'service call' should be considered part of the original contract to install the AC unit and make it operational.  No Additional cost incurred, as this was the culmination of the original contract.
